Reso 030 , FIRR NO. 9 - Rezoning PLANNING RESOLUTION NO. 30 411 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING GRANTING A ZONE CHANGE FROM A-2:B-- ZONE TO AN R-3-H ZONE. WHEREAS, the attached application has been submitted to the City of Cupertino requesting a change of zone in the zoning regulations of the City from an A-2:B-4 District to an R-3-H District, and WHEREAS, the Planning Commission has held at least one public hearing in regard to the application on the date as noted on said application, and WHEREAS, the Planning Commission has duly considered and heard all evidence submitted in regard to said, application, and WHEREAS, the necessary public notices have been given- as • required by the zoning ordinance of the City of Cupertino. NOW, THEREFORE, BE IT RESOLVED: 1. -That the Planning Commission finds that the proposed zone change: a Encourages the most appropriate use of land, b Conserves and stablizes the value of property, c Provides for adequate open spaces for light and air, d Permits adequate control of fires, e Promotes the health, safety and public welfare, f Provides for the orderly development of the City, g Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located. 2. That said Planning Commission, therefore, reports favorably to the City Council in the matter of granting said zone change. Said approval to be subject to the following IIIconditions: (see reverse) City of Cupertino RESOLUTION-ZONE CHANGE 1960 -1- I 1. All lands taken or to be taken by the State in connection with their acquisition of a right-of-way for the Junipero Serra Freeway are hereby subtracted from the property description before us. 2. A strip one lot deep next to the Junipero Serra Freeway is to 410 defined by tentative and final map with 25' of additional depth which is to be planted and maintained as a buffer strip intended to shield the residents of the multiples from the effects of freeway traffic. This provision is not to be required if final freeway plans provide for sufficient depression of the freeway to damp-out the noise where the multiples will be located. 3. A strip one lot deep next to the R-1 area is hereby changed to the R-2-H designation. Units built hereon are to be of one story construction reasonably compatible in styling and appearance with the R-1 homes already constructed at the time the R-2-H structures are started. 4. Dedications: (a) Sufficient lands to be dedicated on applicants side to permit the widening of Homestead Road to a 90' right-or-way in g Y front of the multiple; (b) Sufficient lands to be dedicated on appli- cants side to permit widening of Blaney Avenue to a 72' right-of-way in front of the multiple; (c) In addition applicant is to file with the City official letters from the following agencies that they will require nothing further than these street areas for their facilities: City of Cupertino on storm drains or ditches; Cupertino Sanitary Dis- trict on sewer lines; S. C. Valley Flood Control District on pipes or ditches for run-off waters. 5. Improvements: Applicant to follow the regularly established rules of the City in making, paying; for, or bonding for the various improvements including but not limited to: street widening, interior streets, curbs, gutters, sidewalks, street lights, water mains and Ill fire plugs, electroliers and undergroung cable, signalization of im- portant intersections, . . 6. Contributions: Applicant to make the regular contributions on storm drainage for both on-tract and eff-tract facilities: to obtain clearances from the Cupertino Sanitary District for sewer facilities under their regular rules, and the City' s; to pay such fees and make such deposits as are the regular practice of the City in matters like plan checking and all other items. 7. Restrictions: After consideration, the usual restrictions ail- ing for plans before recommendation and a time limit on construction under pain of voided zoning if not completed, are hereby waived. (a) Applicant expressly acknowledges familiarity with Ordinance 144 - Revised, and hereby affirms his statement made at one of the hear- ings that he is agreeable to the terms and conditions in the Ordinance; (b) To insure plans eventually in keeping with applicant' s assurances to the Commission that the multiples " . . will not be junk. ." , all plans are to limit average density to 20 families to the acre; and are to provide living areas of not less than 625' on one-bedroom units, and 800' on two-bedroom units. 110 p PASSED AND ADOPTED, this 21st day of November , 1960 at a regular meeting of the Planning Commission of the City of Cupertino by the following roll call vote: AYES: Commissioners: Adamo, Fi th, Small, Leonard NAYS: Commissioners: None ABSENT: Commissioners: Bagar, Rampy, Snyder /sl Burrel Leonard Chairman of the Planning Commission ATTEST: /s/ Lawrence .
