Reso 1893 24-TM-78 • ; RESOLUTION NO. 1893 • OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMENDING APPROVAL OF A TENTATIVE MAP TO DIVIDE A 411 30,000 SQ. FT. PARCEL (APPROXIMATELY .7 OF AN ACRE) INTO TWO PARCELS CONSISTING OF APPROXIMATELY 11,000 SQ FT. AND 19 ,000 SQ. FT. EACH. APPLICANT: James C. Scott ADDRESS : 10280 Scenic Boulevard, Cupertino, California 95014 SUBMITTED: September 7, 1978 LOCATION: East side of Scenic Boulevard approximately 200 ft. southerly of the intersection with Carmen Road. Approval is recommended subject to the findings as set forth on Page- 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of October 9, 1978. CONDITIONS: 1- 14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. That the approval is based upon Exhibit A of Application 24-TM-78 as may be modified by additional conditions contained herein. 16. If the applicant intends to utilize the existing asphalt pavement for access to both Parcel A and Parcel B it will be necessary to record a reciprocal ingress/egress easement. 17. The garage and lanai shall be removed and the abandoned pool filled in or removed subject to the approval of the Chief Building Inspector prior to filing of the final map. • 18. The property line shall be adjusted slightly to ensure that it is located a minimum of 3 ft. from the westerly most roof overhang or wall of the guest house on Parcel B. The guest house is considered an accessory structure and is not permitted any cooking facilities. The guest house structure shall be inspected and brought up to standards of the uniform building code prior to any form of occupancy or at the time of application for building permits for the main structure on Parcel B whichever comes first. 19. The applicant shall provide separate sewer, water and electrical connections for both parcels and shall remove or fill in any septic systems presently serving either Parcel A'or Parcel B prior to ' filing of the final parcel map subject to the approval of the Santa Clara County Health Department. Also, the final'map shall reflect any easements or sanitary sewer or water lines to Parcel B. -2- R CITY OF CUPERTINO 411 City Hall, 10300 Torre Avenue Cupertino, California 95014 Telephone: (408) 2,52-4505 RESOLUTION OF THE .PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING THE APPROVAL OF A TENTATIVE MAP WHEREAS, the attached application has been submitted to the City of Cupertino requesting approval of a tentative map; and WHEREAS, the Planning Commission has held ' at least one public hearing in regard to the application; and WHEREAS, the Planning Commission has duly, considered and heard all evidence submitted in regard to said application; and WHEREAS, the necessary public notices have been given as required by the subdivision and procedural ordinances of the City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission makes the following findings : a) That the proposed map is consistent with the general and specific plans. b) That the design or improvement of the proposed subdivision is I consistent with the general and specific plans. c) That the site is physically suitable for the type of development. d) That the site is physically suitable for the proposed density of development. e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. f) That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. g) That the design of the subdivision or the type of improvements will not conflict with easements, acqui' ed by the public at large, for access through or use of, property within the proposed subdivision. 110 -1- 24-T'i-78 • Planning Conmiiss-ion Resolution No. 1893 (continued) 410 20. A soil and foundation investigation should he completed for Parcel B prior to any additional development . Of primary concern is the determination of a safe setback distance from the edge of the steep cliff face located along the eastern edge of the parcel .
