FURTHER FINDINGS:
WHEREAS, the applicant has had a similar use of this property
for many years, antedating similar uses permitted on two
other corners of this intersection, and
WHEREAS, a critical corner would be vastly improved .as to
amenities and visibility, and
WHEREAS, the proposal would replace an existing but less
desirable use, and
WHEREAS, no sound alternative use has been shown to be feasible
during these hearings, and
WHEREAS, the City Staff has reported favorably on this
application because of advantages accruing to the City
CONDITIONS :
® 1-12. Municipal improvements and dedications are required,
as stated in attached Exhibit "B" .
13. Improvements shall be made to the satisfaction of the
City Engineer.
14. Additional improvements shall be made in front of the
restaurant parcel north of the service station.
15. Building Drawings shall accompany the application to
the H-Control Committee, as well as previous concept
shown at the First Hearing.
16. Landscaping shall be made according to the importance
of the corner.
PASSED AND ADOPTED this 23rd day of November, . 1964, at a regular
meeting of the Planning Commission of the City of Cupertino, State of
California, by the following roll call vote :
AYES: Commissioners Frolich, Johnson, Traeumer, Thomson
NOES: Commissioners Gates, Hirshon

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
GRANTING A USE PERMIT.
WHEREAS, the Planning Commission of the City of Cupertino
received an application for a USE PERMIT, as stated on page two; and
WHEREAS, the applicant has met the burdern of proof required
to support his said application; and
WHEREAS, the Planning Commission finds that the application
meets the following requirements :
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property,
c . Provides for adequate open spaces for light and air,
d. Permits adequate control of fires,
e . Promotes the health, safety and public welfare,
f. Provides for the orderly development of the City, and
g. Is advantageous to the property and improvements in the
zoning district and neighborhood in which the property is
located;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and
other evidence submitted in this matter, the application for the USE
PERMIT be, and the same is hereby granted, subject to the conditions
stated on page two; and
BE IT FURTHER RESOLVED:
That the aforementioned findings be approved and adopted, and
that the Secretary be, and is hereby directed to notify the parties
affected by this decision.
