RESOLUTION NO. 1777
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF USE PERMIT TO ALLOW CON-
STRUCTION OF A DOUGHNUT SHOP CONTAINING APPROXIMATELY
1500 SQ. FT. IN A P (PLANNED DEVELOPMENT) ZONE.

FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meet-
ing of November 14, 1977.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions enumerated herein shall apply.
15. That the approval is based upon Exhibit A of Application 29-U-77,
® as may be amended by additional conditions contained herein.
16. That the approval is for a 1,540 sq. ft. doughnut shop facility. (per City Council
17. The owner shall sign a statement, acceptable to the City Attorney,
agreeing to provide reciprocal ingress/egress easements with the
property to the south at such time in the future as the City can
require the same of the adjoining property owner.
18. The owner shall be required to install a masonry wall, to match the
existing wall on the property to the south, which shall extend along
the easterly side of the building and wrap around the northerly side
to help buffer this development from the adjoining residential neighbor-
hood.
19. This approval does not imply acceptance of the proposed architecture.
The Architectural and Site Approval Committee shall closely review
the architectural style and building form to ensure minimal impact
on the adjoining residential neighborhood.
20. The Planning Commission reserves the right to review this use permit
and add further conditions or require actions to mitigate any unreason-
able noise impacts resulting from the use.
Said conditions or actions may include, but are not necessarily limited
• to the following:
1. Restriction on the hours of operation.
2. Restrictions on trash pickup hours.

the Planning Commission of the City of Cupertino, State of California, by the
