Reso 1647 31-TM-76 RESOLUTION NO. 1647 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO 41) RECOMMENDING APPROVAL OF A SUBDIVISION MAP TO DIVIDE 21.3 ACRES INTO A FIVE-UNIT DEVELOPMENT CONTAINING FIFTY-SEVEN (57) LOTS IN UNIT ONE AND THIRTY (30) LOTS IN UNITS TWO, THREE, FOUR AND FIVE. The Commission finds the potential City acquisition of the land area identified as Units 2, 3, 4 and 5 for park purposes to be consistent with the general plan. APPLICANT: Dividend Industries ADDRESS: 3600 Pruneridge Avenue, Santa Clara, California 95051 SUBMITTED: November 29, 1976 LOCATION: Northwest corner of the intersection of Alves Drive and Stelling Road ZONE: R1-7.5 (Residential, single-family, 7,500 sq. ft. per dwelling unit) ACREAGE: 21.3 acres FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of January 24, 1977. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. That the 7.4 acre portion of the tentative map, designated as Units Two through Five, is approved subject to possible acquisition by the City for public park purposes. Said acquisition shall be initiated under separate agreement between the applicant and the City of Cupertino. If the City fails to acquire the park site, the applicant shall be responsible for fully improving the east/west street border- ing Units Two through Five on the north. 16. The applicant shall utilize noise attenuating construction methods along the entire frontage of Stelling Road. Said methods shall be utilized in the construction of the fence along said frontage as well as any and all residential structures as deemed appropriate by the standards expressed in Title 25 of, the California Administrative Code. 17. The applicant shall submit details of the architecture and landscaping for the fencing or sound wall along Stelling Road to the Architectural and Site Approval Committee for approval. 18. The applicant shall prepare a detailed tree preservation plan and make 411 every attempt to save all of the existing specimen trees noted on Exhibit A 1st Revision and any additional deciduous trees deemed desirable, subject to staff approval at the grading permit stage. The grading plan shall be designed in a manner to accommodate the specimen trees. -2- 31-TM-76 Resolution No. 1647 (continued) ® 19. The applicant shall reimburse the City for installation of the water line on the western property line of Units Two through Five adjacent to the City's existing Memorial Park, based upon the benefits to this subdivision as determined by the City Engineer. 20. The applicant shall fully dedicate and make improvements along Stelling Road southerly to Alves Drive. Additionally, the applicant shall enter into a standard reimbursement agreement with the City providing for the reimbursement of the cost of said improvements at such time as the property develops. 21. The applicant shall modify the configuration of Lot 87 so that it orientates to Alves Drive. 22. The applicant shall be responsible for the installation of curb and gutter along the frontage of the existing City-owned tennis court facility. The reference to the City of Cupertino constructing curb and gutter on Exhibit A 1st Revision, as shown at Cross Section "A" - "A", is not approved. Curb and gutter is -not required adjacent to the proposed 7.4-acre park site acquisition. The improvements to Ann Arbor Avenue adjacent to Glenbrook Apartments, including landscaping, shall be installed by the applicant. The street section for Ann Arbor Avenue shall include sidewalk on both sides of the travelled way with a 5-foot landscaped strip along the westerly side adjacent to the Glenbrook Apartments. The landscaped improvements 410 shall be subject to the review and approval of the Architectural and Site Approval Committee. 23. The park purchase schedule noted on Exhibit A 1st Revision does not reflect any legal agreement with the City .of_ Cupertino and is hereby voided. 24. The pedestrian easement as shown on the tentative map connecting Ann Arbor Avenue and Rumford Drive is not required and therefore shall be deleted. 25. The approval is based upon Exhibit A 1st Revision of Application 31-TM-76, as may be modified by additional conditions contained herein.
