PC Reso 1540 • 81,004.151 RESOLUTION NO. 1540 (Minute Order) OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO 4, ASKING THE CITY COUNCIL FOR CLARIFICATION OF INTENT REGARDING THE TREE ORDINANCE The Planning Commission has tentatively reached a decision that the City should not enact an ordinance which requires tree preservation but rather should enact an ordinance which protects trees during the construction process. The intent being that all trees would be protected and that private property owners owning land in all classifications of land use would later have the option of removing trees at their own discretion. The Planning Commission hereby requests that the City Council give direction regarding the following policy questions: 1. Is it the Council's intent to require the preservation of specimen trees on private property including single-family homes or just protect trees during the construction process? 2. What is the definition of a specimen tree? Is it all trees over a certain trunk diameter or are they selected trees that have a community impact? 3. Does the City Council feel that the City has an obligation to participate in the maintenance of trees designated for preserva- tion? The Planning Commission requests that the City Council provide direction involving the above listed questions prior to the Planning Commission meeting of June 28, 1976 in order to permit the Planning Commission to conclude its hearings involving the Tree Ordinance.
