Reso 2203 6-TM-81 0 RESOLUTION NO. 2203 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO SUBDIVIDE APPROXIMATELY 1.74 ACRES INTO AS MANY AS 16 CONDOMINIUM PARCELS AND ONE LOT TO BE HELD IN COMMON OWNERSHIP. APPLICANT: Dirk C. Reed ADDRESS : 225 Loma Alta, Los Gatos , California 95030 SUBMITTED: April 3, 1981 LOCATION: Northwest corner of Stevens Creek Boulevard and Foothill Boulevard FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of .the Planning Commission meeting of May 26, 1981. CONDITIONS:. 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein.- In the event a'conflict does exist, the special conditions enumerated herein shall apply. 15. The approval is based upon Exhibit A and B of Application 6-TM-81 as may be amended by additional conditions contained herein. 16. An association comprised of all condominium owners shall be formed to ensure property management of commonly held property. The appropriate association document shall be reviewed and approved as to form and content by the City Attorney prior to recordation of the final map. 17. The property may be divided into 16 or fewer condominium units at the applicant's discretion . The exact placement of interior walls may be modified subject to review by the staff. 18. Prior to recordation of the final map, required landscaping for the subject property shall be installed by the applicant and inspected by City staff. Sisk John Claudy, Chairman 411, Planning Director Planning Commission -2— CITY OF C U P' E R T I N O e City Hall, 10300 Torre Avenue Cupertino, California 95014 Telephone: (408) 252-4505 RESOLUTION OF THE •PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING THE APPROVAL OF A TENTATIVE MAP WHEREAS, the attached application has been submitted to the City of Cupertino requesting approval of a tentative map; and WHEREAS, the Planning Commission has held: at least one public hearing in regard to the application; and WHEREAS, the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS, the necessary public notices have been given as required by the subdivision and procedural ordinances of the City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission makes the following findings: a) That the proposed map is consistent with the general and specific • plans. b) That the design or improvement of the proposed subdivision is consistent with the general and specific plans. c) That the site is physically suitable for the type of development. d) That the site is physically suitable for the proposed density of development. e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. f) That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. 11111 -1-
