OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A TENTATIVE MAP TO SUBDIVIDE
411 6.8 ACRES INTO 28 SINGLE-FAMILY CLUSTER RESIDENTIAL
LOTS PLUS ONE LOT TO BE HELD IN COMMON AND TWO LOTS
TO REMAIN UNDEVELOPED

CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with
the special conditions enumerated herein. In the event a conflict
does exist, the special conditions as enumerated herein shall apply.
15. The approval is -based upon Exhibits A - 1st Revision, A-1, A-2, and
A-3, as may be modified by additional conditions contained herein.
16. That the applicant shall provide a 12-ft. pedestrian easement from
the terminus of Scenic Blvd. to Stevens Creek Blvd. which shall be
Ill designed in such a manner as to serve as an emergency access for
fire vehicles into or out of this area. The final design shall be
reviewed and approved by the City Engineer. Said easement shall be
recorded as part of the final map.
17. The applicant shall present a plan illustrating the trees to be
preserved and removed along with a box detail in areas of land cut
or fill resulting from grading, and shall provide detailed provisions
for the preservation of the trees to be preserved during and after
construction. Said plan shall be provided to the Architectural and
Site Approval Committee for approval at the time of submission of
detailed Architectural and Site plans.
18. The applicant shall provide to the City the appropriate legal
documents from any private landowners of property on which off-site
grading will occur. The format of the legal document shall be subject
to the review and approval by the City Attorney prior to obtaining
signatures and shall be submitted with all the appropriate signatures
prior to recording of the final map.
19. The applicant shall provide detailed plans illustrating the location,
grading and transition alignment of Scenic Blvd. with the existing
portion of Scenic Blvd. located to the west of the subject develop-
ment. The final grading and alignment shall be subject to the review
and approval by the City Engineer.

RESOLUTION OF THE PLANNING COMMISSION. OF THE CITY OF CUPERTINO RECOMMENDING
THE APPROVAL OF A TENTATIVE MAP
WHEREAS, the attached application has been submitted to the City of Cupertino
requesting approval of a tentative map; and
WHEREAS, the Planning Commission has held'at least one -public hearing in
regard to the application; and
WHEREAS, the Planning Commission has duly considered and heard all evidence
submitted in regard to said application; and
WHEREAS, the necessary public notices have been given as required by the
subdivision and. procedural ordinances of the City of Cupertino.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Planning Commission makes the following findings:
a) That the proposed map is consistent with the general and specific •
plans.
b) That the design or improvement of the proposed subdivision is
consistent with the general and specific plans.
c) That the site is physically suitable for the type of development.
d) That the site is physically suitable for the proposed density of
development.
e) That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat.

f) That the design of the subdivision or the type of improvements are
not likely to cause serious public health problems.
g) That the design of the subdivision or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of, property within the proposed subdivision.

20. All buildings and fences shall be constructed on or within the lot
® lines. The buildings and fences shall be located as described on
the precise site plan reviewed by the Architectural and Site Approval
Committee and approved by City Council.
The Covenants, Conditions and Restrictions shall contain a statement
informing individual lot buyers that the lot area outside of the
building area and fence area that is described as common area on the
approved Architectural and. Site Approval Committee plan shall be
developed and maintained as common area.
PASSED AND ADOPTED this 26th day of July, 1976, at a regular meeting of the
Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
