RESOLUTION NO. 2208
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
1111 RECOMMENDING APPROVAL OF A TENTATIVE PARCEL MAP TO
RECONFIGURE THREE LOTS OF RECORD AND TO APPROVE THE
STREET ALIGNMENT AND SECTION FOR THE TERMINUS OF
SAN FELIPE ROAD.

LOCATION: Southerly terminus of San Felipe Road approximately 300 ft.
south of Alcalde Road
FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and sub-
conclusions as set forth in the minutes of the Planning Commission meeting of
May 11, 1981.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. The approval is based upon Exhibit A of Application 7-TM-81 as may be
amended by special conditions contained herein. The applicant shall
have the ability to adjust the location of the cul-de-sac in a manner
411 approved by the Director of Public Works.
16. In recognition of the close proximity of a suspected trace of the Monta
Vista fault, the applicant shall retain an Engineering Geologist to
evaluate and mitigate potential seismic and geologic hazards. The City's
geologic consultant shall prepare a scope of work for the applicant's
consultant and review the final report. Said geologic investigation
shall be completed prior to recordation of the final map. The final
map shall contain a note indicating that a geologic report has been
prepared and a covenant shall be recorded informing future purchasers
of parcels that said geologic report has been prepared and copies of
said report are available for public inspection in the Cupertino City Hall.
17. The applicant/owner(s) shall cause a new two-car garage to be built on
Parcel A. A suitable financial guarantee shall be posted with the City
to guarantee construction of the garage within a one-year period following
recordation of final map.
18. The trees on Parcels B and C as described on Exhibit A shall be retained.
Said trees shall be protected during construction of dwellings.
19. The applicant shall record a quit claim deed transferring the 13 ft. wide
strip of land on the eastern boundary of the subdivision (refer to Exhibit A)
to the adjacent easterly property owner.

RESOLUTION OF THE -PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING
THE APPROVAL OF A TENTATIVE MAP
WHEREAS, the attached application has been submitted to the City of Cupertino
requesting approval of a tentative map; and
WHEREAS, the Planning Commission has held at least one public hearing in
regard to the application; and
WHEREAS, the Planning Commission has duly considered and heard all evidence
submitted in regard to said application; and
WHEREAS, the necessary public notices have been given as required by the
subdivision and procedural ordinances of the City of Cupertino.
NOW, THEREFORE, BE IT RESOLVED:

1. That the Planning Conuiiission makes the following findings :
a) That the proposed map is consistent with the general and specific 411
plans.
b) That the design or improvement of the proposed subdivision is
consistent with the general and specific plans.
c) That the site is physically suitable for the type of development.
d) That the site is physically suitable for the proposed density of
development.
e) That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat.
f) That the design of the subdivision or the type of improvements are
not likely to cause serious public health problems.
g) That the design of the subdivision or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of, property within the proposed subdivision.
