Reso 1750 17-TM-77 1111 RESOLUTION NO. 1750 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO DIVIDE 5.2 ACRES INTO THREE PARCELS. APPLICANT: The Koll Company (WTW, Inc.) ADDRESS: 3130 Coronado Drive, Santa Clara, California 95050 SUBMITTED: July 19, 1977 _ _ LOCATION: Southeast corner of the intersection of Alves Dr. and Bandley Dr. ACREAGE: 5.2 acres FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of October 10, 1977. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. That the approval is based upon Exhibit A of Application 17-TM-77® as may be amended by additional conditions contained herein. 16. It is recognized that Application 17-TM-77 is a companion application with 20-TM-77, and that the final parcel map associated with this approval shall be recorded first and thereafter be immediately followed, on the same day, by the transfer of ownership of Parcel C to the owners of the Home Savings parcel identified in Application 20-TM-77, after which the applicants shall record the final parcel map associated with Application 20-TM-77. This application shall be held invalid if the companion final parcel map and transfer of ownership of Parcel C are not filed and recorded consecutively on the same day in the manner as prescribed above. 17. The applicant shall record a deed restriction and covenant running with the land, satisfactory to the City Attorney, which provides for cross vehicular circulation and parking easements between all parcels within this subdivision prior to recordation of the final parcel map. 18. The property lines between Parcels A and B shall be adjusted to ensure that Parcel A meets the parking requirements to accommodate the recently approved market center. This adjustment must be realigned to shift 10 parking spaces from Parcel B to Parcel A. 19. The applicant shall provide an asphalt concrete overlay on Alves Drive from North De Anza Boulevard to Bandley Drive. The structural section shall be subject to approval by the City Engineer. -2- I - T 17-TM-77 Resolution No. 1750 (continued) ® 20. The applicant shall record a deed restriction and covenant running with the land, which is acceptable to the City Attorney, providing for reciprocal cross vehicular circulation and ingress/egress easements with all of the properties bordering the subject site. If the applicant is unable to obtain the mutual cooperation of any adjoining property owners, he shall sign a statement, which is acceptable to the City Attorney, agreeing to provide reciprocal circulation and ingress/egress easements at such time as the City can require the same of the adjoining property owner.
