MINUTES OF THE REGULAR MEETING OF THE PLANNING COMMISSION
HELD ON MARCH 22, 1982, IN THE COUNCIL CHAMBER, CITY HALL
CUPERTINO, CALIFORNIA

APPROVAL OF MINUTES: It was moved by Com. Koenitzer, seconded by
Com. Binneweg and passed unanimously to approve the minutes of the
regular meeting of March 8, 1982 with the following amendment: Page
3, paragraph 6, last sentence to read, "Letter of appeal should be
sent to the City."

PUBLIC HEARINGS
1. Application 24-TM-8l (Revised) of K-Land Consultant Engineers,
Inc.: Tentative Map Revision to modify a condition of approval to
allow vehicular access from McClellan Road and Environmental Re-
view: The project was previously assessed, hence, no action is
required. The subject property is ilL" shaped and is located on
the south side of McClellan Road approximately 100 ft. west of
De Anza Boulevard and continues around to De Anza Boulevard 145
ft. south of McClellan Road. First Hearing - Tentative City
Council hearing date - April 5, 1982.
Assistant Planning Director Cowan reviewed the application with the
Commission.

Kamil Navai, K-Land representative, reported to the Commission that
he had altered the design to permit traffic from McClellan be "right
turn out" only.
Ken Small, 20545 Blossom Lane, expressed his concerns of privacy and
the noise level.
It was moved by Com. Blaine, seconded by Com. Koenitzer and passed
unanimously to close the public hearing.
It was moved by Com. Koenitzer, seconded by Com. Blaine and passed
unanimously to recommend approval of Application 24-TM-8l (Revised)
per Standard Conditions 1-14; 15 and 16 of staff memo and the findings
and subconclusions on the staff report. The Commission further concluded
that the right turn only egress from the site onto McClellen Road will
result in better internal circulation, greater fire safety, and will
result in less traffic on De Anza Boulevard.
2. Application 2l-U-80 of Far West Savings and Loan Association
Amendment of Previously approved use permit to delete the requirement
that construction of the residential portion of the project begin
prior to occupancy of the commercial building and Environmental
Review: The project was previously assessed, hence, no action is
required. Said Property is located at the southwest corner of
Stevens Creek Boulevard and Finch Avenue. First Hearing continued.
Tentative City Council hearing date - April 5, 1982.
Assistant Planning Director Cowan reviewed the application for the
Commission. He referred the Commission to a letter submitted by the
applicant.
Jim Capatano, Senior Vice-president of Far West Savings & Loan, asked
for a delay on his application to build townhouses until the money
market is better which would probably be approximately 18 months. He
stated that the grounds will be kept clean of debris.
It was moved by Com. Blaine, seconded by Com. Binneweg and passed
with Com. Koenitzer dissenting to approve a continuance for 60 days to
enable the staff and applicant to evaluate security and liability
concerns related to the removal of a 6' temporary fence; the staff
is authorized to issue a certificate of occupancy for the Savings &
Loan building; the authorization is granted contingent upon maintaining
the housing site in the manor stipulated in the applicants letter of
March 22, 1982 (except fence removal).
3. Review of Below Market Rate (BMR) Program and Subcommittee Final
Report: Consideration of modifications of llMR Guidelines regarding
implementation of the BMR Program. First Hearing continued.
Tentative City Council hearing date - April 19, 1982.
Assistant Planning Director Cowan reviewed the charge Council had
directed to the Planning Commission.
CDBG Coordinator Hendee reported that sales and interest rates are
factors that the developers are concerned about. One factor that
could be discussed was abolishment vs. modification.

Camm. Blaine expressed her concerns about the standards used in
selecting buyers. She suggested setting up a committee with the
staff, builders of BMR housing, possibly a Council representative, an
a Planning Commissioner to set up some stringent criteria that could
be monitered closely to insure that only first time buyers would be
eligable.
Alf Modine, 10385 Prune Tree Lane, suggested pro-rating the BMR
requirements until interest rates drop.
Lucy Tyler, Midpeninsula Citizens for Fair Housing, said she felt
that the present income requirement for BMR purchases should be more
flexible.
John Vidovich, De Anza Forge developer, expressed that he is not
against providing housing but wanted to know who was going to pay fo
it because developers cannot sell what they have on the market and
he felt it was unfair to build a unit and sell it under cost.
Gary Johnson, Woodspring Project, described various cost factors
which could include underground parking, elevators and construction
fees; however, by putting cheaper fixtures, cupboards, carpeting and
bathroom fixtures in, the cost could be cut down a little.
Marty Hall, Town Center Development, spoke on density and the cost
per unit. He pointed out that the BMR units are the first sold
resulting in an immediate expense to the developer. He would like
to spread the BMR sales over the general sales time.
Jason Charier, developer, stated that the few BMR units he has avail-
able are the only ones being sold.
Charles Newman, 22270 Homestead Road, opposes the BMR program and
would like to see it abandoned.
Tom Randazzo, 10920 No. De Anza, spoke on affordable housing, and
Lucy Tyler, Midpeninsula Citizens for Fair Housing, informed the
Commission that Palo Alto has off-site BMR units.
Assistant Planning Director Cowan suggested to the Commission that
staff prepare a series of alternative paragraphs for each of the
major factors.
It was moved by Com. Koenitzer, seconded by Com. Blaine and passed
unanimously to continue the discussion on April 12, 1982.

UNFINISHED BUSINESS
4. Applications l7-U-80 and 13-TM-80 of Woodspring, Inc. - Request
for Extension of Use Permit and Tentative Map.
Assistant Planning Director Cowan reviewed the applications and asked
that the Commission approve the staff recommendation. Mr. Cowan
explained that the applicant had initiated the use permit by conduc-
ting site work. However, due to market conditions, continuous

construction will not be maintained, therefore, the use permit should be
extended.
It was moved by Com. Blaine, seconded by Com. Koenitzer and passed unani-
mously that an extension of one year be granted to April 13, 1983 for
Application 13-TM-80
It was moved by Com. Blaine, seconded by Com. Koenitzer and passed unani-
mously that an extension of one year be granted to February 22, 1983 for
Application 17-U-80.
By consensus, the Commission agreed to meet April 28, 1982 to consider a
Comprehensive General Plan Amendment.

REPORT OF PLANNING COMMISSION
Com. Blaine reported she attended the school board meeting where a
discussion on selling, closing or keeping sites was held.
