Gatto received a letter from the Attorney's Office in regard to an item on this agenda, which he submitted to the staff. There was a letter from Mayor Meyers, dated May 8, 1979, in regard to San Jose Planning Commission #PDC 79-3-39. ORAL COMMUNICATIONS There were none. PUBLIC HEARINGS 1. Application 3-TM-79 of STATE MUTUAL SAVINGS & LOAN ASSOCIATION: TENTATIVE MAP to subdivide approximately two acres into 23 parcels consisting of 20 townhouse parcels, one condominium parcel, one common area parcel and one parcel equaling approximately 0.8 of an aCre to accommodate an office building and ENVIRONMENTAL REVIEW: The project was previously assessed, hence no action is required. Said property is located on the southwest corner of Stevens Creek Blvd. and Finch Avenue. First Hearing continued. Moved by Comm. Blaine, seconded by Comm. Adams to continue application 3-TM-79 to June 25, 1979. Motion carried, 5-0 The Planning Director was assured that statements in the May 10th memo were accurate according to the Planning Commission's concerns and could be forwarded to the H-Control. The 10' setback should be maintained. Comm. Adams said that although the Planning Commission is disappointed in the changes, it should go forward to the City Council along with both sets of drawings. MINUTES OF THE I1AY 14, 1979 PLANNING COMMISSION MEETING PC-306 Page 3 2. Application 5-TM-79 of MAXINE DRUMMOND: TENTATIVE MAP to subdivide approximately 0.7 acre into two parcels equaling 10,500 sq. ft. and 18,600 sq. ft. and ENVIRONMENTAL REVIEW: The project is categorically exempt, hence no action is required. Said property is located on the west side of Carmen Road approximately 150 feet southerly of Cupertino Road in a pre-Rl-lO zoning district. First Hearing. The Assistant Planning Director said this application is consistent with the General Plan. If the Stevens Creek Blvd. Plan Line is implemented, it will require abandonment of parcel 2, but this would require separate action. Comm. Adams was answered by the Assistant City Engineer that this is an uphill slope easement and at the present time the City policy is to not take any uphill easements. The Assistant Planning Director said there is an on-grade driveway to the existing residences. Comm. Adams does not want this to come in for a variance sometime in the future. He wants to make sure there is a net 10,000 sq. ft The Assistant Planning Director suggested this be a condition of approvaL Action on this application was delayed so the staff could check the topo maps. 3. Application 5-U-79 of VICTOR J. CHINN (MAGIC WOK): USE PERMIT to operate a 3,000 sq. ft. fast-food restaurant on the former Red Barn site and ENVIRONMENTAL REVIEW: The Environmental Review Committee recommends the granting of a Negative Declaration. Said property is located on the northwest corner of Stevens Creek Blvd. and Saich Way in a CG (General Commercial) zoning district. First Hearing. The Associate Planner reviewed the details of the May ll, 1979, staff memo. He answered Comm. Koenitzer that there is a bus stop at that corner. Comm. Adams stated he hoped the trash enclosures would be taken care of with this new business better than the previous one. Mr. Victor Chin, 679 Grand Coulee, Sunnyvale, said he was the applicant. He will work with the ASAC as to landscaping. He has already agreed to installing additional landscaping by the bus stop. He answered Ch. Gatto that there would be no drive-up windows. Motion carried, 5-0 It was noted there is a 2' difference in elevation in this parking lot and that of the Good Earth Restaurant next door. Moved by Comm. Adams, seconded by Comm. Claudy to recommend granting of a Negative Declaration. Motion carried, 5-0 Moved by Comm. Adams, seconded by Comm. Claudy to approve application 5-U-79, subject to conditions 1-18 in the May 10, 1979 staff report and Condition 19 - that H-Control review the trash enclosure. Motion carried, 5-0 The Planning Commission returned to the Public Hearing of 5-TM-79. The Assistant Planning Director stated that a review of the topo map shows the present bank is outside the plan line. Comm. Koenitzer suggested that since there will be no access to Stevens Creek Blvd., that the applicant's obligation to pay certain costs be removed. The Assistant Planning Director said this is a policy issue. On major boulevards, minor properties should not be involved in major improvements. The applicant stated she was in favor of no access to Stevens Creek Blvd. The Assistant City Attorney advised that since the applicant would realize no benefit without access, she should be released from that obligation. Since there were no comments from the audience, it was moved by Comm. Blaine, seconded by Comm. Adams to close the Public Hearing. Application 4-Z-79 of CITY OF CUPERTINO: PREZONING 23+ acres from Santa Clara County zones R2-h (two family residen~e) and CG (General Commercial) to City of Cupertino P (Planned Development with residential and neighborhood commercial intent) zone consistent with the adopted General Plan or whatever zone is deemed appropriate by the Planning Commis- sion and ENVIRONMENTAL REVIEW: The Environmental Review Committee recommends the granting of a Negative Declaration. The 23± acres located westerly of Freeway Route 85, southerly of University Avenue, easterly of Peninsula Avenue and northerly of Stevens Creek Blvd. First Hearing. The Director of Planning and Development reviewed details of the May 10, 1979 staff memo. He noted the recommendation is for Planned Development with Residential and Neighborhood Commercial consistent with the adopted General Plan and annexation to the City of Cupertino. Any new construction would be subject to the Use Permit procedure. For the benefit of the audience, the Planning Director gave a brief history of this property. After much study and discussion, it was determined Monta Vista should stay with its present character. The commercial would remain along Stevens Creek Blvd. and the remainder from 4 units per acre to 7 units per acre residential. Any new construction will be evaluated according to the present neighborhood. A map was placed on the board, illustrating these statements. Mr. Ed Stepronski, lOl18 Santa Clara Avenue, stated his 5000 sq. ft. lot will not conform to the new zoning. Ch. Gatto stated that any lots of record are allowed to construct at least one residence. Mr. Stepronski said he presently has a duplex on his lot and wondered what would happe~, say, if part of it burned. The Assistant City Attorney advised that if a fire caused 75% or more destruction of his property he could not rebuild; less than 75%, he could rebuild. PC-306 Page 6 MINUTES OF THE MAY 14, 1979 PLANNING COMMISSION MEETING Mr. Ray Maffin, 10lll Santa Clara Avenue, said he has a single-family dwelling on his property now, but he would like in the future to add 2 units on these 2.5 lots. He is On a corner. He said this is a duplex area at the present time and he does not believe it would be appropriate to make this a single-family area. Ch. Gatto said the intent of the prezoning is to establish 4.4 to 7.7 dwelling units per acre range. The Planned Development allows more flexibility than a straight Rl would. Mr. Maffin stressed that they want to keep R2. Mr. John K. Higgins, 10201 Alhambra, said he is concerned about the I Little Souls Nursery and wondered about the owners' ability to continue this use. The Planning Director said if it is a legal use in the County it will be accepted by the City of Cupertino. He added that if there are Some illegal uses in the County, then they will be illegal in the City. Mr. John Waller, 10230 Peninsula Avenue, said he does not wish to be adopted into the City of Cupertino. The Planning Director said that if the Planning Commission makes a positive determination, this will I go to the City Council June 18th, and that is when Mr. Waller should make his feelings known. Mr. Earl Butler, 10156 Peninsula Avenue, said he was planning to convert his present dwelling to a duplex. It will not require any addition to the house. When he learned that his one lot is entitled to only one dwelling, he said that is why he is against the annexation. The Planning Director said he had checked with the County and learned there is the possibility that he could build a duplex in the County if he could meet all the County requirements. i Comm. Koenitzer had a slight modification to condition 4 on page 1 of the Monta Vista Zoning Plan. Comm. Gatto acknowledged this was a Martha Higgins, 1020l Alhambra Avenue, noted that at the present time it is possible to build 2 units. She would like to add 3 bedrooms and 2 baths to her present home. She wondered if she would be prevented from doing this. She does not at this time see any advantage to annexing to the City of Cupertino. Conditions 7 and 8 were modified. Application 19-U-76 (Revised) of ANY MOUNTAIN, LTD: AMENDMENT of a previously approved use permit to construct a l2,500 sq. ft. facility and add a 200 sq. ft. addition to the existing Ski Any Mountain building and ENVIRONMENTAL REVIEW: The Environmental Review Committee recommends the granting of a Negative Declaration. Said property is located on the southwest corner of North De Anza Blvd. and Mariani Avenue in a P (Planned Development with light industrial, general commercial and residential (4-10 dwelling units per acre) intent) zoning district. First Hearing. The Associate Planner reviewed details of the May ll, 1979 staff memo. He noted this proposal does not conform with the trip end constraint. The building is 3,600 sq. ft. larger than was approved by the Planning Commission. Also, the second floor is about 800 sq. ft. larger than the plan. Parking is the other major issue. The staff recommended continuation of this proposal to allow the app~icant time to seek additional trips. The applicant said he wanted a decision at this meeting. Comm. Koenitzer was answered that the BAS Homes next door are presently occupied. Ch. Gatto asked for comments from the audience. PC-306 Page 8 MINUTES OF THE MAY 14, 1979 PLANNING COMMISSION MEETING Mr. Eldon Hoffman, 21048 Bank Mill, Saratoga, said the original trips allowed 47.1; the City calculated 35.8 trips - giving a surplus of ll.3. This was based on gross sq. ft. of the store. Warehouse space was included. He said the warehouse does not generate traffic. He had a study done, based on retail space that came up with 22.8 trips. He did not argue the point with the City at the time because he wanted to get his building built. As to the enlargement of the store, he said the only change he made was addition of a mezzanine for warehousing of materials. , Ch. Gatto advised it would be appropriate with Mr. Hoffman to get back with the staff and tabulate the disagreements so it can be studied by the Commission. ,Mr. Hoffman said he wants to add a sub-basement to the proposed . building, to be used for bulk storage and also to build a mezzanine for office space. Comm. Gatto said his point about warehouse space was valid, but did not see how the Commission could take action at this point. ,Mr. Hoffman said his_parking lot is inadequate November and December; I and he is open 7 months per year. This is a unique situation. He . said he was not asking for additional retail space. He believes he I is being penalized for being semi-successful. Comm. Blaine asked where the office is presently located. Mr. Hoffman said they now rent mini-warehouses across the street. The deliveries , . i could be made ~n one or two loads rather than 5 or 6. They had an I office but it was replaced with a lunch room for the employees. i Comm. Claudy said he would vote for continuation or against this ! proposal. Comm. Adams and Koenitzer agreed. Comm. Blaine would like I clarification of the meaning of "warehouse" 9 and of all extenuating circumstances here. Architect Rob Steinberg, 1737 North First Street, San Jose, explained their time constraints. I Mr. Rich Lampson, Manager of Any Mountain, said the proposed building I is for rental of equipment. There are no loading docks. I Mr. Its Uenaka, owner of Cupertino Nursery next door, said his peak I times are springtime and Mr. Hoffman's peak period is ski Season. Applications 5-Z-79 and 6-TM-79 of CHARLES & SHIRLEY SNYDER: REZONING approximately 0.7 gross acre from Al-43 (Agri- cultural Residential 43,000 sq. ft. minimum lot size) to Rl-IO (Residential single-family 10,000 sq. ft. minimum lot size) or whatever zone may be deemed appropriate by the Planning Commission: Tentative Map to subdivide approxi- mately 0.7 acre into two parcels equaling approximately l5,OOO sq. ft. each and ENVIRONMENTAL REVIEW: The Environ- mental Review Committee recommends the granting of a Negative Declaration. Said property is located at the terminus of Mount Crest Place. First Hearing. The Assistant Planning Director reviewed details of the May 11, 1979 staff report. It is consistent with the General Plan; howevèr, some issues should be resolved. The staff recommended this area be looked at as to appropriate land use. The General Plan character and the question of the degree of access to the Snyders' home and other lots to the private road should be studied The staff recommended this be continued to July 9th. Comm. Koenitzer stated the original subdivision was allowed, based on averaging. He would like to know more about the 1965 subdivision. Ch. Gatto noted this entire area needs to be re-studied. The question is whether this should be done before or after action is taken on this request. The Assistant Planning Director stated the consultant needs more time to determine whether this property is stable. Comm. Koenitzer believes the entire area should be studied first. The street needs to be studied in relation to the property behind it. Comm. Blaine would like to take another look at the slope/density formula in relation to this property. Gatto would like to know the rationale of why these lots arrived at the present configuration. Mr. Charles Snyder, l1244 Mount Crest Drive, presented a petition signed by his neighbors in support of his proposal. He said there are two areas involved here, as it pertains to the General Plan. The Mount Crest cul-de-sac area shows lO,OOO sq. ft. lots. There are lots in that area less than 15,000 sq. ft. He does not believe they were based on an evaluation. In March 1961 Mount Crest (a steep road) was the primary access to his property off Lindy Lane. He has had a right of access denied by City Ordinance. He said he has a legal ingress/egress to that private road. It is the more logical way to get to his property. It is a steep hill, but it is also a beautiful area. His proposal would also be helping the housing situation in Cupertino. ¡Mr. Dennis Paboojin, 21989 Linda Lane, said he has 2 of the 6 parcels i included in the half-acre minimum with road access. He is concerned about the discussion on May 23rd which will affect his property and the possible decision on July 9th that will affect his property. He will be out of the Country at that time and cannot be present. ;He also said that in 1974 the residents in that area came to City ,Hall to discuss this. He is not clear as to what changes are taking place. It was determined that no individual could subdivide unless all tne others on that road agreed to it. .If Snyder is allowed to subdivide, then the others should also be allowed to subdivide. Ms. Juanita McLaren, 22101 Lindy Lane, said she has been there 23 years. She explained how she and the other 8 land owners were asked to annex. She said they were never included in the Hillside Study. These large parcels can be a fire hazard if not taken care of. Her home is now being used for a turn-around. She wants it kept a private road, not : a public street. She is concerned about the fire hazard and believes II it is time to develop up there because it is almost impossible to ,maintain a full acre. ¡Mr. Snyder responded he would not affect Ms. McLaren's ingress/egress. The home and garage would have legal setback. The Fire Department said they could service the area from the private road or Mount Crest. Mr. Snyder said he was granted ingress/egress rights in 1961, and the propertys were granted exclusive use in 1965. It is difficult to police the area when it is a private road. The entire area should ; be studied. : Comm. Claudy believes of the General Plan. developed. Applications 7-TM-79 and 6-U-79 of CARL HOLVICK COMPANY: TENTATIVE MAP to subdivide approximately 3 acres into 2 parcels equaling approximately 2.2 acres and 0.7 acre; USE PERMIT to construct a 28,300 sq. ft. industrial building ENVIRONMENTAL REVIEW: The Environmental Review Committee recommends the granting of a Negative Declaration. Said property is located easterly of Bandley Drive and Westerly of De Anza Blvd., approximately 200 ft. northerly of Lazaneo Drive in a P (Planned Development with light industrial, commercial and residential (4-10 dwelling units per acre) intent) zoning district. First Hearing. The Assistant Planning Director reviewed details of the May ll, 1979 staff memo. Both the map and uSe permit are consistent with the , General Plan; however, he wanted to discuss the degree of access. The staff believes there should be a floating eaSe- ment between the Uenaka and Brown east/west street. It was suggested the ASAC be given the opportunity to review the Uenaka and Brown properties to shift the buildings and the parking somewhat to allow the east/west access to function as an aisleway. Mr. Jim Walker, ll660 Regnart Canyon Drive, representing the applicant, said this development is consistent with what has been I happening in the area. It meets the needs of Apple Computer I Company. He would like some clarification of a "floating easement1'. Dr. Joe Brown, Peppertree Lane, said the issue tonight is the building for Apple Computers. The possibility of east/west access is probably of no consideration tonight other than restriction I that no barrier be constructed to prevent it at a later date. I Mr. Walker said it is important to keep the Apple buildings close together. Mr. Its Uenaka said he will cooperate with Dr. Brown to the extent that a common driveway does not affect his business (Cupertino Nursery). He believes the east/west access can be determined at a later date. Blaine, to extend 26-TM-77 approval for one year. Motion carried, 5-0 REPORT OF PLANNING COMMISSION. Ch. Gatto wants to streamline the operation of the applications so they can be acted upon more expeditiously. Icarom.
