Staff Presentation: Mr. Piasecki reviewed the Application and commented as follows:
- Presented Pro,posed Residential Ordinances: Setbacks - Miscellaneous Reqµirements
- Draft Ordinance YYYY, Section 4.9 Day Care Homes, Family and Section 4.10 Day
Care Homes, Special, would be addressed by Ms. Lopez
- Suggested a Minute Order be sent to Council addressing the overlap period
Com. Adams commented as follows:
- Draft Ordinance YYYY, Section 4.30, questioned the radial front setback lirte;
Consensus reached that the diagram be altered showing a front setback arrow in center
- Draft Ordinance XXXX, Section 12.2 Minor Variations in Setbacks and Hei!!ht, sug-
gested deleting the Section since determinations reached by neighbors was not planning.
Consensus reached to accept suggestion, deleting the entire Section.
Com. Szabo asked that in Draft Ordinance XXXX, Section 8.3.2 Side - Minimum, further
clarification be provided; language to be added to state that in instances where both setbacks
were less than ten (10) feet, the wider of the setbacks shall be maintained.
The Public Hearing was then opened.
Mr. Richard Childress, 11701 Regnart Canyon Dr., Cupertino, commented as follows:
- Presented results of a study on Buildin~ Hei~ht vs. Pitch. Variable Gable Width
- Noted that the smallest house studied had a 27 ft. height; study showed that the smallest
structures had the higher fIxed gables
- Asked that a 28 ft. height limitation be considered; such seemed to be what was already
;n the housing market and secondly, such allowed the City to exercise some control over
height and bulk
- Had already addressed his comments on the .48 FAR preferred
- Was favorable to the Draft Ordinances as proposed
Mr. Tom Wen, 7717 Oak Meadow Ct., Cupertino, commented as follows:
- Cited an example of privacy impacts from adjacent property owners
- Suggested that agreements be reached with existing property owners before new struc-
tures were allowed to prevent such impacts
Mr. Cowan added that Mr. Wen approached him regarding impacts from a flag lot (side
yard abutting rear yard); he suggested the speaker address the Commission on this issue.
Com. Claudy noted his continuing opposition to flag lot development for the reasons cited.
MOTION: Com. Claudy moved to close the Public Hearing
SECOND: Com. Mackenzie
VOTE: Passed

Com. Mackenzie questioned Draft Ordinance XXXX Section 8.4.2 Side - Minimum, D.
Comer Lot and asked for clarification of individual property owners rights; examples cited.
Mr. Piasecki suggested that if the Commission were considering the height limitation such
be amended in the Rl Ordinance only, leaving RHS, A and Al Zoning Districts as stated.
Consensus reached by the Commission to amend the height limitation to 28 ft; such to apply
to the Rl, A and Al Zoning Districts; RHS Zoning Ordinance to remain unchanged.

MOTION: Com. Adams moved approval of 2-EA-88, 3-EA-88 and 4-EA-88.

VOTE: Passed 5-0
Ms. Lopez noted that irt Draft Ordinance YYYY Section 4.9 and Section 4.10 would be
subject to new State guidelines.
MOTION: Com. Adams moved to approve a Resolution recommending adoption of the
New Residential Zones for the Rl, RHS, A, Al Zoning Districts, with the fol-
lowing amendments: Heiiht Restriction in the Rl, A and Al Zonirtg Districts
amended to 28 ft limitation; RHS Zonirtg Qrdirtance height limitation unchang-
ed. In Draft Ordinance XXXX, Section 8.3.2, Side - Minimum, language to
be added to state that in instances where both setbacks were less than ten (10)
feet, the wider of the setbacks shall be maintained; delete Section 12.2 MiJ1Qr

MOTION: Com. Mackenzie moved to send a Minute Order to Council recommending that
the effective dates of the new Qrdirtances overlap with the irtterim ordÌl1ance by
a three month period of time during which both the existing and the interim
ordirtance would be applicable.

VOTE: Passed 5-0
NEW BUSINESS:
ITEM 2: Application 28-U-80 - Digital Equipment Corporation - Request of interpreta-
tion of a minor amendment.
Staff Presentation: Mr. Cowan reviewed the request, presented site photographs and a
diagram of the structures.
ApD!icant's Presentation: Mr. Ron Ronconi, Architect, stated that confusion resulted from
the fact that the project was phased; during the second phase, the shell was constructed.
The parapet was now painted to match the building; he confirmed that the building was
pre-cast concrete with an asbestos pipe and sheet metal attached to the top.
MOTION: Com. Claudy moved approval of a Resolution recommending approval of a
Minor Modification of Use Permit Application 28-U-80 to allow a 6 ft. high
parapet extension on top of the Digital Equipment Building (former Trilogy
Building) located at 10500 Ridgeview Ct.
SECOND: Com. Adams

REPORT OF THE PLANNING COMMISSION:
Chr. Sorensen reported a fence on Garden Gate Dr. which appeared to be a fire hazard
She extended the invitation of Mr. Mark Hancock for the Commissioners to tour Vallco
She noted the placement of some automatic teller windows to the rear of bank buildings;
possible safety hazards were cited; she asked that the Sheriffs Department be made
aware of the situation
Com. Szabo requested information on the status of Blackberry Farm
