USE INTENT.
APPLICANT: Pete & Marlene Sulaver and Marilyn & Al Hiatt
ADDRESS: 20640 Rodrigues Ave. , Cupertino & 4861 Marion Way, Santa Clara, CA 95051
SUBMITTED: September 16, 1977
LOCATION: Adjacent to and northerly of Stevens Creek Blvd. approximately
150 ft. easterly of the intersection of Stevens Creek Blvd.
and No. De Anza Blvd.

subconclusions as set forth in the minutes of the Planning Commission meeting
of November 14, 1977.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions enumerated herein shall apply.
15. That the approval is based upon Exhibits B, C, E 1st Revision of
® Application 27-U-77 as may be modified by additional conditions
contained herein.
16. That the approval is for the restoration of the existing historically
significant single-family home consisting of approximately 3,000 sq.
ft. , to be used for general retail commercial and retail office uses.
The allowed uses shall be restricted to those of a retail sales nature
such as music shops, record stores, office supplies, book stores,
florist shops, arts and crafts stores, and/or office uses such as
real estate offices, insurance offices, etc. New uses may be permitted
to occupy the retail/office space in this project when, in the opinion
of the Planning Director, they substantially conform to the above list
of permissible uses and when it is determined that theywill not exceed
a maximum trip generation rate of two trips per 1,000 sq. ft.
17. It is recognized that the land use intensity will generate more than the
equivalent of 16 one-way trips per acre during the peak hour. The Plan-
ning Commission finds that the Baer House is of historical significance
to the community and hereby waives strict compliance with the trip stan-
dard. The following accounting of trips is hereby incorporated into the
subject approval:
Trips generated by the project (3,000 sq. ft. x 2 trips per 1,000) = 6 trips
Allowable trips (.36 net acres x 16) = 5..•7 trips
IRO Historical credit = 0.3 trips
SURPLUS = 0 trips
