0.51 gross acre from Santa Clara County R2-8LH (two-family residence
8,000 sq. ft. minimum lot size) to City of Cupertino Rl-7.5
(Residential, single-family, 7,500 sq. ft. minimum lot size) zone
or whatever zone may be deemed appropriate by the Planning Commission;
and ENVIRONMENTAL REVIEW: The Environmental Review Committee
recommends the granting of a Negative Declaration~ Said property
is located on the east side of Merriman Road approximately 400 feet
southerly of the intersection with Alcalde Road. First Hearing.
The Assistant Planning Director located the subject property on the
map displayed on the screen. He noted that the properties to the north
are currently Rl-7.5 and are in various stages of construction. The
application was consistent with the General Plan and the Area. Both
lots would be over and above the 7,500 sq. ft. minimum.
The applicant, Mr. Barre Barnes, 22660 San Juan Road, Cupertino, offered
to answer any questions.
Ch. Blaine asked for comments from the audience.
Mr. Roy E. Davis, 10600 Merriman Road, Cupertino, said his property is
just south of this property. He said this has been understood for years
to be single family lots. He said he wanted to make sure these would be
single family homes.

Hearing.

Declaration. Said property is located on the east side of
Blaney Avenue approximately 100 feet northerly of the inter-
section with Pacifica Drive. First Hearing.
The Assistant Planning Director located the property on the map
displayed on the screen. The property is just to the north of
the San Jose area presently due to be annexed to Cupertino.
The Assistant Planning Director stated this application to divide
this property into three lots is consistent with the General Plan
and the neighborhood and subdivision map. There will be access
for two lots onto Blaney and the potential for two on Glenview
Avenue. An aerial photograph showed the building to the rear of
the property.
Mr. Richard Kier, Kier Engineering, 3350 Scott Blvd., Santa Clara,
Building 22, said there is an existing home facing Blaney Avenue.
There is a gitage structure to the rear in which antique cars
will be stored.
Since there were no comments from the audience, it was moved by
Comm. Koenitzer, seconded by Comm. Adams, to close the Public
Hearing.

3. Applications 24-U-78 and 27-TM-78 of GAETANO S. DIVITTORIO: USE
PERMIT to construct a retail commercial office building consisting
of approximately 20,000 sq. ft.; TENTATIVE MAP to consolidate three
existing parcels into one parcel consisting of approximately 1.2 acres;
and ENVIRONMENTAL REVIEW: The Environmental Review Committee recom-
mends the granting of a Negative Declaration. Said property is
located at the northwest corner of Lazaneo Drive and North De Anza
Blvd. in a P (Planned Development with general commercial, light
industrial and residential, 4-10 dwelling units per gross acre intent)
zoning district. First Hearing.
The Associate Planner said the display on the screen illustrated the
three issues involved here: 1) The trip end question; 2) Protection
of existing trees; and 3) Parking/Circulation. Photographs showed 'the
very prominent trees on this property presently housing a tailoring shop
in an existing structure. There are redwoods, pepper and oak trees. A
clump of trees is located in the parking lot and right in the middle of the
30' street. The staff recommended a condition requesting the applicant
consider planting of more trees. The pine trees would have to be removed
because of their location. The pepper would have to be removed because
it is too close to the oak.

The Associate Planner said theexísting hòuse appears to have been
built in the 1930's or 40's and there is no historical significanc
There is a narrow gauge railroad track on the property which
appears to have been a hobby. The staff is suggesting the curb
cut on De Anza Blvd. be made right-turn-in-only or be eliminated.
Comm. Koenitzer noted there will be a common driveway for access
to the property to the north. He questions whether it is wise to
put parking on this major road in the parking lot. The Associate
Planner said this has been studied by the staff. The Assistant
Planning Director said it did not appear that there would be too
many problems with this particular design. The Associate Planner
noted that the applicant may have to eliminate a couple of the
parking spaces. There will be another public or private street
leading out to De Anza Blvd. somewhere between Mariani and Lazaneo
There followed a discussion of the whole concept of the plan line
on the West side of De Anza Blvd.
Ch. Blaine said one of her concerns was if everybody got out of
work at the same time, then all would be trying to back their cars
out at the same time onto that street. An aerial photograph of
the area was displayed on the screen. The Assistant City Engineer
said the traffic volume here will be much less than that of some I
residential streets where cars back out onto the street4
Cn. Blaine asked for comments from the audience.
Mr. Gaetano Divittorio, 22804 Cervantes Road, Campbell, said that I
if he is required to eliminate one row of parking he will not have)
enough parking. After much thought, they came up with this
present site plan. He feels the traffic circulation will be more
than adequate.
Comm. Adams asked if his architect had considered having entrance
to the underground parking from the ends of the building.
Mr. Divittorio said this could endanger some of the older trees
on the property.
Comm. Claudy commented that he really liked this plan, with the
landscaping, etc.
Moved by Comm. Claudy, seconded by Comm. Adams to close the Public
Hearing. This motion and its second were withdrawn when it
became apparent there was to be more input~

Mr. Divittorio said he was concerned about the conditions listed in
the staff report. The design of the building has a hallway. If he
is going to have to change the square footage for the hallway he will
not put in doors. Discussion followed. Comm. Claudy suggested wrought
iron gates at each end of the building.
Since there were no comments from the audience, it was moved by
Comm. Adams, seconded by Comm. Claudy to close the Public Hearing.

Comm. Koenitzer noted the applicant is devoting a good portion of the
parcel to preservation of the existing trees. Perhaps there could be
a minor exception to the parking requirement or to slightly diminish the
size of the setback along the front.
Carom. Claudy suggested moving the building forward would put the
sidewalk over the roots of the redwood trees, and redwoods are subject
to soil compaction.
Camm. Gatto said Camm. Koenitzerls concern about traffic in the parking
lot is well founded and he would be in favor of eliminating a couple
of the parking spaces. It will also be necessary to decrease the radius
of the 18' aisle. He reaffirmed that dropping a couple of parking
stalls to allow better circulation is a very good idea.
Moved by Comm. Claudy, seconded by Comm. Adams to accept the ERC's
recommendation and grant the Negative Declaration.

operate a 1,400 sq. ft. travel agency within the existing
Homestead Lanes Shopping Center; and ENVIRONMENTAL REVIEW,
The project was previously assessed; hence, no action is
required. Said property is located on the southeast corner
of Homestead Road and Stelling Road in a P (Planned Develop-
ment with recreational, entertainment and limited commercial
intent) zoning district. First Hearing.
In the staff report of December 4, 1978, the staff recommends
approval of the subject application with no special conditions.
Carom. Koenitzer asked the staff for a list of permitted uses for
this property.
Ms. Maureen Rezec, 862 Quelta, Sunnyvale, said she was the
applicant in this case. She offered to answer any questions.
There were none.
Since there were no comments from the audience, it was moved by
Comm. Gatto, seconded by Comm. Adams to close the public hearing.

REPORT OF PLANNING COMMISSION
Ch. Blaine reported the Burger King has been "dethroned".
Ch. Blaine also reported that the BAS Romes application was approved
by the City Council since it was found there would be no extra traffic
problem for Westridge.
Ch. Blaine reported the Santa Clara Valley Corridor Evaluation meeting
includes extension of Freeway #85. She urged that the Planning Commis-
sion I s position on this subj ect be made known. Meetings will be on
December 12th in Pal0 Alto and the 13th in the County building.
