Reso 094 File No. 48-Z-61 Zone Change PLANNING COMMISSION RESOLUTION NO. 94 411 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND- ING GRANTING A ZONE CHANGE FROM AN R=1 ZONE TO AN R-3-H ZONE. WHEREAS, the attached application has been submitted to the City of Cupertino requesting a change .of zone in the zoning regulations of the City from an R-1 District to an R-3-H District; and WHEREAS, the Planning Commission has held at least one public hear- ing in regard to the application on the date as noted on said applica- tion; and WHEREAS, the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS, the necessary public notices have been given as required by the zoning ordinance of the City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission finds that the proposed zone change: a) Encourages the most appropriate use of land, b) Conserves and stabilizes the value of property, c) Provides for adequate open spaces for light and air, (d) Permits adequate control of fires, (e) Promotes the health, safety and public welfare, f Provides for the orderly development of the City, (g) Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located. 2. That said Planning Commission, therefore, reports favorably to . the City Council in the matter of granting said zone change. Said . ap- proval to be subject to the following conditions: 1-12 - Exhibit "B" attached. 13-15 - Exhibit "A." attached.. PASSED AND ADOPTED, this 12th day of March , �96 2 , at a regular meeting of the Planning Commission of the City of Cupertino by the following roll call vote: AYES: Commissioner&: AdamoF Fitzgerald, Frolich, Leonard, Rampy, Small NAYS: Commissioners None ABSENT: Commissioners: Snyder 411 /s/ E. Adoption of an ordinance along the lines suggested, (See page 2, minutes of March 12) , before final passage of the rezoning. 14 . Signing of agreements satisfactory to the City Attorney, City Engineer, City Manager, the Cupertino Sanitary District with respect to sewer outfall lines under the proposed Junipero Serra Freeway lying just northward and downhill of the subject property. 15. Filing with the City a completely identified docket of maps, sketches, and descriptive statements sufficient to establish clearly the intent and purpose of the applicant on ;his development with respect to density, recreational facilities, quality of design and construction, and Ik observance of the amenities .
