Reso 104 File No. 52-Z-62 - Zone Change PLANNING COMMISSION RESOLUTION NO. 104 411 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND- ING GRANTING A ZONE CHANGE FROM AN A-2:B-2 ZONE TO AN R-24-H ZONE. WHEREAS, the attached application has been submitted to the City of Cupertino requesting a change of zone in the zoning regulations of the i City from an A-2:B-2 District to an R-3-H District; aa(amended to R-24-H); and WHEREAS, the Planning Commission has held at least one public hear- ing in regard to the application on the date as noted on said applica- 1 tion; and WHEREAS, the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS, the necessary public notices have been given as required by the zoning ordinance of the City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission finds that the proposed zone change: (a Encourages the most appropriate use of land, (b Conserves and stabilizes the value of property, 411 (c Provides for adequate open spaces for light and air, (d) Permits adequate control of fires, (e) Promotes the health, safety and public welfare, (f) Provides for the orderly development of the City, (g) Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located. 2. That said Planning Commission, therefore, reports favorably to the City Council in the matter of granting said zone change. Said ap- proval to be subject to the following conditions: Exhibit B, items 1-12. 13. That the Council be aware of the possible tax-exempt status of this property and make whatever efforts they deem advisable to insure this property remain subject to appropriate property taxation consistent with legal counsel advice .
