RESOLUTION NO. 1671
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A TENTATIVE PARCEL MAP TO
CONSOLIDATE FIVE EXISTING PARCELS TOTALING 2.55
ACRES INTO ONE PARCEL.

FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of March 14, 1977.
CONDITIONS :
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
S 15. The approval is granted based upon tentative map Exhibit A of 2-TM-77,
as may be modified by additional conditions contained herein.
16. That the applicant shall include the existing sanitary sewer-easements
running through the existing rights-of-way, and along the northerly
property line of the parcels fronting on Stevens Creek Boulevard on
the final parcel map.
17. The applicant shall sign a statement with the City which is acceptable
to the City Attorney, agreeing to provide reciprocal parking and ingress/
egress easements to the properties designated on tentative parcel map
2-TM-77 as owned by National Life and Accident Insurance Company, and
Baer Property (see Exhibit A of Application 2-TM-77) at such time as the
City can require the same of said property owner/s.
Additionally, the agreement shall state that the applicant will provide
reciprocal parking and ingress/egress easements with the adjoining
Catholic Church property at such time as the owner of the St. Joseph's -
Catholic Church dedicates and/or improves the Church frontage along North
De Anza Boulevard and agrees to provide reciprocal parking and ingress/
egress easements to the applicant. The agreement should state that it
is understood that said easements are to be mutually agreeable by both
parties. The precise location of said ingress/egress easements with
the Church property to the north and east shall be determined and
based upon future negotiations concerning an enlarged right-of-way
area and the most logical location of major driveway entrances off of
110 said right-of-way.
