411, RECOMMENDING APPROVAL OF A TENTATIVE MAP TO DIVIDE
APPROXIMATELY FIVE (5) ACRES INTO TWO (2) PARCELS.

FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meet-
ing of February 14, 1977.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
improvement requirements set forth in Policy Statement No. 3 of the
Hillside General Plan and the special conditions enumerated herein.
In the event a conflict does exist, the special conditions as enumerated
herein shall apply.
® 15. That the approval is based upon tentative map Exhibit A, as may be
modified by additional conditions contained herein.
16. That the applicant shall prepare an appropriate legal instrument to
be approved by the City Attorney which transfers the development
right for one potential dwelling unit from contiguous property to the
subject property. Said agreement shall be signed by the owner of said
contiguous property and shall b.e recorded to appraise potential pur-
chasers that the right to build one of the potential dwelling units
that may be permitted, based upon the general plan currently in effect,
has been transferred to the land area encompassed by the subject
tentative map.
17. The developer shall agree to participate in an improvement district
to install street improvements on public roadways within the Regnart
Canyon area which is defined by the general plan. The City shall
relieve the developer of the above requirement if and only if the
assessment district is not formed within a one-year period of time at
which time the developer shall install the required improvements as
outlined in the conditions of approval.
18. The Architectural and Site Approval Committee shall approve plans for
additional grading and property fencing on the subject parcels. In
order to permit migration of wildlife and to retain the natural open
character of the hillside area, solid fencing shall be limited to a
building envelope as defined by the Architectural and Site Approval
Committee.
