Reso 074 - PLANNING COMMISSION RESOLUT SON NO. 74 A RESOLUTION OF THE PLANNING COM :ISSION Or TEE CITY OF CUPERTINO ® APPROVING PROPOSED SUBDIVISION ORDINANCE NO, I7 (REVISED) SUB- JECT TO CERTAIN CONDITIONS AS SET FORTH HEREIN. WHEREAS, the proposed Subdivision Ordinanc copy of which is annexed hereto and made part hereof, has been duly considered by the Planning Commission after duly noticed public hearings, and WHEREAS, the proposed ordinance is found to be in compliance with the law and will promote the general welfare of the City; NOW, THEREFORE, BE IT RESOLVED: . That the Planning Commission of, the City of .Cupertino hereby approves the aforesaid proposed subdivision ordinance and in conrec•- tion therewith and as a result of public hearings, recommends that the Council consider the following changes and modifications thereto: 1. Page 1, Section 1: 1: Add "Ordinance No. 47 is hereby repealed as of theeffective date of this ordinance." 2. Page 2, Section 2:4: On next to last and last line, insert "road" and delete "or dedication" so that the phrase reads "or any land in which road opening is required. " • 3. Page 4, Section 3: 3 (i) : Add "except Orchard trees, which shall be shown by general area, location, and spacing of rows. " 4. Page 7, Section 4: 2 (e) : Lots containing one- half (1/2) acre or more should require the net acreage shown. This is to agree with County regulations. ' 5. Page 8, Section 4: 2 (h) (7) : Each block in: its - entirety shall be shown on one sheet when pos- sible. It may be impossible to show on one sheet . : . 6. Page 11, Section 5: 3 (b) : Reduce length of tangents from seventy-five (75) feet to fifty (50) feet. Tangents of fifty (50) feet should be ample -- such as one-half street of thirty (30) feet plus back of re tu.rI .of twenty (20) V feet. • :. 7. Page 13, Section 7: 1: Insevz in second paragraph . after the next too last sentence, "provided the average of all lots exceeds the required minimum" . 8. Page 13, Section 7: 5: Add "based upon agreement between developer and owner of such areas. If developer is unable to reach such agreement, he shall so state in writing to advisory agency" . -1- Vi 9,. Page 16, add the following section:. Section .13:5: Off-tract Storm Drainage. Fees: The subdivider •shall pay, as a condition .of approval of a final subdivision map, off-tract storm drainage fees in accordance with the MASTER STORM DRAINAG l PLAN AND COST STUDY of the City of Cupertino, ' dated March 27, 1961 which is incor- porated as part of this ordinance and made a part hereof. The fees so received shall be deposited in a "special storm drainage fund" as provided in Ordinance No. 50 of the City to be ';,sed for the construction of storm drainage facilities in the local drainage area or to reimburse the general fund of the City for monies advanced within the local drainage area. Ordinance No, 50 and Resolu- tion No, 466 are hereby repealed as of the effe,3 410 — tive date of this ordinance insofar as they are inconszstant with the provisions of this ordinance . Martin Secretary i Addendum to Planning Commission Resolution - ® Subdivision Ordinance Paragraph 8 of Planning Resolution No. 74 is hereby deleted and in its place is added the following to Section 7: 5 of the Subdivision Ordinance: . . provided the two acres or less are lands re- tained by the seller of the subdivision area. In all other cases, the developer and the owner of the parcel shall enter into an agreement to effect the same. If the developer is unable to obtain such an agreement, he shall so state in writing to the advisory agency.
