Application 8-TM-77 of ~ucrINE DRUMMOND: TENTATI'Æ K~ to adjust property line involving two existing lots of record, resulting in two lots containing a minimum of 10,000 sq. ft. each. Said property is located adjacent to and northerly of Palm Avenue approximately 100 feet easterly of the intersection of Palm Avenue and South Foothill Blvd., prezoned Rl-IO (Residential, single-fa~ily, , 10,000 sq. ft. per dwelling unit). First Hearing. [AlthOUgh the applicant was not yet present, the Planning Commission decided ¡'to proceed with this public hearing. The Assistant Planning Director said the application is for the purpose jOf creating a flag lot, giving access to the lot at the rear. 'Æhen the surrounding lots were developed, no provision was made for access to the ¡northerly portion of this property. ,Chairman Koenitzer was concerned that this same situation of the cutting off ¡Of access exis,ts at lots 25ì, 264 and possibly other lots in this same area. I Comm. Blaine clarified that these lots are in the County, not the City at I this time. I Comm. Blaine was concerned about the staff's recommended Condition 16. 'The Assistant Planning Director explained that the City's policy in these cases is to ask for a 30 foot half street. He does not anticipate im- provement of this street will require removal of that row of palm trees. The Assistant City Engineer assured the Commission that the City will go in there and do some work around those trees. Since there were no comments from the audience, it was moved by Comm. Gatto, seconded by Comm. Blaine to close the public hearing. Motion carried, 3-0 8-TM-77 approved Moved by Comm. Gatto, seconded by Comm. That the proposed map is consistent with the general and specific plans. 2. That the design or 1mprov~ent of the proposed subdivision is consistent with the general and specific plans. 3. That the site is physically suitable for the type of develo~ent. 4. That the site is physically suitable for the proposed density of development. S. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or would substantially and avoidably injure fish or wildlife or their habitat. 6. That the design of the subdivision or the type of 1mprov~ents are not likely to cause serious public health problems. 7. That the design of the subdivision or the type of improvements will not conflict with eas~ents, acquired by the public at large, for access through or use of, property within the pro- posed subdivision. 3. Application 12-U-77 of ~~T CONSTRUCTION CO~Ĺ“ANY: USE PERMIT to allow construction of an office building containing approximately 2,000 sq. ft. of space. Said property is located at the northeast corner of the intersection of Valley Green Drive and Beardon Drive in a P (Planned Development)Zone. First Hearing. The Assistant Planning Director explained this application repre- sents the property at the tip of the adjacent West Valley Industrial Park. The request at this public hearing is to construct 2,000 sq. ft. building on the site. From a land uSe point of view, it is consistent with the general plan. There are surplus trip ends. The applicant approached Mr. Sobrato, who refused joint access. The staff recommended two parking stalls on Beardon be deleted and one-way egress. The staff also recommended H-Control consider moving the parking lot some 2 feet to the right to allow additional landscaping in that area. The Traffic Engineer has stated the ingress is very close to the intersection, but because this is a relatively small development and traffic is one-way at this point, he did not object to it. Colored slides of the site were displayed on the screen. PC-256 Page 4 MINUTES OF THE JUNE 13, 1977 PLANNING COMMISSION MEETING It was pointed out that a 10 foot wide sidewalk exists here. One of the existing trees may have to be removed and/or relocated. Chairman Koenitzer asked for comments from the applicant. Mr. David Thimgan, Architect for this project, said that since the driveway is one-way in it will not be hazardous. He is willing to work with the staff on moving the building somewhat to the west, if this is the wish of the Planning Commission. There is the possibility of the wing walls then projecting into the setback area. The trees will be 15-gallon size. Since there were no comments from the audience, it was moved by Comm. The I staff recommended one-month continuance of chis application. ¡ Further, staff would like some direction from the Planning Com- ! mission as to the overall site design in this area. i I ¡ Mr. Robert Chrisman. 280 Parkside Drive, Palo Alto, CA 94306, I said he was representing Century Music, Inc., who will be purchasiqg the building from his firm. They presentl¡ are located in a I 2000 sq. ft. building at Stevens Creek Blvd. and the free\;ay and I in addition, they r~ve a 3000 sq. ft. storage building. They wish I' to incorporate both at this new location. They are purchasing a piece of property from the owners of Custom House. As to the trip I ends, he said their peak hours would be 10 Ai.'1 to noon and 2 co 4 ¡ PM. Their main business is industrial installation of sound I systems. They are not retailers, but rather are professional ! sound installers. They are willing to record a covenant to devote ¡ 8000 sq. ft. to retail sales and the stock storage area with a i permanent separation. The store fronts for Century retail sales . will be recessed within the building. Chairman Koenitzer commented that he overall plan for the entire parcel. the applicant. sees the need to adopt an He asked for comments from Comm. Blaine is concerned about enforcement of the trip end constraint. Mr. Chrisman said future users of chis property, if this should happen, would be reviewed by the City. He said that normally, 1/3 of a retail score is devoted co storage. The Assistant Planning Director stated that the Cicy Council has stated that tenants of 10,000 sq. ft. or larger areas were to be reviewed by the Planning Commission. Blaine said she would Drefer to make a decision on setting a trip end ¡policy when the entire Planning Commission is present. She would also like la more complete traffic record as to numòer of cars at what times of the day. Comm. Gatto said we have some unknown factors here that must be cleared up. Chairman Koenitzer questioned where the Commission should cut off studying the individual uses and where to start considering the overall use of the property. Comm. Gatto would like to have an evaluation of each building here rather than an overall evalua"ion for the entire site. I ¡In regard to landscaping, Mr. Chrisman said a substantial amount of land is devoted to landscaping of this site. At the request of the ¡staff, the parking was moved to the rear and increased landscaping added ,¡to the front portion. Comm. Gatto was answered "hat a masonry wall will be required. He then recommended keeping "he landscaping strip fairly narrow with tree wells for the parking stall area. Chairman Koenitzer would like the staff to ask the City Council at their July S"h meeting for a policy on trip ends. He would also like the applicant to discuss joint driveway and curb cuts with the owner of the Custom House. He would also like the applicant to consider the possibility of changing the shape of the building slightly to allow lS' wide planter I strip. ,Comm. Gatto would like the applicant to consider a tree screen at the Irear of the property and would like H-Control to review it. ¡The Assistant Planning Director asked whether the Planning Commission ¡wanted to get involved in a full-scale plan for that entire area. Discussion of designation of parking for disabled persons. ¡The Assistant City Attorney's June 2, 1977 letter and accompanying ¡status report were reviewed. He said an ordinance has to be adopted ¡providing for off-Site and on-site parking of handicapped persons. ¡we need the cooperation of property Owners with respect to this. Comm. Blaine is concerned about enforcement of the ordinance. She would be in favor of a citation. The Assistant City Engineer said a ramp is being constructed on the south side of the City Hall. As to parking for the handicapped persons, he does not believe the merchants will want to enforce this. The Assistant City Attorney suggested a resolution rather than an ordinance. IMINUTE ORDER: Moved by Comm. Blaine, seconded by Comm. Gatto., to request the City Council address on-site and off-site handicapped parking and enforcement of it.
