Reso 1767 27-U-77 RESOLUTION NO. 1767 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO ® RECOMMENDING APPROVAL OF A USE PERMIT TO UTILIZE EXISTING STRUCTURE FOR RETAIL AND PROFESSIONAL OFFICE USE INTENT. APPLICANT: Pete & Marlene Sulaver and Marilyn & Al Hiatt ADDRESS: 20640 Rodrigues Ave. , Cupertino & 4861 Marion Way, Santa Clara, CA 95051 SUBMITTED: September 16, 1977 LOCATION: Adjacent to and northerly of Stevens Creek Blvd. approximately 150 ft. easterly of the intersection of Stevens Creek Blvd. and No. De Anza Blvd. FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of November 14, 1977. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. That the approval is based upon Exhibits B, C, E 1st Revision of ® Application 27-U-77 as may be modified by additional conditions contained herein. 16. That the approval is for the restoration of the existing historically significant single-family home consisting of approximately 3,000 sq. ft. , to be used for general retail commercial and retail office uses. The allowed uses shall be restricted to those of a retail sales nature such as music shops, record stores, office supplies, book stores, florist shops, arts and crafts stores, and/or office uses such as real estate offices, insurance offices, etc. New uses may be permitted to occupy the retail/office space in this project when, in the opinion of the Planning Director, they substantially conform to the above list of permissible uses and when it is determined that theywill not exceed a maximum trip generation rate of two trips per 1,000 sq. ft. 17. It is recognized that the land use intensity will generate more than the equivalent of 16 one-way trips per acre during the peak hour. The Plan- ning Commission finds that the Baer House is of historical significance to the community and hereby waives strict compliance with the trip stan- dard. The following accounting of trips is hereby incorporated into the subject approval: Trips generated by the project (3,000 sq. ft. x 2 trips per 1,000) = 6 trips Allowable trips (.36 net acres x 16) = 5..•7 trips IRO Historical credit = 0.3 trips SURPLUS = 0 trips -2- 27-U-77 Resolution No. 1767 (continued) ® 18. The applicant shall provide a tree preservation plan detailing the trees to be preserved and removed. Said plan shall analyze the impact of construction and grading operations as well as future landscaping proposals on said trees. The plan shall be prepared by a landscape architect or tree surgeon in accordance with Ordinance No. 778 and shall be presented to the Architectural and Site Approval Committee at the time of application for architectural and site approval. It is understood that every attempt shall be made to preserve as many of the specimen trees as possible. 19. The applicant shall enter into reciprocal ingress/egress -and cross circulation easements with the adjoining Pacific Valley Bank to the north. Additionally, the applicant shall prepare and sign a state- ment, acceptable to the City Attorney, agreeing to provide reciprocal ingress/egress easements with the adjoining service station property to the west at such time in the future as the City can require the same from the adjoining property owner. Additionally, reciprocal easement agreements that are mutually agreeable between the bank and applicant will be permitted in the future. 20.
