De Anza Blvd.. and Route 280 for a distance of approximately 2500 ft,

The Director of Planning and Development reviewed the iIlitial
hearing on this proposal. There were concerns in regard to the
integration of this use with the nearby residential. He next
reviewed the composit map of this entire quadrant of the City. He
noted the applicant has agreed to additional landscaping along the
easterly border line, adjacent to the residential.
Comm. Koenitzer observed there is a lZ" sewer line running along
Mariani Avenue and he suggested there be a requirement of an ease-
ment to maintain it, since Mariani Avenue is going to be shifted.
The Director of Public Works stated this lZ" sewer line has been
taken into account and it will probably be shifted since the
roadway is being shifted. If not, there will be an easement.
Comm.. Køenitzer asked about the ratio of standard to compact size
parking spaces. The Director of Public Works stated about 1/3 of
the parking spaces are devoted to compact 'cars.
Comm.. Gatto was concerned about the location of the curve in the
street coming into De Anza Blvd. The Director of Public Works
stated it is a safe distance. He also answered Comm. Gatto that
there are about ZOO ft. between the two cul-de-sacs, and the
walkway/bike path between them will be in public ownership.

Comm. Gatto was assured by the Plannin~ Director that the appli-
cant'meets the parking ratio requirement on the north side of the
cul-de-sac.
Comm., Gatto commented that the prior determination-was' no access
to Lucille Avenue.
Chairman Adams asked for comments from the audience.
Mr. H. N. McLaull;hlin7 Jr.. 10643 Larry Way, Cupertino, wanted to
know how close buildin~s 1 and 4 on the exhibit are to the
residential to the east. He was told this is ZOO', Mr. McLaull;hli
said he is concerned about the warehouse loading dock location.
In regard to the architectural and site public hearings; he would
like to be notified when these public hearings take place. He
would l'ike to be' present to discuss sound walls with the consultan

and phone number and he would be notified.
Mr. Jim Holt, 10510 Larry Way, Cupertino. asked about the status
of the B .A.S. homes in this area. He was told their application
will be heard by the City ,Council on September 7th. Mr. Holt said
he would like to have the sound wall along the residential in-
stalled prior to or during the major construction of the industria
park. The Director of Public Works said this is the recommenda-
tion of the staff.

Mr. Holt wanted the City to make sure that the fire trucks have access
to this area. He then asked about the requirement for 32 vans for the
van pool. The Planning Director explained there was a recent meeting
of a committee, headed by Councilman Jackson, regarding van pools.
Mr. Sobrato is aIso a Member of this Committee. As a result of this
meeting, Condition 24 of this application has been revised.

The Director of Public Works said the City Council has requested the
Environmental ~pact Report evaluate the traffic at De Attza Blvd, and
Mariani Avenue. Condition 33' addresses this issue. There will be a
double left turn lane into Mariani' Avenue.

Mr. Carl Berg. of Sobratò-Berg, 2735 Middlefield Road. Palo Alto, said
they intend to submit something in writing to the staff in regard to
the sound waIl construction prior to construction of the development.
He said the present loading dock location is very important to the project.
An 8' _11 will be ,sufficient. according to their consultant. He said
25% maxtœwn of the parking lot will be for compact cars. He said that
the sewer line will be moved and relocated if a building is to be put over
it in its present location. Otherwise, they will provide an easement.
Mr. Berg said the School Board has approved this street design. He said
the drawings for the sound wall will be complete in time for their hearing
before the Architectural and Site Approval Committee. The sidewalk will
go all along Mariani Avenue to the cul-de-sac and walkway. CODDIl. Gatto
asked how they arrived at that configuration for the cul-de-sac. Mr. Berg
said it gave more advantageöus use of the property on the other side. as
well as meeting the conditions. They eliminated the drive along::Larry
Way residential.
Mr. Berg said the restaurants have told him they are not interested in
this location without curb cuts. It is Mr. Berg's opinion that the City's
proposed joint access roads will, create traffic safety problems. He
would like to have the restaurant access curb cut 350-400 feet south of
the entry to Building 3.
Mr. Sobrato commented on the staff's suggested conditions:

18. He asked when the determination will be made on the suggested park.
He would like to have it resolved at the September 7th meeting. The
Director of Planning and. Development stated it was his understanding that
the City Council is not interested in a park in this location. The
Planning Commissioners agreed that this was not a very good location for
a park. The Planning Director suggested that perhaps. in the future, they
will consider a park adjacent to Collins School.
22. Mr. Sobrato said they felt they should be reimbursed their fair share
when the property to the west develops. The Director of Public Works
said this can be worked into the Agreement. However. he would pref erito have the wording of Condition 22 rBmSin.

In regard to Condition 24. Mr. Sobrato said they met with
Councilman Jackson and as a result of that meeting, they now only
have to purchase 4 vans. Rowever, they feel they are being made
the City's "guinnea pigs". He suggested the City employees be th
"guinnea pigs" and have their own van pool. Then if the project
works ,he will also do it. He, personally, does not believe it
w111 work. Re said the 3M experiment was done in Minneapolis,
where there are severe winters and a round trip of 3S miles. Her
the employees will probably live S miles from work. Lastly, he
šaid if the City feels that strongly about it they should conside
devoting some of the Vall co Park traffic reduction money for this
purpose.
Comm. Gatto asked what incentives there are for other development
to participate in this type program. The Director of Public Work
said Watkins-Johnson, in Vall co Park is the only other development
contemplated for this type program at this time. If successful,
the employees will probably want to participate. Comm. Gatto sai
you neeci the cooperation of many tenants to make this work. He
feels it is inequitable to asked this developer to initiate the
program, and they are the last major developer in Cupertino. The
Director of Public Works said the City has also applied for a
grant to purchase vans for this purpose.

Chairman Adams noted the success of some busses purchased by
individuals who work in the Sunnyvale Industrial Park.
In regard to Condition 25, Mr. Sobrato said he obj ected to the
word "covereci" for the requirement of bike lockers. Instead, he
would like to provide facilities for the bicycles in full view
of the security officers. , Chairman Adams said his understanding
of this condition is that it refers to bike lockers.
As to Condition 28, Mr. Sobrato said it is the opinion of their
acoustical consultant that an 8' wall will protect the residences
located some 200' away.
Acoustical Engineer Edward Pack said he studied the Ralph's Marke
on De Anu Blvd. during loading operations. During the recording
of these 12-14 operations the highest single event noise was
66.5 dba at 60' from the vehicle. They recorded at 3 locations
contiguous with the housing along Larry Way, by the school and
the BoA.S. homes development. He then recapped page 3 of his
report. He said the present standards for industrial noise
exposure is up to 90 dba without any protection.
Comm. Koenitzer said he recalled the residences adjacent to Vallc
Park were having problems with noises late at night.

Mr. McLaughl.in said the noise pollution in his area is caused by motor-
cycles out~racing the police. Sound carries quite well in this area.
The garbage collection at 5 AM at Collins School is of 1/2 hour duration.
He suggested that if an 8 AM time is set for use of the loading dock
to unload the contents of the trucks, then the trucks will start lining
up at 5 AM. He asked if the sound wall could be installed right by the
loading dock to keep the noise localized.
Mr. Berg said that, based on this report, they will not be generating
any excessive noise. They probably won' t have any deliveries before
7:30 or 8 AM. Comm. Koenitzer said that is why he brought up the matter
of the homeowners' problem with the generators at Vallco Park.
Mr. Sobrato said the tank farm will be between buildings land 2. The
shipping and receiving dock will be on the east side of building l. This
is a minimum of 220' from the residential. The stock will be electronic
and computer parts. The trucks will back into this loading dock area.
This will be at ground level, so they won't be backing down into a hole
and then revving up the motor to pullout again.
Comm. Gatto offered an amendment to Condition 28: Line 2, after "acoustical
barrier" add "or barriers" and Line 4, after School site add: 20' from the
wall, 6 r from the ground". Add ''The noise level should not exceed the
ambient noise level."

As to Condition 29. Mr. Sobrato,said in all likelihood, the row of pepper
trees on the south side of the property should be removed. They are old,
messy trees.
As to Condition 30, Mr. Sobrato said they have 1/2 m1le(~50Q'} of frontage
along De Anza Blvd., and they are asking for only 4 curb cuts. He
answered Comm. Gatto that they are encouraging the bank and the restaurant
to not park in the industrial parking area. Comm. Woodward suggested
an additional condition: That at such time as it is found there is a
problem with parking, that some arrangement be made that a certain
amount of joint parking spaces be accomplished.
Condition 32 - Mr. Sobrato said they. have planned for l2.5' of landscaping
along the Larry Way residences. This will cost $75,000 and will not
provide $75,000 benefit. ' Mr. Berg said they would like to discourage
truck traffic from going directly along the perimeter road and, instead,
use more'direct route out to the highway. They need these 44 parking spaces.
Comm. Gatto believes the present location of the cul-de-sac is good, or
it could be shifted somewhat to the south. '

Mr. Sobrato said they have tried to design something uniq,ue.
Here we have four buildings surrounded by a parklike sétting.
The linear effect will be broken up with the spacing of the trees
and shrubbery.

The Planning Director reported the City Council sent this back to the
Planning Commission for further consideration of the relationship of
this project with the adjacent" properties. It was felt that perhaps
the architect would be given more latitude if this were developed as a
PD rather than R2 with a number of variances, The City Council was
particularly concerned about the variànce to the setback.
Chairman Adams asked for comments from the applicant and/or audience.
Mr. Ron Kemper stated he was representing the applicant, Mr. Maybo.
They don't care which setback is changed, they just want to put a duplex
On this lot. The actual upstairs living area is 20' back from the
property line. This shifted the building from 14' 6" to 12' on the
easterly side.
After reviewing the situation, Comm, Gatto stated he would prefer to
approve the variance request rather than get into a PD procedure.

of trees on the property. He also recommended grasscrete be used
along the 12' strip at the rear of the buildings.

arrived at this developmant plan. Thare was soma discussion about
landscaping and security in the rasr of the property. This will be
low scale architectura with hasvy timber columns. Thera will be
a unifiad sign design. The roof will ba tila. Ha submittad a section
drawing of tha proposed architectura.
Mr. Shur said they are limitad to 11,000 sq. ft., which ml!ans thay
will have 2 or 3 rastaurants.
An 18' high wall was suggastad for the southwest cornar of the cantar

Mr. Johnston said they can save most of tha traas on the proparty.

Mr. Ron Palmgran, rapresenting Long's Drug Stora, said thay are against
free-standing signs and will ask only for signs on their building.
He said they do not run a central warehouse. The local deliveries should
not be a grast problem. They will do what they can to minimize the
:Impact on the adjacent residential. Delivery hours are 8 AM to 4 PM.
Thay ara closed Saturdays as far as racaiving stock is coucarned.
Operating hours are 9 :30 to 9 :30 Monday through Saturday and 10 to 7 on
Sundays. Theyastimata 10 to 15 trucks per day, and 2 or 3 big rigs
per month. They will not have any plants, fartilizar or that sort of
thing out in front. Thay will go along with a sidewalk sala if the
rast of the center is having ona.

site plan to be reflected in the final plan.

said there are instances where the 2--story units were put as far
back ou the lot as possible and the balcony bangs beyond that. In

line-of-sight approach. This section was reworded.

Section 9.1 was reworded to reflect the cooperative spirit approach
in good neighbor relationships. Comm. Woodward believes it is the
responsibility of the developer to keep in mind the neighborhood as
well as his own development.
Mr. John Rintala said there are only a few lots let of Alpine Drive.
He has plans ready to submit in which he eliminated the balconies.

lO. 5-GPC-76 of Midpeninsula Regional Park District: Determination as to
general plan consistency of possible future open space acquisition by
the Midpeninsula Regional Park District - approximately 20 acres
located easterly of and adjacent to Permanente at its intersection with
Freeway Route 280 and westerly of and adjacent to St. Joseph's Seminary.
The Planning Director reviewed the August 20th staff report.

Commission finds this proposed acquisition is in conformance with the
General Plan and it highly endorses the purchase of this property. It
is determined that it does not cut off any areas from services and it
connects with existing park land.
