RESOLUTION NO. 1685 (Minute Order)
S OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
FINDING THE CONCEPT OF UTILIZING DEVELOPMENT RIGHTS
TRANSFER TO REDUCE THE COST OF OPEN SPACE ACQUISITION
TO BE BOTH COST EFFECTIVE AND CONSISTENT WITH GENERAL
PLAN POLICY.
The finding specifically relates to the proposed transfer of development
rights for three dwelling units from 63 acres to be purchased from the
Nellis family by the Mid-Peninsula Regional Open Space District to residual
acreage owned by the Nellis family. The proposal involves the transfer of
three dwelling units from the 63-acre land area which is entitled to a total
of fourteen dwelling units as determined by application of the Semi-Rural
5-acre slope density formula. Although the three dwelling units can be
added to the slope density yield generated on the remainder of the Nellis
holding, the finding of consistency relative to development rights transfer
does not preclude the City from reducing dwelling unit density for a sub-
sequent development proposal contingent upon environmental and other
factors.
