HELD ON SEPTEMBER 28, 1978, IN THE COUNCIL CHAMBER, CITY HALL

to the Flag.

2. Application l8-U-78 of STAFFIELD/ROSE REAL ESTATE INVESTMENTS:
USE PERMIT to construct a 9,200 sq. ft. building consisting of
an emergency medical service facility and retail commercial
store; and ENVIRONMENTAL REVIEW: The Environmental Review
Committee recommends the granting of a Negative Declaration.
Said property is 10cated on the north side of Stevens Creek Blvd.
approximately 100 ft. westerly of Vista Drive. First Hearing
continued.
The staff report of September 26, 1978 was reviewed. The staff re-
commends a cross connection between adjacent United Auto site and
this property. The staff feels strongly that the parking for the
commercial should have access to cross streets.
It was noted there is a 10' separation to increase the planting
along the blank waIl.
Comm. Gatto was answered by the staff that any approval at this time
would more or less dictate the use of that corner property.
Ch. Blaine was concerned whether there would be enough backing-up
space in the aisle with the propošed changes. Staff indicated they
would go to angle parking rather than perpendicular.
The Assistant Planning Director said the amount of parking is based
on the entire building being used for co.mmercia1. .The proposed use
of a medical facility would not be utilizing as much parking as
commercial would.
Mr. Russell Wilkins, 12440 Town Center Lane, Cupertino, said he was
representing the applicant, who was still out of town. He said he
had no actual authority, but had a few comments to make. In regard
to reciprocal parking, he does not believe it would be a good idea
because he feels there should be reserved parking for the medical
emergencies. Comm. Gatto suggested marking them "handicapped" or
"emergency" parking spaces.
Mr. Wilkins asked what the most expeditious way would be to move this
project along. The procedure for handling these applications was
explained by the Assistant City Attorney.
Moved by Comm. Gatto, seconded by Comm. Gatto to close the public
hearing since there were no further comments from the audience.

Comm. Gatto observed that the critical thing here is to provide
cross easement. He wanted to modify Condition 18 to require 5'
instead of 10'. He would like a connecting link and 5' separation
Moved by Comm. Gatto, seconded by Comm. Adams to grant a Negative
Declaration on this proposal, as recommended by the ERC.
Motion carried, 3-0
Moved by Comm. Gatto, seconded by Comm. Adams to approve appli-
cation l8-U-78, subject to the 14 standard conditions, conditions
15,16,17, 18-modified with 10' changed to 5', and condition 15
modified in regard to cross easement.

regulating conversion of multiple family rental projects
(including duplexes) into single-owner housing units.
First Hearing.
The Assistant Planning Director reviewed the comprehensive staff
memo, dated September 26, 1978, of the first draft of the Rousing
Element.
The Associate Planner reviewed the September 22, 1978 staff memo
regarding the Condominium Conversion Ordinance - Third Draft.
After~discussion, it was moved by Comm. Adams, seconded by
Comm. Gatto to continue the ordinance regulating conversion of
multiple family rental projects (including duplexes) intb single-
owner housing unitsa
