Adams to approve the Minutes of September 28, 1978, as submitted. Motion carried, 3-0 Comm. Claudy & Koenitzer abstained Minutes of Regular meeting of January 8, 1979; Page 5, paragraph 3, line 4: Add "at the entrance to the project" to the end of the sentence. Page 10, paragraph 4, last sentence should read: "Because he recorded his map prior to the enactment of the RHS Ordinance, if the property was rezoned, he could technically come in and file for subdivision of his 10-acre lot." Motion carried, 3-0 PC-298 Page 2 MINUTES OF THE JANUARY 22, 1979 PLANNING COMMISSION MEETING POSTPONEI1ENTS OR NEW AGENDA ITEMS: None. WRITTEN COMMUNICATIONS: None. ORAL COMMUNICATIONS: Ch. Blaine thanked the staff for conducting the very informative field trip on January 20th. PUBLIC HEARINGS: 1. CITY OF CUPERTINO: Public Hearing to consider the adoption of a Comprehensive General Plan including the following elements: Land Use, Housing, Open Space/Conservation, Seismic Safety, Public Safety, Noise, Circulation and Scenic Highways. The meeting concentrated on: A. Consideration of Land Use/Community Character Element of the General Plan. B. Consideration of Working Paper for Public Open Space and Parks Element of General Plan. First Hearing continued. The Assistant Planning Director stated he first wanted to review the key San Jose Properties under consideration for transfer and some of the issues raised at the December 19th public hearing involving the first draft of the Land Use Element; and then review where we are and where we are going. Packets of the documents concerned were made available to the audience. The Assistant Planning Director said circulation must be considered in addition to land use and character. The Housing Element recently adopted must be modified. We have to get involved with seismic and other issues. Land use includes kinds of uses and intensity of the uses. The City's Traffic Consultant, Mr. Don Goodrich, is coming back to take another look at the traffic numbers. The utilities capacity must also be studied. Comm. Koenitzer suggested studies should be made with #85 going through and with #85 NOT going through. The Assistant Planning Director agreed that one of the problems is the traffic model assumes #85 goes through. MINUTES OF THE J&~UARY 22, 1979 PLANNING COMMISSION MEETING PC-298 Page 3 The Assistant Planning Director reviewed Site A -- Bollinger Road at De Anza Blvd. The staff recommends the zoning here remain l6000 sq. ft. commercial. The review process has been completed in the City of San Jose. The permit would be issued by San Jose. The property involved is 1.52 acres. Ms. Jo Celio, 1047 Colonÿ Hills, San Jose, has been a member of a group for about 3 years that has been working on this. One of their concerns is the blind spot at the northwest corner, with the K-Mart traffic and the traffic that is cutting through here from De Anza Blvd. to avoid the heavy traffic through Cupertino. Comm. Adams said he would like to hear more about the area from the citizens who have watched it develop. Comm. Gatto said commercial is a logical use for this property but he would prefer to have it PD rather than General Commercial. Ch. Blaine feels residential would be all right on this property. One of the problems here is the large trucks that are regularly parked along the curb. Area B was discussed next. The Assistant Planning Director reviewed the proposal for extension of Bollinger Road. It is zoned 0-5 residential. The staff feels this is appropriate. Mr. John Mangano, l0716 South Stelling Road, Cupertino, said he is affected by the extension of Bollinger Road. Originally, it was supposed to tie in with Lilac Way. His home is directly in the present plan line for Bollinger Road. He said the traffic is extremely congested daily from 6:30 to 9:00 AM and from 3:30 to 6:00 PM. He invited the Commissioners to come and observe it themselves from his home. He recommended 2 cul-de-sacs of Bollinger Road and prevent even more traffic from using Stelling Road. Comm. Gatto said some type of residential would be appropriate here. He would like more data, however, before making any decision on the density. Comm. Claudy said this should be residential in some manner. Comm. Koenitzer said that R2 (Duplex) might be possible but not any higher density. Ch. Blaine was in favor of residential of some type here. There should be provision here for an open space linkage between Orion Lane and Orogrande Place to provide safe access to the proposed park site and to take advantage of the natural creekside setting. They feel the traffic along Stelling is so bad that they have to drive their 13 and II year old children to soccer practice. If it is not too expensive, they would like to see a neighborhood park on the vacant property. The Assistant Planning Director said, in regard to park sites, that Three Oaks Park is under discussion for the southerly portion be used for a row of residential and a road; and perhaps sell the land for these homes to purchase other park land. Comm. Claudy said he felt that residential is the appropriate zoning on this property. He does not agree with San Jose on zoning credits, etc. He feels there are some real problems with the park site as it is proposed at the present time. As to the creek, he prefers dirt rather than concrete banks. Comm. Koenitzer noted this area is isolated with railroad tracks along one side. He believes the density factor is right; however it does not have to be conventional RI lots. Comm. Gatto agreed that area needs Some sort of park site. It should have a road all the way around it. 1 to 5 units per acre seems appropriate. Ch. Blaine believes this should be residential, 0-5 units per acre. The people do need a park in that area. When and if #85 goes through, these people will become more isolated. The Assistant Planning Director pointed out that Area D is a partially developed County area. It is similar to the Tula Lane area, with large lots and homes built in the 1950's. The staff recommends residential zoning, 0 to 5 units per acre. The General Plan would allow the two churches to continue their use. MINUTES OF THE JA~UARY 22, 1979, PLA~ING COMMISSION ~lliETING PC-298 Page 5 Mr. John Mangano pointed out the bad situation here, where Rainbow Drive jogs unsafely at Stelling Road. Comm. Gatto said that rather than the City getting involved in designing a street plan, it would be better to take a look at the properties as they are brought in for review. Comm. Adams agreed. Comm. Claudy said the lower three I-acre lots are single family. Instead of allowing three flag lots, he would like to allow two of the roadways to adjoin. He concurred with the proposed densit Area E was considered next. The staff recommends residential, 0-5 units per gross acre on those properties near Rainbow and Stelling. The Assistant Planning Director said that if Bubb Road goes circuitously through 7 Springs Ranch to Prospect it will take some of the traffic off Rainbow Drive. Mr. Pat Sheehy pointed out that Rainbow has the potential of becoming as busy as Stelling Road....Bubb Road, too. Perhaps the City could expedite the development of that intersection because of the heavy traffic. Mr. Roland Guay, 7764 Squirehill, said his property is at the corner of Rainbow Drive and the railroad tracks.... 1.42 acres. He is on the east side of the railroad tracks. He is concerned that the City is creating too much traffic here. He wants to stay in Agriculture and is concerned that the City is allowing development of property adjacent to him. Concensus was residential, 0-5. Discussion next was on Area F. The Assistant Planning Director said the State originally proposed Gardenside be a frontage road along #85 future extension. The staff is now proposing for F-l 5-10 units per acre (typical townhouse development), for F-2 lO-20 units per acre and for F-3 General Commercial zoning. There were no comments from the audience on this at this time. Comm. Claudy said F-l and F-2 should have the same density range. Comm. Gatto said his inclination was to go to 5-10 residential for all three areas in F. It was noted the freeway will be elevated at this point so there will be noise. PC-298 Page 6 MINUTES OF THE JANUARY 22, 1979 PLfu~NING COMMISSION MEETING Realtor John Rintala, 10122 Adelheid, said he represented several property owners in this Area F. They would prefer 5-10 units per acre. He said at a higher density the unit price would come down. He was speaking about the west side of Gardenside. Ch. Blaine said that with·apartments here they could build to minimize the noise from the freeway, so she would like to go l0-20 units per acre for F-l and F-2. Ms. Celio said they are concerned about the density, considering the high traffic volume here. They are also concerned with the privacy intrusion. Ch. Blaine said that with 10-20 units per acre we will probably get townhouses or cluster, but to get apartments we should allow 20-35 units per acre. Mr. Rintala said apartments are available but expensive. He said that because of the lower marriage rate and birth rate, we are not getting as many people looking for apartments. Comm. Claudy, Adams and Gatto were in favor of 5-10 units per acre. Ch. Blaine was in favor of 10-20 units per acre. Comm. Koenitzer was in favor of 5-10 on the west side and 10-20 on the east. Area G was discussed next. It was pointed out that Areas G-l.and G-2 are owned or controlled by Mr. Yamagami. G-1 is zoned 5-12 and G-2 is zoned commercial by San Jose. The Assistant Planning Director advised G-l be zoned at 5-10 and to allow G-2 10-l2 density mix. G-3 is located between Minton's and the commercial complex at Prospect. San Jose has designated this area as 5-12 units per acre and Cupertino staff recommends 5-10 density range, or if the properties should combine it could be commercial/residential mix. ~n. Blaine was concerned about allowing general commercial here. She also said there is the question of how long Woolworth needs such a large parking lot. She would like to see more controls placed on this area. Mr. Tim, Cernymo, 74ll Wild Flower Drive, said there are 7 houses along here on Wild Flower and Poppy, and he feels that more traffic will be created on their residential streets. He said their street is small now and they want to keep it that way. The Assistant Planning Director said the staff wants to explore the possibility of "necking-down" the street as it leaves the commercial district and enters the residential district - giving it a gateway effect. PC-29B Page 7 MINUTES OF THE J~~UARY 22, 1979 PLANNING COMMISSION }Ĺ’ETING Mr. Calvin Machida, 1522 Jamestown Drive, San Jose, said his home is on the last lot on G-3. They were not aware of the office building plans until just before Christmas. The entire area was bulldozed. Now there is excessive noise and bright lights from the Saratoga-Sunnyvale Rd. area intruding on his home. They are very concerned about what is going to happen to the western portion of that commercial piece. Comm. Koenitzer said that any commercial development would be required to construct a masonry wall between the commercial and residential properties and they would have to make sure there is no light intrusion into that residential neighborhood. Mr. Taro Yamagami, l36l Saratoga-Sunnyvale Road, said he is concerned about the G-2 and G-l garden center area. He owns most of it and it is presently zoned general commercial. He would prefer to put small, single family homes on that long, narrow piece of land rather than condominiums or apartments. He said he is thinking in terms of a bank or a savings and loan at the corner of Saratoga-Sunnyvale Road and Wild Flower Drive. At this point, he wondered if he should proceed with his plans or if he should wait. The Assistant Planning Director explained this must first go to LAFCO for review. The cities of Cupertino and San Jose are hoping to have this matter resolved by July 1st, but this is still flexible. Comm. Adams stated that G-l would be a good buffer between residential and the G-2 commercial. It was determined that the entire commercial area between #85 and Prospect Road should be PD and that the residential should be 5-10 if developed individually or it could go to 10-20 if there was an overall plan. Moved by Comm. Gatto, seconded by Comm. Adams to continue the public hearing on the Land Use/Community Character Element of the General Plan. Motion carried, 5-0 Ch. Blaine called a recess at 10:45 PM. The meeting reconvened at 10:55 PM. B. Consideration of Working Paper for Public Open Space and Parks Element of General Plan. This discussion included historical resources, school sites, the slope/density for Lindy Lane and the matter of Scenic Blvd./Riviera Road. PC-298 Page 8 MINUTES OF THE J&~ARY 22, 1979 PLANNING COMMISSION MEETING Ch. Blaine stated she had spoken with staff members Mark Caughey and Toby Kramer and a representative from the County in regard to what a historical resources element of the General Plan should contain and then an ordinance should be drafted. The ordinance would have the criteria for judging a site and it must have a body to review it. There must be a zoning to apply to the property. There must be a list of approved uses, how it would be maintained and some amendments to the Building Code. Comm. Gatto requested a list of potential sites first so there would be some idea of the magnitude of this problem. Oomm. Koenitzer would like this list to include a short statement of why a site might be considered to have historical significance. Ca. Blaine said that once we have the ordinance it is open-ended and in years to come it would be there to evaluate properties in the future. There are tax advantages as incentives for the private sector, but the only way this can be accomplished is if we have the ordinance. There waS Some discussion about an ad hoc committee for reviewing the sites. It was felt there should be some input from the H-Control committee on this matter. The Assistant Planning Director suggested a Land Use Element Policy dealing with the USe of school sites. Comm. Claudy said his concern is ide~tifying the character of the neighborhood around Monta Vista Elemen- tary School. The Assistant Planning Director was instructed to speak with the City Manager as to the significance of the density range applied to the school sites. Ch. Blaine would like to zone part of the site public open space and park and part of it residential because that is the way the Planning Commission feels it should be used. Moved by Comm. Koenitzer, seconded by Comm. Adams to continue the public hearing on the Public Open Space and Parks Element of the General Plan. Motion carried, 5-0 UNFINISHED BUSINESS: None. NEW BUSINESS: Comm. Adams requested the staff give the Planning Commission a rundown on the County pockets in the Cupertino area. REPORT OF PLANNING COMMISSION: None. REPORT OF PLANNING DIRECTOR The Assistant Planning Director stated that on February 8th the Noise Element will be considered by the Public Safety Commission.
