® PLANNING COMMISSION RESOLUTION NO. 67
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO DENYING
THE GRANTING OF A ZONE CHANGE FROM C-1-H ZONE TO AN M=1-H ZONE:
WHEREAS, the attached application has been submitted to the City
of Cupertino requesting a change of zone in the zoning regulations of
the City from an C-1-H District to an M-1—H District; and
WHEREAS, the Planning Commission has held at least one public hear-
ing in regard to the application on the date as noted on said application;
and
WHEREAS, the Planning Commission has duly considered and heard all
evidence submitted in regard to said application; and
WHEREAS, the necessary public notices have been given as required
by the zoning ordinance of the City of Cupertino.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Planning Commission finds that the proposed zone change
does not:
® a) Encourage the most appropriate use of land,
b) Conserve and stabilize the value of property,
c) Provide for adequate open spaces for light and air,
d) Permit adequate control of fires,
e) Promote the health, safety and public welfare,
�f Provide for the orderly development of the City,
g Be advantageous to the property and improvements in the zon-
ing district and neighborhood _ in which the property is located.
2. That said Planning Commission, therefore, reports unfavorably
to the City Council in the matter of granting said zone change.
PASSED AND ADOPTED, this 28th day of August , �9 61 , at a
regular meeting of the Planning Commission of the City of' Cupertino by
the following roll call vote:
AYES: Commissioners: Adamo, Leonard., Rampy, Snyder and Small
NOES: Commissioners: None
ABSENT: Commissioners: Bagar .and Frolich.

Moved. by Commissioner Leonard that:
WHEREAS, applicant proposes use of an existing
R-1 dwelling and outbuildings for a mixed commercial
and light industrial use; and
WHEREAS, the proposal would seem to be- a less than
optimum development near the presumed center of town,
thus tending to retard better development by others;
NOW, THEREFORE, BE IT RESOLVED that the- Commission
recommend denial.
