4 SIXTEENTH WORK SESSION ON THE PROPOSED ZONING ORDINANCE
BY THE PLANNING COMMISSION, AUGUST 13, 1964

I Mr. Leonard has offered the Planning Commissioners a tour of
the road pattern of Vallco Park. Those interested are to go
to Leonard 's Fruit Plant, 19160 Homestead Road on Saturday,
August 22nd, at 9:00 A.Me The tour will take about one hour
and 45 minutes .
II Chairman Thomson had nothing to report from the last City
Council meeting,"
III. The proposed interchange at McClellan will come before the
City Council on Monday, August 24th.
The Planning Commission's proposal to include water and
lighting within the median strip when Stevens Creek Blvd
is improved will also come before the City Council at
the next City Council meeting.
IV Chairman Thdmson announced that at this work session the
Commissioners should put aside the Wilsey, Ham & Blair
PROPOSED ZONING ORDINANCE and study the City Planner 's
proposal. Then, if the Planning Commission is too conservative
or if they feel this is too radical, they must get busy and
finish up the Wilsey, Ham and Blair proposal.
41/ The City Planner distributed copies of his proposal to the
Commissioners.
There was a half-hour recess in order to let the Commissioners
briefly read the City Planner 's report, or at least the
generalized parts of it, so they could evaluate and discuss
his approach.

• Comm. 'Frolich suggested that maybe the County Lease Law
should be incorporated into the new Ordinance.
Comm. Gates said he likes the framework within which the City
Planner 's proposal is enclosed. The functional treatment of
the Commercial zone is the only way to treat it, as well as
the manufacturing and residential zones. He felt it was a
good, creative treatment. He thought it contained not so
much laws as the spirit of laws, . 111
Comm. Frolich thought this arrangement was a lot more amenable
to changes as time goes on.
Chairman Thomson wondered whether or not this approach would
be as helpful to the citizens, recognizing that it is much
easier for the Planning Commissioners,
Chairman Thomson asked the Commissioners if they saw any
practical advantages other than that it is easier to read.
Comm. Gates felt it was much more easily interpreted.
The City Planner pointed out that the difference between ar-
rangement by functions . and arrangement by zones does not have
to be Controversial. It is just a matter of retyping to
transform the Ordinance from one arrangement to the other:
Actually, both editions .should be available.
Chairman Thomson asked how we would get a :better .ordinance
out of this.
Comm. Gates pointed out that the Wilsey, Ham & Blair
commercial ordinance was inadequate . '
Comm. .Frolich .said he .liked the. philosophy, of, the .City Planner 's
approach. He added,. however, that..the. Wilpey.., Ham: Blair
numbering setup was very handy.
Comm. Small felt the. CityPlanner
proposal . of'fered a
simpler, more readily..usable • Ordinance.
Comm. Gates pointed out that the socialization of the laws is
taken care of here. •
Comm. Small f_ elt, this was a "permiss.ive law" rather. than a'
"prohibitive law. ".

Comm. Traeumer said that, from a d:eveLoper 's standpoint, it
will have .to be collated... •
Chairman Thomson then asked for Mr. .Leonard 's, opinion.
Mr. Leonard said he was delighted with. th.e City. Planner 's 410

time and testing behind. it . •

• .Mr, Leonard said he checked. past. issues and situations against
. the new approach and also against the County -Ordinances. He
said he differs with the City Planner on some of the .specifics
but the approach is good!

Mr. Leonard suggested the Planning Commission might want to sal-
vage the Wilsey, Ham & Blair job in order to save public opinion.
It will be an editing job---reinforcing the good points and
cleaning up the mistakes.
Mr. Leonard felt the best solution for the City would be to fight
it out so that we get a master plan and a zoning ordinance which
has technically been worked on®. This would benefit the City
411 more than to throw out the Wilsey, Ham & Blair proposal.
Chairman Thomson said that if this becomes known as the Planning
Commission's or the City Planner 's material it would not look
as good as to have the name of an established firm on it.
Comm. Frolich pointed out that the $27,000 paid Wilsey, Ham &
Blair for the Master Plan is still good; it is just the Ordinance
that needs to be reworked.
Mr. Leonard repeated that it might be best to let Wilsey, Ham &
Blair save face and keep their cover.
It was pointed out that, im making their recommendations , the
Commissioners would be making use of the City Planner 's material
for changes, modifications , etc . A double index was suggested.
The City Planner pointed out that his revised Proposed Zoning
Ordinance by no means had discarded Wilsey, Ham & Blair 's pro-
posal. He had made extensive use of that material and realized
its worth. Still, he felt that it should not be adopted by
Cupertino unrevised.
The Chairman will send a communication to the City Council saying
that the Commission is asking the Staff for some review and
interim recommendations on the Wilsey, Ham & Blair Zoning Ordi-
nances in conjunction with their regular studies.
It was generally felt that simplicity, clarity and conciseness
are an asset to a Zoning Ordinance.
V The Planning Commissioners are to go through the City Planner 's
report before next Thursday and turn in their copy of his pro-
posal along with corrections , deletions, and/or additions to the
City Planner 's office . There will be no work session on Aug. 20.
