Reso 056 FILE NO. 31 • PLANNING RESOLUTION NO. 56 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND- ING GRANTING A ZONE CHANGE FROM R-1:B-2 AND A-2:B-4 ZONES TO C-1-H AND AR ZONES. WHEREAS, the attached application has been submitted to the City of Cupertino requesting a change of zone in the zoning regulations of the City from an R-1:B-2 and A-2:8-4 District to a C-1-H and AR District, and WHEREAS, the Planning Commission has held at least one public hear- ; ing in regard to the application on the date as noted on said application, and WHEREAS, the Planning Commission has duly considered and heard all evidence submitted in regard to said application, and WHEREAS, the necessary public notices have been given as required by the zoning ordinance of the City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission finds that the proposed zone change: • a Encourages the most appropriate use of land, b Conserves and stabilizes the value of property, c Provides for adequate open spaces for light and air, d Permits adequate control of fires, e Promotes the health, safety and public welfare, f Provides for the orderly development of the City, g Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located. 2. That said Planning Commission, therefore, reports favorably to the City Council in the matter of granting said zone change. Said approval to be subject to the following conditions: (1) The standard conditions outlined in Exhibit B. (Whole property) . (2) Submission of plans to the H Control Committee before issuance of any building permits. (AR zone) (3) Review by the City Council of uses intended to be developed before applicant lets any contracts or receives any permits. (AR zone) (4) Acceptance by the Building Inspector of all revisions in the remodelled tavern building. (Lots 74, 77, 78, 79) (5) Presentation to the City of signed agreements 110 acceptable to the Council and the City Attorney providing for the realigned McClellan route. (Lots 74, 77, 78, 79) . 1 -1- (6) 3ubmission of plans to the H Control Committee and approval by them prior to issuance of any building permits. (Lots 52, 53, 54, 54A) . PASSED AND ADOPTED, this 26th day of June, 1961, at a regular meeting of the Planning Commission of the City of Cupertino by the following roll call vote: AYES: Commissioners: Adamo, Bagar, Fitch, Leonard, Rampy, Snyder and Small NAYS: Commissioners: None ABSENT: Commissioners: None NOTE: Commissioner Fitch voted ''nay" on lots 52, 53, 54, 54A.
