Reso 1737 - 18-TM-77 RESOLUTION NO. 1737 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO SUBDIVIDE .405 ACRES INTO TWO PARCELS. APPLICANT: South County Development Corporation ADDRESS: c/o Retail Commercial Properties, 1737 N. First St. , #470, San Jose, California 95112 SUBMITTED: July 14, 1977 LOCATION: Southerly of and adjacent to Stevens Creek Boulevard approximately 116 ft. easterly of Blaney Avenue FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of September 12, 1977. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. That the approval is based upon Exhibit A 1st Revision of Application 18-TM-77 as may be modified by additional conditions contained herein. • 16. The applicant shall modify the two existing driveways located on Stevens Creek Boulevard to accommodate a one-way drive with the adjoining property owner to the east and a two-way drive with the U.S.A. Petroleum site to the west. 17. That the applicant shall enter into reciprocal ingress/egress agree- ments with the Gazzera property (Fisherman's Village Restaurant site) located to the east and with the developed portion of the U.S.A. Petroleum site located to the west. Said agreement shall be subject to the review and approval of the City Attorney prior to recordation of the final map. The easement area shall be located on the final parcel map which shall be recorded concurrently with the closing of escrow on the subject property. If the applicant is unable to obtain the permission of the adjoining property owners to implement said reciprocal drives, the applicant shall sign a statement acceptable to the City Attorney, agreeing to provide reciprocal ingress/egress easements with the adjoining properties at such time as the City can require the same from the adjoining property owners. • -2- , 7, 18-TM-77 Resolution No. 1737 (continued) ® PASSED AND ADOPTED this 12th day of September, 1977, at a regular meeting of the Planning Couaiiission of the City of Cupertino, State of California, by the following roll call vote: AYES: Commissioners Blaine, Markkula, Chairman Koenitzer NAYS: None ABSTAIN: None ABSENT: Commissioners Adams, Gatto APPROVED: QN &tpR.
