(27 • 410 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND- ING GRANTING A ZONE CHANGE FROM AN A-2:B-4 ZONE TO AN R-1,- R-2-HZONE. R-3-H 8c . d-1 H WHEREAS, the attached application has been submitted to the City of Cupertino requesting a change of zone in the zoning regulations of the City from an A-2: B74 District to an R-1, R-2-H District; and H-,$-H & C-1-H WHEREAS, the Planning Commission has held at least one public hear- ing in regard to the application on the date as noted on said applica- tion; and WHEREAS, the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS, the necessary public notices have been given as required by the zoning ordinance of the City of Cupertino. NOW, TIIEREFORE, BE IT RESOLVED: 1. That the Planning Commission finds that the proposed zone change: • a) Encourages the most appropriate use of land, b) Conserves and stabilizes the value of property, c) Provides for adequate open spaces for light and air, ® (d Permits adequate control of fires, (e Promotes the health, safety and public welfare, r , Provides for the orderly development of the City, Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located. 2. That said Planning Commission, therefore, reports favorably to the City Council in the matter of granting said zone change. (14) Consultation with the Sanitary District to assure that the present or future sewer lines lie in present or proposed public streets insofar as possible. With the understanding of a 90' street on Mountain View- Stevens Creek Road. 411 EXHIBIT B 1. Install ornamental street lights. All lighting shall be de- signed to in no way interefer with adjacent residential district. 2. Street trees will be planted in the public right-of-way and shall be of a type approved by the City in places designated by the City. 3. Traffic control signs will be placed at locations' to be specified by the City. • 4. Fire hydrants shall be located as requested by the City, 5, A masonry wall six feet figh will be built separating the commercial area from the residential area. 6. All parking areas and driveways will be paved as shown on. the plot plan. 7. Curbs, gutters, sidewalks, and structures shall be installed to grades and be constructed in accordance with standards specified by the City. Engineer. • • 8. Drainage within and without the development shall be to the satis- faction of the City Engineer. i9. Street improvements abutting the applicant ' s property shall be according to City standards and specifications. 10. The applicant shall be responsible for completing site as shown on approved plot plan, and shall be required to pay for required engineering, checking, and inspection fees prior to issuance of building permit. 11. Landscaping shall be as approved and maintained as shown on plot plan. 12. Street widening and dedications shall be in accordance with street widths approved by City Engineer.
