Lou Tersini, Mason Enterprises Vice-Chairman Gates presided over this work session. The main ob- jective of this session was to discuss various points of the Interim Cluster Ordinance with the City Attorney. The next regular Planning Commission meeting will be November 23rd. The next work session, when the final draft will be presented, is schedIed for Monday, November 30th, at 8:00 P.M. , at City Hall. Comm. Traeumer explained that the term "C .C . & H. is " referred to "Covenants, Conditions and Restrictions . ® Following are the modifications to be made to Draft G, as a result of this meeting : G 15, Item 36, DEVELOPMENT PLAN, the second paragraph shall read as follows : "The information required to be shown on or attached to the Development Plan shall, unless waived or deferred by the Planning Commission on motion adopted, in addition to the information, . . , ® . . . . " G 15, (d) shall read as follows : "Appropriate restrictive covenants, documents providing for the maintenance of common open spaces , any dedications or reservations of public sites , and any dedications of development rights . " G 17, Item 37 COVENANTS FOR COMMON AREA. Para . 2 shall read, "The Common Area shall be either, with the consent of the Planning Commission: (a) Offered for dedication to the City; provided the Planning Com- mission agrees to accept the dedication. (b) Deeded to an association of the homeowners for whose benefit the Common Area is set aside ; development rights, as defined in Para . 16, shall in this case be dedicated to the City. (c ) This is all right as it is presently written. ® (d) Developed and maintained pursuant to an approved plan of a State Agency, a Federal Agency, or an approved lending institution. 411 G 13, last paragraph shall read as follows : "The Development Plan shall be incorporated in and made an appendix to the Resolution granting a rezoning to any Cluster Zone , and conformance to the Development Plan shall be a condition to the rezoning . G '21, first line , first paragraph. The word "substantial," shall be. changed to.. ."mater.ial " There followed a discussion of the possibilities to implement and enforce Covenants for Common Area. Discussion will continue during the next work session at City Hall, Monday, November 30, 1964, 8:0O . P,M, It is hoped that remaining problems can beyresolved during this meeting, the text be finalized, and the Ordinance placed on the agenda for the regular meeting, December 14, 1964.
