MINUTES OF THE 21st WORK SESSION ON THE INTERIM CLUSTER ORDINANCE

Vice-Chairman Gates presided over this meeting. The main objective of
this work session was to review the second draft of the Cluster
Ordinance , dated October 30, 196)4.
The City Planner recommended the City Attorney be invited to attend
the work session on November 12th. Chairman Gates said : this would be
put in the form of a motion at the• Regular Planning Commission meeting
on November 9th. The City Planner was instructed to go ahead and
have the final draft typed before the November 12th work session.
Following are changes to be made in the second draft :
® Page F 1, last two lines : Delete the following : "provisions in this
Ordinance may not be. construed to be a vested right. " . ' -
Page F 3, Semi-attached buildings : Line 2. Chairman Gates and Comm.
Frolichquestioned the term "accessory building, " The City Planner
was of the opinion that a detached garage is an accessory building.
Chairman Gates asked for examples to clarify this term, such as
garages, breezeways, etc
Page F 4, second paragraph. The City Attorney has advised deletion of
this paragraph.
Page F LE, Para . 18 OPEN SPACE, line LE, between the words "of " and
"abutting ", add the following words : "the development and the . . . "
Para . 18. At the' end of sub-paragraph 2, add : (Ref. para . 37)
F 5, first line . Betwee:n the words "number " and "and " add the
following : "as determined by Ordinance and/or Planning Commis-
sion decision. "
F 5, Para . 20:" The City Attorney has recommended some rewording here .
F 5, Para . 21 shall read as follows : "Walls containing main window
exposures shall insure adequate light and air and shall be so
arranged. . . . . "

F 6, Para.. 22, line 2 . Between the words "acres, " and "of ", add the
following : "and R24C and R3C shall comprise at least 7 acres . "
Para 22, line 5 , between the words "a " and "Cluster, " add the follow-
ing : "equal or higher density, "
F 6, Para . 23 DENSITY. Comm,: Frolich feels this needs clarification.
It was decided Para 23 would be split and, a second paragraph would
be labelled MODIFICATIONS, which would read something like the follow-
in.g : "The previous sub-paragraph notwithstanding, the Planning
Commission may require a reduction An density where terrain or other 411
factors make this advisable; an.d may also, subject to approval 'b r the
City Council in each separate case , .'allow an increase in density under
one or more of the following conditions : "
F 6, last line should read as follows : "c ) In order to encourage an
outstanding level of quality in the design of a particular development
area, or an ingenious solution to development of a problem area;
involving development costs above those in a comparable non-cluster
zone , and when these costs cannot, in the judgment of the Planning
Commission, be retrieved by high sales or rent prices per unit. The
burden of proof thereof shall rest on the applicant .
F 7, second paragraph. This belongs' with Para. 23 .1 and in place of
Increase in density " at the beginning of the paragraph, it should say
"Modifications allowed for reasons . ... . . "
F 9, Para 25, LOT, AREA. At the end of the first paragraph, reference
to Sec . 35 should be added .
• F 9, Para . 26, LOT WIDTH. The' City Planner felt something like :
"After a certain distance, have certain breaks , " should be added .
Another approach was as follows : "The average lot width on any strip III
or chain of lots must be at least 50 ' . " Reference to Sec . 35 should
be added at the end of this paragraph.
F 9, Para . 27 COVERAGE shall be deleted entirely„ '
F 10, the last sub-paragraph of Para . 28 FRONT YARD is to be deleted
from this interim ordinance and, instead, there should be reference to
the "Modification paragraph" (23 . 1) . Also add reference to Para. 35 .
F 10, Para 29 SIDE YARD AND BACK YARD , Add reference to Para. 35 .
F 11, Para . 30 HEIGHT, second sub-para. shall read as follows :
"The Planning Commission, subject to City Council approval, may allow
higher. . .. . .
F 11, same para . next to the last line : "Use Permit " shall be
changed to read "Variance . "
F 11, Para . .31 WIDTH OF .BUILDING. The -following shall be added at the
end of the para . : "in width at the setback line . "
F 11 , Para 32 DISTANCE BETWEEN DETACHED BUILDINGS, 4th line of second 410
sub-•paragraph: Delete all after the words : "less than l4 ' "
F 11, last para . The City Planner was asked to redo this para, which
continues of F 12. Suggested wording ab top of F12 : "Where two
buildings are adjoining, the 'u les sba.11, - , "

F 14, At the end of Para . 35 TRANSITION TO ADJOINING ZONES, add refer-
ence to Para . 25 & 26. Note : Chairman Gates and Comm. Frolich
complimented the City Planner on Para . 35 !
F 15, Para . 36 DEVELOPMENT PLAN, (d) Add the following : "It must
be approved by the Planning Commission on the basis of a written
report from the City Attorney prior to issuance of the Building Permit . "
F 16, Add (h) A map showing street systems , public and private , with
111 cross sections shown for any private street which is proposed to be
constructed to less than City standards
F 17, Para . 37 COVENANTS FOR COMMON AREA. This is to be reviewed at
the next work session when the City Attorney is present .
F 19, Para 38 STREETS, second line . The word "differentiated " was
challenged; a synonym should be used here . Third lino , between the
words "and " and "through" shall be added : "major streets with through
traffic . "
F 19, third sub-para . , last 2 lines shall read : "traffic that would
otherwise have passed through the development area if a conventional
grid system had been employed. "
F 19, b) , last 2 lines shall read : "space provided for automobiles in
excess of amount required in correspondin.g non-cluster zones . "
F 20, Para 39 CONDITIONS. Delete whole second sub-paragraph and put
in Para . 23. 1 (Modifications ) in its place .
F 22, Para . 41,2 UNDERGROUND PUBLIC UTILITIES, the last two lines shall
read as follows : "at ground level in locations approved by the Arch..-
® tectural and Site Control Committee , in enclosures approved by the City
Staff.
F 22 , Para 42 INSPECTION OF PROGRESS AND COMPLIANCE WITH APPROVED PLAN,
Add the following at the end of the para.. : "at least annually by the
City Planner. "
F 23, Para 44, APPLICATION OF PREVIOUS ORDINANCES, last word in line 3
"matters " shall be changed to read "requirements , "
