WRITTEN COMMUNICATIONS A letter from Mr. Hoffman, Any Mountain, Ltd, pertaining to Item #2 of the Agenda was called to the attention of the Commissioners (a copy of letter included in each packet). ORAL COMMUNICATIONS PUBLIC HEARINGS ITEM 11, Application 24-Z-77 of CITY OF CUPERTINO(TOWN CENT R): REZONING approximately 50 gross acres from P (Planned De- velopment) to P (Planned Development with residential, com- mercial and office use intent) zone or whatever zone may be deemed appropriate by the Planning Commissio~ and ENVIRON- MENTAL REVIEW: The Environmental Review Committee recommen s the granting of a Negative Declaration. Said property is located on the southeast corner of Stevens Creek Boulevard and De Anza Boulevard. First Hearing continued. Tentative City Council hearing date - December 3, 1979. Planning Director Sisk briefly reviewed the ten years of work on Town Center, the concentrated efforts of the last two years, and the directive and instructions of the meet in of September 27, 1979 (PC-3l8). Although the original intent for the 200,000-250,000 sq. ft limit on commercial space in the Center seemed to be thwart d by the wording of the proposal permitting more than 250,000 sq. ft., (the impact of traffic being critical with 50,000 PC-321 Page 2 MINUTES NOVEMBER 13, 1979 REGULAR PLANNING COMMISSION MEETING sq. ft. of commercial added), Associate Planner Piasecki explained the system assigning trips on a sq. ft. basis. It was determined the owners could receive an allotment themselves or use the allocation for consideration to the other developers. Total commercial, office, and/or residential would be on an allocation basis proportionate to land area. The market place determining use, the first developer in for a specific use would acquire the rights to the specific type of development. Agreement was reached that on quasi-public use the credits would be distributed to the owner of the property used for quasi-public use. Mr. G. D. Gibson, developer, of Koll Company, Palo Alto, and Mr. Tom O'Donnell, atto·rney for Cali interests, congratulated the City and Staff on the hard work that was culminating in approval. Mr. Gibson ~rr~~ed to provide an overall plan for the area if the Commissioners were interested. Mr. O'Donnell, said he felt there would not be objection from the Cali Family if that is what the City wished to authorize. It was sug- gested, by both Mr. Gibson and Mr. O'Donnell, that fur- - ther definition of some of the terminology be refined to better understand what was requited. Mr. Edward Cali outlined the control of the Cali Family property between the R. Cali and Joseph Cali interests (a 50-50 cooperative control) and felt that cooperation and cohesion was possible in knowing which way to move under the direction being provided by the Commissioners, City Council and City Staff. On the property east of Torre, change wording to "public or quasi- public use..." Make change on Exhibit. H2 through #6 and Exhibit A-C~l modified to change area east of Torre to public (from commercial, public or private office) to residential, public or quasi-public. Com. MINUTES NOVEMBER 13, 1979 REGULAR PLANNING COMMISSION MEET NG PC-321 Page 3 ITEM '2, Application 19-U-76 of ANY MOUNTAIN, LTD.: PUBLIC HEARING to review the onsite parking situation at th~ ex- isting Any Mountain facility and ENVIRONMENTAL REVIEW: The project is categorically exempt, hence no action is require Said property is located on the southwest corner of Mariani Avenue and North De Anza Boulevard in a P (Planned Devel- opment with industrial, commercial and residential intent) zoning district. First hearing. Tentative City Council hearing date - November 19, 1979. Associate Planner Piasecki distributed additional infor- mation, called attention to a letter from Any Mountain pur- porting to represent a parking agreement for Four-Phase parking lot use, and briefly reviewed the exascerbating parking situation in the residential areas (See PC-320, October" 22, 1979). The City Council recommendation of a wall being con- structed to prevent access to Greenleaf and bus routes was discussed. It was agreed to recommend pedestrian pas- sageway through the wall. Assistant City Engineer Whitten advised that extension of Bandley would relieve some con- gestion and permit agreements between other parking lot owners and Any Mountain, Ltd. The Commissioners, having gone through the problems of Any Mountain, Ltd. on many occasions, felt a delay to pro- vide time for Councilman Dan O'Keefe to negotiate with Four-Phase should be provided. MOTION: Com. Adams, to continue public hearing 19-U-78 to November 26, 1979 Agenda, or until such time as documentation of parking agreement could be re- viewed and substantiated by Staff Review for presentation to the Planning Commission. Second: Commissioner Koenitzer PASSED: UNANIMOUSLY 5-0 ITEM #3, CITY OF CUPERTINO: PUBLIC HEARING to clarify land use policies contained within the Old Monta Vista General Plan, particularly with respect to the practice of per- mitting on-street parking to satisfy off-street parking needs and ENVIRONMENTAL REVIEW: The project was previously Assessed, hence no action is required. First Hearing con- tinued. Tentative City Council hearing date - December 3, 1979. ITEM #4, APPLICATIONS 20-Z-79 and 24-U-79 of ALLEN DEGRANGE: REZONING approximately .3 of a gross acre from ML (Light Industrial) to P (Planned Development with commercial and industrial intent) zone or whatever zone may be deemed appropriate by the Planning Commission; USE PERMIT to con- struct a 6,000 sq. ft. commercial and industrial building and ENVIRONMENTAL REVIEW: The Environmental Review Committee recommends the granting of a Negstive Declaration. Said property is located on the east side of Imperial Avenue approximately 120 ft. southerly of Stevens Creek Boulevard. First Hearing continued. Tentative City Council hearing date - December 3, 1979. The Staff Report of November 9, 1979 on the continued hearings on the Old Monta Vista General Plan was reviewed, and the Application of Mr. Allen DeGrange (Item #4) explained. Members of the public expressed interest in various seg- ments of the Monta Vista Plans; but, generally, it was felt that the outlook for the area was forward going. The Commissioners discussed the intensity of development in the area, the probability of owners getting together for de- velopment, the number of curb cuts anticipated and control of such cuts, (the latter through parking allocations and de- vices), width of right of way, turn around problems, a parking district for construction and maintenance. Mode of parking was discussed in depth. Mr. Allen DeGrange, Applicant for Item #4 advised that on Applications 20-Z-79 and 24-U-79, he would stipulate that he'd go along with whatever arrangement or allocation was imposed by the Planning Commission. Allocations of credit for all off- street parking was considered in the light of tolerating intensity to generate business in Old Monta Vista. Of the three plans available (exhibited as the Staff Report recòmmendations for the October 22, 1979 Planning Commissio Meeting (PC-320), and determinations on Item #3 led to the following motion. MOTION: Commissioner Blaine, to recommend approval, on Resolution (as per Staff Report) and that pavement cross section have normal setbsck with surplus space in sidewalk. Second: Commissioner C1audy VOTE: AYES: Commissioners C1audy, Adams, Blaine, Gatto. NO: Commissioner Koenitzer 4-1 PUBLIC HEARING CLOSED: Motion: Commissioner Blaine Second: Commissioner Claudy PASSED: UNANIMOUSLY 5-0 Two problems on Item #4 were discussed --the outside storag area and the commercial Store-Front issue. Failure of bus- inesses to move into Monta Vista was noted and it was felt the site backing to a railroad siding certainly satisfied conditions for commercial or wholesale business. MOTION: Commissioner C1audy, recommending granting of a Negative Declaration of Environmental Impact. Second: Commissioner Blaine VOTE: PASSED: UNANIMOUSLJ 5-0 MOTION: Commissioner Blaine approval 20-Z-79, subject to Standard Conditions #1 through #14; #15 as stated in the Staff Report; #16 to state the finding of the Planning Commission that the operation of a plumbing wholesale supply house is a commercial activity.
