Said aroperty is generally located within the southeast quadrant
of the intersection of Stevens Creek Boul=vard and De Anza Boulevard,

First Hearing continued,
Assistant Planner Steve Piasecki, reviewed the details of the January 20, 19~8
staff report regarding adoption o£ community goals and ob~ectives for the
Town Center. He noted this public hearing would be discussion of a adoption
of these community goals and objectives. It is anticioated tnese objec+.ives
~ will oe determined by the City prior to the developer's detailed plans, He
then reviewed three alternatives for develonment, touching on market feasibility,
~ financial feasibility and fiscal imvact. The Assistant Planner reviewed Attach-
ment A-Community Land Use/Social Objectives. The City has determined there should
i be day time and evening residence and day time employment within this area.
1 Design objectives include a park like setting and a gathering place for local

housina_", Commtssioner Blaine is concerned that we must have some xay ~

Mr, Dave Carter, stated he has been wo*kine orimarily on the pronerty on ~

Torre Avenue xould be a zood nlace for a oark, noting the air quality
of that area, He su~gested that the park should be on t?~e east rather
than the west side of Torre Avenue. Mr. Carter stated that residential
land now sells for more than commercial land. There are 20-30 residen-
tial developers in California who would love to come in here and build
homes. He said the City has advised him to develop commercial, grofess-
ional and he xondered xhat the basis xas for this statement.
Mr. Bill 3enson, The Koll Comnany, said you could put some commercial in
a professional area but not visa-versa.
Mrs. 0'Patti Brisco , said the question is xhether or not we are going
to consider this the heart of the City.
Commissioner Adams questioned the position of Mr. Fleichman on page 30
o£ the reoort, There followed a discussion of the marketinz trends.
Also *~eo~le are beginning to want to live closer to their jobs.
Commissioner Blaine questioned whether a depa.rtment, store e~ina_ in by it-
self today would do very well. Commissioner Markkula does not believe
we have sufficient auantitive or nualitative information for that portio
_ o£ number one of the findings. Commissioner Adams aereed. Commissioner
Gatto said in regard to Item 2, that if we~e to realize all these things
we xill not £ulfill oi:r housing objectives. Commissioner Markkula said
he has a real concern about achieving the 20,~8 moderate income housing
in Item 4. Commis~ioner Blaine asked the Assistant City Attorney hew
xe could ensure private, moderate income housing and keep it that way.
The Assistant City Attorney said for one thing Palo Alto has a"City
right of re£vsal"., but this has not been tested in coUrt.

Blaine, seconded by Commissioner Adams that the Planning Commission recommend
approval of adoption of the findings as amended on page S, at this meeting, ynd the ooject-

The Assistant Planning Director reviewed the January 20, 1978 staff report
on this application, He said the staff recommends a 10 ft, minimum setback
along the rear,
Commissioner Blaine xas answered this duplex wi11 be single-story, She was
concerned about a 10 ft, rear yazd setback in relation to the single-family
home at the rear of this property.
Mr. Gary Mailander, renresenting the applicant, said they decided on a duplex
because it xould fit in crell with the neighborhood.

3. CITY OF CUPERTINO: Public Hearing to consider an ordinance ~
regulating hillside residential development including building i
setbacks and height, fence locations, permitted uses and vegeta-i
tion removal. First Hearing continued. i

The Assistant City Planning Director distributed copies of the County i
Ordinance on the hillsides which was then reviewed by the Commissiun.
Commissioner Gatto agreed with the staff that a sliding scale would be
a wise approach. Chairman Koenitzer asked for comments from the audience
~Sr. Richard Childress, 22025 Regnart Road, said he would draft a letter
to the staff giving his co~nents on this ordinance.
Jo Ann Gholson, 22125 Regnart Road, said she would like to know the long-
term effect. She would like to see more than 10' setback from the road. I
Commissioner Adams would like a staff overview of this ordinance and theni
redraft changes in accordance with discussions that occurred at this publ~.c
hearing. Mrs. Gholson's concern was that these ordinances were not coming
in time to assist some of the developing areas. '
:~rs. Lucien Hertert, San Juan Road, would like the Planning Commission to
address at an earlier point the modification procedure of these appeal
procedures by other than the applicant. She would like to see owners
_ sharing the same road notified of these public hearings. There are fire
considerations. She would like hydrologist's and geologist's reports
considered early on. She said that whenever you fill, it affects the
property below; whenever you cut if affects the property above. In
regard to horses other farm animals, etc. she said what about eggs. Can
you only have four chickens? What about the 4-H girls' project for
ins tance ?
~Ir. Bill McGuire, 10421 Phar Lap Drive, would like a definition of
"vegetation". Does this include Poison Oak?
Dorothy Wright, 22303 Regnart Road, wanted to know if the Noise Ordinance
would be coming up soon.
Since there were no further comments from the audience it was moved by
Commissioner Blaine, seconded by Co~issioner Adams to continue the Hill-
side Ordinance to February 13, 1978.

Toby Rramer, Assistant Planner, reviewed her report of January 20, 1978
regarding the Saata Clara Valley Corridor Evaluation. She said this i.s the
chance for local goverffient to make th~nselves heard. She urged .the ?laaning
Co~mmission to make reco~endations to the County.
REPORT OF THE PL.1i~iNI?IG COP4~SISSION:
Chairman Koenit2er stated that at the Kayor's meeting it was stated that the
Do-Nut Wheel building has been moved back to where the Planning Co~issi~n
reco~ended it go.
Ia regard to the Kaiser property, the Committee is willing to discuss using tne
railroad tracks and Foothill and Stevens Creek Boulevard. There will be pu6lic
hearing on this on Tuesday, Februarq 21, 1978.
.~nother ite~ discussed, was that the School District is planniag to close some
more of the school sites. We should look at underlying use of school sites.
REPORT OF THE P7,~1Ni7ING DIRECTOR:
Planning Director Sisk referred to his January 20, 1978 staff inemo on the
216 uait apartment project in the Cfty of Los rlltos, _The access way to this
complex is still withi.a the City of Cupertino. Commissioner Adams felt therP
was too little parking. Chairmaa Roeaitzer felt it was too dense a developm
Co~issioner Blaiae is verq concerned about the traffic problem at the busy
intersection at Fallea Leaf. There should be a signal. Chairaaa Roenitzer
feels a logical use for this property is an extension of C'~e commercial with
this proposal, we will be allowing people to live right next to the Fretxaay
_ which is poor plaaning.
