Reso 1760 15-TM-77 RESOLUTION NO. 1760 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO SUBDIVIDE APPROXIMATELY 10.6 ACRES INTO TWENTY-FIVE (25) SINGLE- FAMILY LOTS AND ONE LOT TO REMAIN UNDEVELOPED. APPLICANT: B.A.S. Homes, Inc. ADDRESS: 20823 Stevens Creek Blvd. , Cupertino, California 95014 SUBMITTED: June 24, 1977 LOCATION: Easterly of and adjacent to Beardon Drive at the northeast corner of the intersection of Beardon Drive and Greenleaf Dr iv e ZONE: P (Planned Development) FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of October 24, 1977. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. ® 15. That the approval is based upon Exhibit A of Application 15-TM-77, as may be modified by additional conditions contained herein. 16. That prior to recordation of the final map, the applicant shall submit a detailed landscaping plan and if required a sound wall design to the Architectural and Site Approval Committee for those portions of the development along the northerly boundary line and the easterly boundary. The easterly property line shall be moved a minimum of ten (10) feet to the west to accommodate a minimum of fifteen (15) foot landscaped area as approved by the Architectural and Site Approval Committee. 17. The applicant shall install landscaping including an irrigation system for the fifteen (15) foot landscaped area located adjacent to Bandley Drive as approved by the Architectural and Site Approval Committee. The applicant shall record an appropriate legal document binding sub- sequent lot purchasers to fund the long-term cost of City maintenance of said landscaping setback areas. Prior to recordation of the final map, an open space maintenance district shall be formed incorporating all lots within the subdivision. The applicant shall deposit with the City and the City shall establish an account to fund the estimated periodic maintenance costs of said landscaping for a period not to exceed ten (10) years. The intent of the condition is for the appli- cant to install natural plant materials and maintain said areas until said landscaping is well established and relatively maintenance free. ® The future lot owners will be responsible for maintenance costs upon expiration of the ten (10) year period or upon exhaustion of the ten (10) year maintenance fund deposit, whichever occurs first. -2- 15-TM-77 Resolution No. 1760 (continued) 411 • 18. The applicant shall make an irrevocable offer of dedication for a street right of way width sufficient to provide for the extension . of Greenleaf Drive to Bandley Drive.
