PLANNING COMMISSION RESOLUTION NO. 215
RESOLUTION OF THE PLANNING COMMISSION OF TES CITY OF CUPERTINO DENYING
THE GRANTING OF -A ZONE CHANGE FROM M-1:B-)4-H ZONE TO AN R-24-H ZONE.
WHEREAS, the attached application has beea submitted to the City
of Cupertino requesting a: change of zone in the zoning regulations of
the City from an M-1:B-4-H District to an R-24-H District; and
WHEREAS, the Planning Commission has held at least one .public hear-
ing in regard to the application on the date as noted on said applica-
tion; and
WHEREAS, the Planning Commission has duly considered and heard all
evidence submitted in regard to said application; , and
WHEREAS, the necessary public notices have been, given as required
by the zoning ordinance of the City of Cupertino, and
WHEREAS, it has become apparent during the Public Hearings on
application 112-Z-63 that the proximity of this property to the
Stevens. Creek Road-Stevens Creek Freeway intersection will create
overcrowded and consequently unsafe conditions on the single real-
, dential street that provides the only ingress and egress to the
property under discussion; and
WHEREAS, the present zoning of this property is M-1:B-4-H, and
WHEREAS; the transportation system of a community are vital to its
growth and economic well being; and
WHEREAS, the existing S.P. right-of-way appears permanent in all
respects; and
WHEREAS, in general, those industries that utilize railroad facili-
ties are of a low employee density; and
WHEREAS, such a low density use of the property is consistent with
the traffic problems inherent in the area,
NOW, THEREFORE, BE IT RESOLVED:
1. That the Planning Commission finds that the proposed zone
change does not:
(a Encourage the most appropriate use of land,
(b Conserve and stabilize the value of property,
(c) Provide for adequate open spaces for light and air,

to the City Council in the matter of granting said zone change
