Reso 1861 14-Z-78 RESOLUTION NO. 1861 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A REQUEST TO PREZONE APPROXIMATELY 1.56 ACRES FROM SANTA CLARA COUNTY R-3h TO CITY OF CUPERTINO PRE R1-7.5 TO CITY OF CUPERTINO PRE R1C. APPLICANT: George Cody (Byrne Avenue Associates) ADDRESS : 212 High Street, Palo Alto, California 94301 SUBMITTED: June 9, 1978 LOCATION: Southeast and Southwest corners of Byrne Avenue and Stevens Creek Boulevard Approval is recommended subject to the findings as set forth on Page 1 and sub- conclusions as set forth in the minutes of the Planning Commission meeting of July 10, 1978. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. The application is approved based upon Exhibits A, B, and C of Application 14-Z-78 as may be amended by additional conditions contained herein. 16. The precise configuration of each building lot shall be determined in conjunction with a subsequently filed and approved tentative subdivision map. The lot depth of five parcels fronting on Old Stevens Creek Road may be 10 ft. + less than delineated on Exhibit..B of Application 14-Z-78. If the lot depth is decreased from the 100 ft. figure described on Exhibit B, a subsequent redesign of the five buildings shall reflect the building style described on Exhibit B and C and shall maintain the same rear setbacks and minimum 20 ft. setback from the property line to face of garage. 17. The landscaping plan required by the architectural and site approval review process shall stress the use of indigenous plants which reflect the natural environment of the Stevens Creek FldbE Plain. 18. As point of information, applicable subsections of Section 13.5 and 13.6 of the R1C Ordinance (Ordinance 664) regarding street improvement requirements and covenants for common area, shall be applied to the development. PASSED AND ADOPTED this 10th day of July, 1978, at a regular meeting of the Planning Commission of the City of Cupertino, State of California, by the following roll call vote: AYES : Commissioners Claudy, Gatto, Koenitzer, Chairperson Blaine NAYS: None ABSTAIN: None ABSENT: Commissioner Adams 110 ATTEST: APPROVED: (24rett—CtiVAA /s/ Sharon Blaine Robert Cowan Sharon Blaine, Chairperson Assistant Planning Director Planning Commission City of Cupertino California RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND- ING THE GRANTING OF A ZONE CHANGElir WHEREAS the attached application has been submitted to the City of Cupertino requesting a change"of zone in the zoning regulations of the City, as stated on Page 2; and WHEREAS the Planning Commission has held at least one public hearing in regard to the application on the date as noted on said application; and WHEREAS the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS the necessary public notices have been given as required by the Zoning Ordinance of the City of Cupertino; NOW, THEREFORE, BE IT RESOLVED: That the Planning Commission finds-that the proposed zone change: a) Encourages the most appropriate use of land, b) Conserves and stabilizes the value of property, c) Provides for adequate open spaces for light and air, 411 d) Permits adequate control of fires, e) Promotes the health, safety and public welfare, f) Provides for the orderly development of the City, Is adva ntageous antageous to the property and improvements in the zoning district and neighborhood in which the property is located. That said Planning Commission, therefore, reports favorably to the City Council in the matter of granting said zone change. 111 • -1-
