Reso 2207 5-TM-81 RESOLUTION NO. 2207 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO DIVIDE APPROXIMATELY 1.3 ACRES INTO SIX LOTS. APPLICANT: Leonard C. Molander ADDRESS: 2671 Saklan Indian Drive, Unit 3, Walnut Creek, California 94595 SUBMITTED: April 2, 1981 LOCATION: East side of Stelling Road approximately 350 ft. northerly of the Highway 85 right-of-way FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and sub- conclusions as set forth in the minutes of the Planning Commission meeting of May 11, 1981. • CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. The approval is based upon Exhibit A of Application 5-TM-81 as may be amended by additional conditions contained herein. 16. The map may be recorded in two phases comprising Lots One. and Two and the balance of the area as Phase One and the subdivision of Lots Three through Six as the second phase. 17. Vehicular access to Lots Three through Six shall be limited to a 20 ft. wide common driveway located in the double 15 ft. wide corridors serving Lots Four and Five. A reciprocal access and maintenance agreement shall be prepared and recorded to reflect the joint use concept. The agreement shall be subject to the review of the City Attorney. 18. The. common property line between Lots One and Two shall be shifted to provide, a minimum 60 ft. frontage for Lot One and to ensure that legal building setbacks are maintained for Lots One and Two. Planning Director Planning Commission -2- CITY OF CUPERTINO City Hall, 10300 Torre Avenue Cupertino, California 95014 Telephone: (408) 252-4505 RESOLUTION OF THE -PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING THE APPROVAL OF A TENTATIVE MAP WHEREAS, the attached application has been submitted to the City of Cupertino requesting approval of a tentative map; and WHEREAS, the Planning Conmiission has held at least one public hearing in regard to the application; and WHEREAS, the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS, the necessary public notices have been given as required by the subdivision and procedural ordinances of the City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission makes the following findings : a) That the proposed map is consistent with the general and specific plans. b) That the design or improvement of the proposed subdivision is consistent with the general and specific plans. c) That the site is physically suitable for the type of development. d) That the site is physically suitable for the proposed density of development. e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. f) That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. 110 -1-
