Reso 003 R. J. Wilson and A, T. Cook RESOLUTION NO. 3 P. C. RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOM- MENDING GRANTING A ZONE CHANGE FROM R-1:B-2 ZONE TO A R-3-H ZONE WHEREAS, the attached application has been submitted to the City of Cupertino for a change of zone in the zoning regulations of the City from an R-1:B-2 District to a R-3-H District, and WHEREAS , the Planning Commission has held at least one public hearing in regard to the application on the date as noted on said application, and WHEREAS, the Planning Commission has duly considered and heard all ev- idence submitted in regard to said application, and WHEREAS , the necessary public notices have been given as required by the Cupertino Municipal Code. NOW, THEREFORE, the Planning Commission of the City of Cupertino ,DOES HEREBY RESOLVE, DETERMINE , AND ORDER AS FOLLOWS : Section 1. The Planning Commission finds that the proposed zone change Does (a) Encourage the most appropriate use of land (b) Conserve and stabilize the value of property 411 (c ) Provide for adequate open spaces for light and air (d) Permit adequate control of fires (e) Promote the health, safety and public welfare (f ) Provide for the orderly development of the City (g ) Be advantageous to the property and improvements in the zoning district and neighborhood in which the property is located. Section 2. The Planning Commission, therefore, reports favorably to the City Council in the matter of granting the said zone change. Martin Secretary of the Planning Commission Exhibit B i 1. Install ornamental street lights. All lighting shall be de- signed to in no way interfere with adjacent residential districts. 2. Street trees will be planted in the public right-of-way and shall be of a type approved by the City in places designated by the City. 3. All parking areas and driveways. will be paved as shown on the plot plan. 7. Curbs , gutters , sidewalks , and structures shall be installed to grades and be constructed in accordance with standards speci- fied by the City Engineer. • 8, Drainage within and without the development shall be to the satisfaction of the City Engineer. 9. Street improvements abutting the applicant ' s property shall be according to City standards and specifications. 10. The applicant shall be responsible for completing site as shown on approved plot plan, and shall be required to pay for required engineering, checking, and inspection fees prior to issuance of building permit. 11. Landscaping shall be as approved and maintained as shown on plot plan. 12. Street widening and dedications shall be in accordance with street widths approved by City Engineer. 1
