PC Reso 1619 '' 26-TM-76 RESOLUTION NO. 1619 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO SUBMITTING A REPORT TO THE CITY COUNCIL RECOMMENDING 4) APPROVAL OF TENTATIVE MAP APPLICATION 26•-TM-76, SUBJECT TO THE FOLLOWING CONDITIONS' OF APPROVAL . APPLICANT: Dr, Joseph F. Brown ADDRESS: P. 0. Box C, Cupertino, California 95014 SUBMITTED; October 15, 1976 LOCATION: Northeast corner of the intersection of Lazaneo Drive and Bandley Drive with. a small segment fronting on North. De Anza Blvd. ACREAGE: 3.79 acres CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. The tentative map is approved based upon tentative map Rxhibit A, 26-TM-76, as may be modified by additional conditions contained herein. 16. The developer shall participate in the costs of the installation of the traffic signal at De Anza Boulevard and Lazaneo Drive as the amount is determined by the City's assessment attorney based upon benefits. 110 17. A reciprocal vehicular circulation easement shall be recorded to permit access to a 20-ft. wide future private roadway which shall be located contiguous to the full length of the westerly boundary line of Parcel C. The easement shall be 30-ft, 'wide for that section between Parcels B and C. The easement shall be written in a manner, as approved by the City Attorney, so as to allow access to said easement for Parcels A & B, both parcels labeled "Lands of Brown" located to the north of the map boundary, "Lands of Murphy, Lands of Spain, Lands of Posty, Lands of City of Cupertino, and Lands of Durkee", as labeled on Exhibit A of 26-TM-76. 18. The roadway improvements for the private driveway, described in Condition 17, shall be installed when necessary to service future development of the properties referenced in Condition 17. The City shall determine the necessity of access based upon a subsequent proposal for development on one or more of the properties referenced by Condition 17. A suitable financial guarantee approved by the City Engineer shall be submitted to the City guarantying completion of said improvements. -2- CITY . TENTATIVE MAP WHEREAS, the attached application has been' submitted to the City of Cupertino requesting approval of a tentative map; and 11, WHEREAS, the Planning Commission has held at least one public hearing in regard to the application; and WHEREAS, the Planning Commission has. duly IConsidered and heard all evidence submitted in regard to said application; and WHEREAS, the necessary public notices have been given as required by the subdivision and procedural ordinances of the City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission makes the, following findings: a) That the proposed map is consistent with the general and specific plans.
