Page 7, paragraph 4 should read: "Comm. Markkula said we have some
numbers for vacancy factor but no comparative numbers for the demand
for ownership units." Paragraph 7, line 3, add "of the General Plan"
after "El~nent".

The Associate Planner said this item was continued from January
upon request of the applicant, which is the City of Cupertino.
The staff recommended this property be resoned with or without
the property owner's consent_
Mr. Louis Paviso, owner of the property in question, said he had
hired Attorney Dei¢pster [o represent him, but he is vacationing
in Honolulu, He asked for interpretation of "or whatever zone
may be deemed appropriate by the Planning Commission", as con-
tained in the paragraph above. He was told this was s[andard
wording used in all rezoning applications. Mr. Paviso then aske
for continuance of this matter, based on the fact that his
Counsel was not present.
Co~. Marklaila asked if the property ownar objected to this
rezoning. Mr. Paviso said he objected to the present plan which
shows him losing access to De Anza Blvd. He said he wants some
proof that his garage can stay where it is. The Assistant
Planning Director said it would be best to give Mr. Paviso a
copy of the Non-Conforming Ordinance.
Co~. Adams suggested the Planning Co~ission could act upon thi
rezoning and Attorney D~pster could speak to the City Council
on behalf of Mr, Paviso. If the Planning Co~ission acted
upon this at this cieeting, the Associate Planner said it would
go to the City Council the first Monday in May.
Comm. Blaine noted the staff report did not address the present
use of the property; it talks about future or conceptual plan.
There followed a discussion of the access to De Anza Blvd,

!*ir. William Weil, owner of the Donut Wheel, adjacent to the propertv in
! question, said good common sense dictates access to De Anza Blvd. He
' said he made concessions in order to be able to develop his nroperty,
~ but he does not believe it was in the best interest. He said the ~
' Lazaneo Drive entrance to the rear parking lot wiil be canpletelv
I inadequate; there must be another way in. He sa}d it will be total
j chaos with the present arrangement.
I The Associate Planner said we are talking about a very small commercial
development here. It meets the City's parking standard. If chaos
, occurs it will mean the parking standard is wrong. If it should become
~ a problem, the City should reserve the right to review the situation
and possible allow one-way-in from De Anza B1vd. Mr, Weil asked the
City to consider access to Parlett Place_
Since there were no co~ents from the audience, it was moved by
~ Comm. Adams, seconded by Comm. Markkula to close the Public Hearing.

NEW BUSINESS
4. Review of Draft Copy of Planning Policy Committee of Master
Trails and Pathways Plans for Santa Clara County.
The Assistant Planning Director said the request was,for the City
to review the draft copy of the Master Trails and Pathways for
Santa Claza County. The purpose is to see if there are any '
inconsistencies.
The staff feels the linkage of the Trail Systan along Stevens
Creek Blvd. is very hazardous and recommended an optional linkage
along McClellan Road.
The staff reco~ended deletion of the tunnel under Freeway 280 at
Foothill Blvd, as there is not enough clearance to make it safe.
Co~. Blaine asked how soon we could see a bike system on McClella .
The Assistant City Engineer said this could hapnen whenever [he
City Council appropriates about $800,000 for this project.
The Assistant Planning Director said one option could be to have
the bike path go through the City Park on McClellan.
Co~. Markkula questioned P37 that goes along Freeway 85 extension
The General Plan has the assumption that this rxtension of Ii85 wil
go through. He believes Stelling Road might be better for the
bike path than the freeway rxtension.
Comm. Blaine said the Planning Commission has always made it very
clear that in no way should anything stand in the way of the
extension of Freeway 85.
Comm. Adams asked the staff for clarification of the tunnel and
that stretch along the creek.
Mrs. Lucien Hertert said she ha° re_~ t}:~t the new S[ate Freeway
Plans will consider bike lanes in some safe manner. They can now
go all along the inland waterways to Los Altos.
After further discussion, it nras the consensus of the Planning
Co~ission to agree with the staff to drop a portion of 8 A of
tha Report.
Moved by Co~. Markkula, seconded by Comm. Adams that an alternate
to ~37 should be made, possibly along Stelling Road, and that the
Planning Co~ission reco~ended te the City Council endorsanent
of the Planning Policy Co~ittee's document, with the modification
that there should be an alternate route along McC1e11an Road and
- that the bike lanes along 085 eicnension should in no vay interfere
with construction of this extension. Section 8A shall be deleted.
The Planning Commission finds this consistent with the General Pla .

Chairman Koenitzer recommended this docum~nt be submitted to the
Parks and Recreation Conunission for review.
REPORT OF THE PLANNING COMMISSION
Comm_ Blaine reported on the last PPC Pieeting. 'fhe staff told
them about the annexation procedure. .
Co~. Blaine congratulated Chairman Koenitzer for the fine job
he'd done this past year as head of the Planning Commission. .
REPORT OF THE PLANNING DIRECTOR
None. .
ADJOURNMENT
Chairman Koenitzer adjourned this meeting to 7:30 on Pionday,
