Jason Chartier, May Investment Corporation, said he represented
approximately 40 acres of vacant land. They have had a plan to submit
since last July. He was assured that he would be one of the first
items on the Agenda on November 14, 1977,

CONTINUED PUBLIC HEARINGS.
1. 'Application 25-U-77 of HEWLETT-PACKARD. USE PERMIT to allow
construction of Phase 2 and J of the Hewlett-Packard facility.
Said phases involve three industrial buildings totaling approximately
467,640 sq, ft. Said property is located at the southeast corner
of the intersection of Homestead Road and Wolfe Road. First
Hearing.
The Assistant Planning Director noted that the Planning Commission had
asked for information from the Director of Public Works in regard to,
number one the method in whioh Hewlett-Paokard would satisfy its obligation
of land use intensity, and number two information on the instàllation of
improvements. He went on to summarize the October 12, 1977 memo by the
Director of Public Works.
It was noted the construction of Phase 2 and 3 would take place over a
period of two to three years,
Commissioner Adams asked when we can expect revised traffic study. The
Assistant Planning Director said the key faotor is completion of the
second phase of the shopping' center and for it to stabilize. The second
phase is due to be completed by Maroh of 1978.
Commissioner Adams said he concurs 'with the need for another traffic
study. However, knowing Hewlett-Packard's oooperation with their staggered
works hours, car pools, van pools, etc., he would be willing to allow them to
proceed.
Mr. Burrel Leonard, 19050 N. Wolfe Road, Cupertino, said he has no
objection to the Hewlett-Packard, the Sobrato, or the other industrial
developments as long as the Lester/Leonard development is not hurt by it.
He said Val1co led to the widening of four to five miles along Homestead,
Pruneridge, and Wolfe Road. They have spent no end of money on traffic
signalization. The Tantau overcrossing cost them some $400,000 also.
Mr. Leonard's 12 acres down by the Howard Johnson Motel has yet to have an,
approved plan, taxes are very high hçxs.

CORPORATION. REZONING approximately 4.73 acres from CG
(General Commercial) to P (Planned Development with commercial
intent) or whatever zone may be deemed appropriate by the
Planning Commission USE PERMIT to allow construction of three
commercial buildings oontaining approximately 46,500 sq. ft.
Said property is located at the southwest corner of the inter;'
section of Stevens Creek Boulevard and Portal Avenue. First
Hearing .
The Director of Planning and Development said there is an overriding
issue with this application. The staff previously recolDDlended. denial
because they are concerned that thp. approval of a commercial develop-
ment on this corner will be contrary to the mix use concept of
residential and commercial which has been approved under the General
Plan for Stevens Creek Boulevard.
Commissioner a=ived at the meeting at this point.
The Planning Director said during General Plan hearings it was deter-
mined that provisions should be made for some type of high density
residential in the future. There are very few vacant properties
remaining along Stevens Creek Boulevard other than the Town Center
property. The staff would like the Planning Commission to consider
allowing additional staff time to study the housing situation in this
area. However, the applicant is requesting a decision at this time.

the applicant's proposal of a first phase consisting of a clothing store
and fabric store, and a second phase of perhaps a furniture store on these
4.7 acres located westerly of Portal Avenue. It should be noted that
JJ trip ends are still available for the 18,000 sq. ft. building. The
issue of noise abatement in relation to the residential to the south has
been addressed. A noise consultant said the sound would be abated with
solid masonry wall. The Director specifically asked the Planning Commission
to address the issue of housing versus cOllUllercial.
Commissioner Blaine ,said she is very concerned about availability of a variety
of housing in Cupertino. This site might be a good one for high density resi-
dential because of its convenience to shopping;' however, it would not be par-
ticularly good for families, the neighborhood school has been closed.
Commissioner Markkula said that although there is a recognized need for
housing in Cupertino, this would not be the proper place for it. The
multi-story, interior hallway type residential structure usually turns
out to be the lower rent type. And the renters do have children. This is
no place to raise children.
Commissioner Adams agreed with Commissioner Markkula that this is not an
ideal place for residential. This is a very valuable piece of property
so it would result in a high cost, dense development for couples only. Com-
mission Adams' understanding that the Town Center area will include residen~
tial is for a larger PD parcel.
Commissioner Gatto said the original intention of the Ceneral Plan is still
valid, either way the developer would like to go would be viable. He said
it is para.doxicàl to pnt high density residential between commercial and
single-family residential. Commercial uses do not create the need for
more housing; industrial does.
Chairman Koenitzer said that while it is nice to talk about future plans
a developer is before the Planning Commission at this time with a plan for
commercial use on his property. He believes the Planning Commission should
look at the application as presented and act upon it,
Commissioner Blaine said she was not thinking of low income housing; but
rather an apartment complex for people who do not want to purchase a home.
Although commercial does nbt generate a need for housing it does take up
land that could contain housing. The buildings could open to Portal Avenue
rather than Stevens Creek Boulevard. There is a definite need for housing,
not necessarily of the low income type. She felt that what was proposed here
would be strip commercial.
Commissioner Markkula said if the housing would be moderate to high income type
he could not imagine anyone willing to pay high rent to live right on
Stevens Creek Boulevard.
The applicant Mr. Merritt Sher, Terranomcs Corporation, said he is the
developer of the adjacent commercial development. Consistent with reasonable
commercial usage, he thinks they will develop as attractive a development as
is possible. He thinks of this as an extension of his adjacent commercial.

of this cu=ent proposal.
Commissioner Gatto stated he was abstaining from this application.

Mr. Sher believes this proposal pulls the projects together. He said i
the Hoolihan's Restaurant is an attractive & sophisticated newly ;

oonstructed building that has very nice elements that relate to bUilding"
in the late Victorian era. The clothing store and. fabric store arc hi t- I
ecture ties in with that of the restaurant. The building was designed
by the same person who is designing the stained glass carved wood etc.
It ties in with the Drexel Heritage building also. He offered to answer
any questions.
The architect led on to explain details, of the sound wall per the
consultants' recommendations as it ties in with the horizontal roof plan
The roof plan attenuates the sound, he feels this is a much better
approach than a 20 ft. wall which would be oppressive.
Commissioner Adams asked what they planned for the 18,000 ft. building.
Mr. Sher said dealing with the trip end constraint is not easy. The
Black Angus Restaurant has been considering this property. They would
prefer to oonstruct the clothing, fabric stores first and establish
what trip ends will be left over. Commissioner Adams said we would
prefer to see the overall plan for the entire area prior to acting
upon this proposal.
Chairman Koenitzer asked for comments from the audience.
Ann Anger" said there is great need for executive type housing. There
are two types of housing attractive to the $200,000 to $300,000 a year
executive I the type who don't want to tie themselves down and. would
like an expensive apartment; others prefer to purchase a home. She
urged the Stevens Creek Boulevard and. De Ansa Boulevard. vacant land
be considered for executive's needs.
Mr. Mike Bullock, 21831 Hermosa Avenue, said this is the time to
ccn3ider the fellow who rides a bicycle or the bus.to a restaurant. He
could be given $.50 cent off a $6.00 meal on the basis that he doesn't
need an expensive parking plaoe.

Commissioner Adams said it appears the applicant has made a serious
attempt to weave the two uses together here. The potential noise
problems can be worked out. He would be in favor of this zoning and.
this use.

Commissioner Blaine still feels housing at this corner would be a better
use of the land.
Chairman Koenitzer with Commissioner Adams regarding trip ends and parking
constraints. As far as architecture is ooncerned he is not sure that this
proposal will blend in but will leave this up to the H-Control Committee.
Commissioner Adams would like to delete Condition 16 of 28-U-77 and have
H-Cantrol act upon the architecture.
Mr. Sher said that although he is willing to enter into a reciprooal
agreement he cannot compel the adjacent property owner to do so. The
Direotor of Planning and Development stated the property owner next door
already has agreed to this.

3. Applications 15-TM-77 and 17-U-77 of B.A.S. HO~, INC. I
TENTATIVE MAP to subdivide approximately 10.6 acres into 25
single-family lotsl USE PERMIT to allow construction of 25
single-family homes in a Planned Development zone. Såid prop-
erty is located easterly of and adjacent to Beardon Drive at
the northeast corner of the intersection of Beardon Drive and
Greenleaf Drive in a P (PlAnned Development) zone. (Referred
back to Planning Commission for a report.)
The Planning Director reviewed the three configuration proposals.
The staff would prefer to have this development oriented toward the
existing residential area rather than have it open to Randley Drive.
Mr. Mike Meyer, representing B.A.S, Homes, said the main issue that he
sees is whether or not the City wants a closed end or open' end
cul-de-sac and whether or not they want a sound wall along a major
street. B.A.S. Homes favor the open end cul-de-sac concept which will
allow free flow of bicycles, children, etc. Also, this will break up
the "solid wall problem". The open end cul-de-sac with broken wall
would allow the property owners to walk around and maintain the small
strip of ground on the other side. He suggested the Planning Comm-
ission require staff approval when the landscaping is done along this
strip. However, if the City requires the sound wall they will put it
in. The concept of making Greenleaf, Mariani a through street is not
attractive to him. He would prefer to make this neighborhood olosed
off rather than a major throughway. On this basis he would like to
modify Condition 16 of 17-U-77 and Condition 16 and 17 of 15-TM~77.
He would not be in favor of setting up a very difficult maintenance
district for the small landscaped strip. He answered Commissioner
Gatto that they could go to two story homes but this has not been
determined as yet.
Commissioner Blaine would like the applicant to consider a windowless
wall ípreferably in the garage) to take the place of a portion of the
sound wall.
The Planning Director answered Commissioner Adams that this is the onl
proposal at the present time for residential along Randley Drive.
Chairman Koentizer asked from comments from the audience.
Ms. Patti Brisco, Brusselhearst in Monta Vista, said she would like
the City to seriously consider wooden fences with the landscaping.
Since there were no further comments from the audience it was moved
by Commissioner Gatto, seconded by Commissioner Blaine to close the
public hearing.

Commissioner Markkula said since we have residential directly across
the street from inclust.rial commercial, a wall with landscaping should
be required. He cannot see the property owner being required to

maintain the landscaped area however. Perhaps an easement should be
considered. Commissioner Gatto agreed to this suggestion. He thinks
the shorter cul-de-sac is the better of the three plans. The uses on
the other side of Bandley Drive are day time uses and traffic levels
would be less at night.
Commissioner Blaine would like to see at least one pedestrian access
along here. Exhibit A was satisfactory to her.
Chairman Koenitzer believes the ,property to the east should retain the
full number of trip ends assigned to it. He prefers the oul-de-sac
without access to Bandley Drive, Commissioner Adams concurred with
Exhibit A and public acoess along Greenleaf Drive. The traffic flow
was discussed by the Planning Commissioners. They decided to add Condition
181 an i=evocable offer of dedication.

Application 17-U-77 subject to the 14 Standard Conditions and Conditions
15-19 in the staff report with Conditions 16 and 17 modified.

The Assistant City Engineer stated the staff at one time anticipated
Drea Road would be connected, to De Anza Circle to serve the Kesler property,
The Rancho Deep Cliff development has precluded this connectio~ therefore
it is no longer needed for roadway purposes. The staff has contacted the
utility companies and there are no objections to the abandonment as long
as a public easement is retained,

Boulevard northerly of Security Pacific Bank. '
The Assistant Planning Director said the request is to amend the
General Plan to permit a commercial use. The staff recommended retain-
ing the existing land use designation. It is their feeling restaurant
uses should be located north of Rodrigues Avenue where they can be
integrated in a planned commercial center.
Mr. Noor Blllawala, 20252 Hill Avenue, Saratoga, President of the
owners of this property said there are a great number of offices in
this immediate area and it would be good planning to have a restaurant
nearby so they could walk ra.ther than drive.
Since there were no comments from the audience, it was moved by
Commissioner Gatto, seconded by Commissioner Blaine to close the public
hearing.

the General Plan as it presently is.

7. CITY OF CUPERTINO I Public Hearing to consider a specific
general plan for the area bounded by Freeway Route 85 on the
east and Byrne Avenue on the west and consideration of a street
plan line for Stevens Creek Boulevard between Freeway Route 85
and Ridgewal Drive (entrance into De Anza Oaks residential
development). First Hearing continued.

The Director of Planning and Development introduoed correspondenoe from
Measurex Corporation informing the Planning Commission that they are the
owners of the cannery and will cease its operation in 1978.
The Assistant Planning Director said this matter was continued at the
last public hearing due to the late hour. The staff has revised a ooncep-
tual plan to make it clear that it is not "cast in concrete". It would
serve as a guide for private owners, the City, H-Control and County
H-Control. The staff also presented the relationship of the trees' to the
proposed plan line. The staff recommends Alternate A shifting the right-
of-way to the south. Five trees will be lost, three can be retained with
engineering solutions. Alternate B would shift the right-of-way to the
north where three trees would be lost and two could be saved with engineering
solutions. Alternate C is the hybrid solution. Commissioner Markkula was
also concerned about loss of homesite as well as trees, with Alternate A
three homesites would be lost Alternate B, five sites Alternate C (the
worst option) takes more homes and causes a condition that would cost a
great deal of money for a retaining wall or would take the home at the top
of the bank. It would also take away the option of a right turn at
Cupertino Road.
Chairman Koenitzer questioned the advisability of opening Soenic Drive
for right turns out onto Stevens Creek Boulevard. The Assistant City
Engineer said we can get by with 15 ft. width, curb to curb. Commissioner
Blaine would like to consider a meandering road around the existing trees
to allow right turn out onto Stevens Creek Boulevard.
The Assistant City Engineer answered Commissioner Adams that there would
be a :5 ft. monolithio sidewalk at the bridge we would be raising the
profile to 1 ft. or less. He answered Commissioner Blaine that the bicycle
lane from Janioe Avenue to Orange Avenue would be 6 ft. wide adjacent to
the curb. Commissioner Blaine suggested the pedestrian walkway go around
the oak trees in order to save them.
Chairman Koenitzer was concerned that we are trading off trees against
homes.
The Assistant Planning Direotor introduced Mr. Mike Bullock's document
oonoerning "Alternate Transportation Plans for Monta Vista's Stevens Creek
Boulevard", ihwhich he ohallenges traffio consultant Goodrioh's computer
model. The staff will make sure that Mr. Goodrich answers the questions
raised by Mr. Bullock.
Chairman Koenitzer reoapped the proposal thus far. The City has determined
there shall be A/C levels of traffic. The projected levels of traffic studies
with assumptions indicate there should be four lanes of Bubb Road, four
lanes of Stevens Creek Boulevard from Bubb Road to Foothill Boulevard. The
Mont& Vista oommercial area will take 5 ft. from its sidewalk to allow
additional la:':.:::::: of traffic. The proposed median from the railroad track to
Foothill Boulevard would limit left turn lanes and substantially impact the
commercial. Orange Avenue would be closed to discourage commute traffic.
Old Cupertino Road would be olosed completely. It would be cul-de-sac'd
to provide aocess to existing homes. Scenic Boulevard would be
opened to right turn out only. The decision to oonstruct the wider
Stevens Creek Boulevard would be made at a later date to cope with the
increased traffic, By 1990 the community will probably become serious
about construction of these four lanes, At the present time the

He asked for comments from the audience at this time stressing the
importanoe of admission of only new information at this point since
there have been extensive public hearings on this issue recently.
Mr, Lewis Stocklmeir, Scenic Boulevard, wanted to~ll attention to
another factor at the junction of Stevens Creek Boulevard and Scenic
Boulevard. He asked if the fill would. interfere with his 20 ft.
easement on which he brings in his agricultura.l equipment. The Assist
ant City Engineer said Alternate A would. cut off this easement.
However, this easement can be protected. with a small retaining wall.
Mr. Stocklmeir identified. the trees on the plan on the bulletin board
pointing out the rare variety of eucalyptus and the memorial tree
planted on December 22, 1918, In regard to the widening of the road
Mr. Stock1meir said that portion from Pbar Lap Drive to Carmen Road is
quite dangerous. Over the past 75 years he has seen it become
increasingly so. In 197:3 he said he tried. to propose a road as nearly
a straight tangent as possible. At the present time there is a 1:3
percent gradiant. The proposed 17 percent gradiant is good. He has
seen Scenic Boulevard used. as a raceway. He suggested two lanes along
Stevens Creek Boulevard, somewhat wider than at present (from the
bridge and on to the westerly limit; four lanes from Byrne Avenue to
the railroad track).' He noted the original entrance to Black Berry
Farm is where the Blue Pheasant Restaurant is now loc<\ted.. He does
not beli~v~ that it is wise to accommodate out of town traffic. All
the beautiful little swails will be filled with carbon monoxide. The
intent for many years for this area was for peace and quiet and comfor
table homes. With the widening of Steve~s Creek Boulevard there will
be more traffic, accidents, noise and pollution.
Mr, Marty Hall, May Investment Company, said his company owns the
property on which all the fill is going. He would like to know why
there is a necessity' for opening Scenic Boulevard which would only
enoourage more traffic. The people living on Scenic do not want a

for 9 years and has become concerned. about the gradual increase in
traffic in her area, She would like to see the commute traffic elimi-

Mr. Mike Bullock, 218)1 Hermosa Avenue, reaffirmed his stand that a
wider Stevens Creek Boulevard will mean more and faster traffic, The
Assistant Planning Director said the road is being widened to reflect
development not to provide development in the hills. Mr, Bullock
proceeded to amplify the statements in his Ootober 20, 1977 lengthy
report. He believes that this is a regional problem but the problems
are really right here as are the solutions. He asked for a cost analysis
for the proposed widening.
Patti Brisco asked for colored slides of this area so the people will
see the actual effect on our environment. She urged extension of Freeway
85.
Mr. Wesley William, 10067 Byrne Avenue, President of Westwood Homeowners
Association addressed the change of the entrance of Black Berry Farm. He
said that he learned that in order for it to be 40 f:t. wide it would project
into his back yard. ,He said there are too many people who would lose too
much to allow the City to purchase this property. He likes four lanes because
it cuts off the very dangerous opening at Old Cupertino Road.
Ann Anger, Monta Vista, said there are some people here at this meeting
who worked on the Goals Committee. Including Rancho Rinconada we have
50,000 people. She said they had to fight with the realtors who wanted high
density. It is her belief that we can expect about 15,000 more people
within our 15 sqyare miles.
Moved by Commissioner Blaine, seconded by Commissioner Adams to close the
public hearing.
Motion carried 5-0
Commissioner Adams suggested the Action Plan be modified to require for
each section of roadway that is to be widened we should reassess facts
that brought use to the decision for four lanes. Commissioner Blaine agreed.
Commissioner Gatto wanted to discuss the nature of what this roadway is
supposed to do. If it to be a commute road it should be an arterial. He
is convinced the only traffic the wider Stevc~= Creek Boulevard will accommo-
date is commute traffic. Widening Foothill Boulevard will compound the
problem. The median strip will make it impossible for pedestrian to cross
Stevens Creek Boulevard to the commercial areas. There are some safety
hazards which Mr, 'Stocklmeir 'has pointed out. The brange Avenue-Mann Drive
intersection is an improvement. We should make sure we have our priorities
in order. Do we try to achieve a B-C traffic level or do we try to make it
a little easier for downtown Monta Vista. The right of way needs to be
established, but we should put the median strip in abeyance.
Chairman Koenitzer said we are contemplating another 1l,OOO homes in the
hills. Stevens Creek Boulevard is the only east/west street with a possibility
of becoming an arterial. He feels the extension of Freeway 85 to De Anza
Boulevard is imperative.

Commissioner Blaine said if downtown Monta Vista is to survive they are
going to have to depend upon customers from a wider radius.
C01ll.'1IÍssioner Markkula said we need to think about what the road is
really supposed to do. Safety has to be the most important factor.
Combining Adriana and Mann Drive with'one entrance to Stevens Creek
Boulevard is good. The cul-de-sac of Old Cupertino Road is good.
Scenic Drive should be blocked off. He suggested making a safer two
lane road would accomplish the goals for the local residents. All
those stop lights discourage commute traffic. He favors setting a plan
for four lanes in case they will be needed in the future, but recommends
very careful budgeting and traffic studies. before any medians are put
in.
Commissioner Adams gave his reasons for approval of four lanes, There
should be a reevaluation of the traffic and other factors prior to actu 1
construction. If the htgh traffic count as we are now exp~rien~ing on
Blaney had been explained or explored, rather, it would have been con-
structed differently. He feels that a four lane option would be planni g
for the next 20 to 25 years. It is better to plan for it today.
Chairman Koenitzer asked the staff to redraft the Action Plan to allow
more options and more staging plans.
The Assistant City Engineer reviewed the proposed Action Plan with the
Commissioners, some minor changes were proposed. On page one the first
phase will not include construction of a median but only allow for it.
There will be a reevaluation of expenditure for that section of roadway.,
in the introduction as well as the implementation section, You should I
eliminate the right turn in on Old Cupertino Road and the right turn
out from Scenic Drive. There should be a signal at Phar Lap Drive only II
if warranted. The Mann Drive/Adriana intersection with Orange Avenue
is good. We should first have a temporary traffic diverter system at
Orange and Granada. which will be reevaluated before it is made permá~
nent. Old Monta Vista downtown should be reassessed. The median on
Stevens Creek Boulevard at the downtown oommercial section should have I
space provided for the median but it should be reassessed before install-
ation. On street parking may be retained until off site parking is I
provided, at which time bicyole lanes would be installed. Each section I
of the Action Plan would be reevaluated before implemented. I
At 1:10AM it was moved by Commissioner Blaine, seconded by Commissioner
Adams to continue Item 8, 2-GPA-77 to November 14, 1977. .

vard", C through LI reconstru~tiûn of that section of road--should be
reworded for clarity, Table III will be modifieè when Tables I and II
are resolved.
Consensus I Alternate A, set the plan line for four lanes, if it is
ever implemented it must be reassessed. The Monta Vista General Plan-

There shall be further study of traffic diverters and installation of
temporary diverters to evaluate the impact.
The City is concerned about Black Berry Farm's parking problem, particularly
in the summer.
In regard to downtown Monta Vista Commissioner Gatto said, we have a
number of small parcels here. What happens is one of the back parcels
comes in with a development plan first. He would like to see some "words
in music" that say speoifically what we would like to see in downtown Monta
Vista,
Chairman Koenitzer said this is a guide for development but we do not
insist that is must be developed in this way. This is an alternate that
exemplifies that which is contained in sub Goal A. . There are small parcels
that may develop independently. But they must be made aware of the overall
plan.
Commissioner Blaine said that prior to any action on the cannery it must be
evalua.ted as to its historical value. This is the time to look at Monta Vist
and Cupertino to see what historica.l structures should be reta.ined.
