In addition, there is a parking deficiency of 6 spaces; perhaps the Applicant can demonstrate that they can sensate for this deficiency. Finally on landscape screening, Staff requests further review by ASAC. Mr. Piasecki stated, in response to Cam. Claudy's question, that there are two lanes of traffic on Stevens Creek Blvd, and benefit would be derived fray a left turn pocket. Applicant's Presentation: Mt. Dave Azzarello, project designer, stated that his client does not view the parking as a problem; patrons of the deli are truckers who are limited to minimal time off for lunch. For this reason, truckers will e park in the adjacent neighborhood; if convenient parking is kervailabl these patrons will look for other food service. The Applicants are willing to eliminate the dining area to relieve on-site parking demand. Due to low intensity use, the Applicant feels that lip proposed parking is adequate. Reducing square footage will make this project economically infeasible. This project lends itself to Planning Staff reoaianendations and the community will benefit fray this project. Com. Claudy commented that this project is clearly an improvement over the present building. He questioned haw the back areas, which has a lot of trash dumped there, would be handled. The Applicant stated that due to requirements for storage space needed for the liquor business, this area would be cleaned up. The Commissioner commented that the location of the trash containers in the southwest corner is unacceptable. In response to Cam. Adams question, Mr. Azzarello stated that the requested square footage was needed to make this project profitable. He stated that there have already been applicants for the proposed office space; this is a desirable project due to its location and the architecture of the building. Chr. Szabo stated that in addition to the above, he is concerned with the rezoning of residential to office use; the City of Cupertino needs residential at the present time. Mr. Azzarello stated that the owners feel that a housing project would not be feasible. Ken Mockler, 22444 Ramona Ct., Cupertino, asked if a standup sign was to be used. Can. Claudy stated that a monument sign will be proposed. Mr. Mockler stated that with the addition of a traffic light at the corner, the noise from traffic and particularly from trucks has greatly increased. In addition, there have been incidents of people fighting and the need for police intervention. He requested that the fences be raised to 8 feet. Chr. Szabo stated that this development cannot be contingent upon raising the height of the walls/fences. Mr. Cowan stated that the city cannot require additional height; this is essentially a private matter between the two property owners. The walls can be raised to 8 feet with permission of the engineering calculations to insure they are structurally sound. owners and with Mr. Steven Sulgit, 22560 Stevens Creek Blvd., Cupertino, stated that the proposed building is an improvement. His only concern is the parking of the trucks in adjacent vacant lots and an neighborhood streets. Mt. • Sulgit stated he is concerned for the safety of his children. Mr. Piasecki stated, in response to (hr. Szabo's question, that a new Use Permit is required if the owners changed the deli to a pizza parlor, per the requirements tints of the CG Zoning Ordinance and Planned Development District. Mr. Albert Bateh, applicant, clarified that the proposed application is for a small deli, serving cold cuts, sandwiches and providing a catering service primarily for the neighborhood. The other spaces are planned for low-intensity tenants. The proposed trash location is convenient; the property has been well maintained in the pest. Can. Mckenzie questioned whether there would be on-sale beer and wine. Mr. Batt& stated that dus to numerous requirements, there were no plans for on-sale beer and wine. Can. Adams questioned whether the feasibility of building a residential unit had been examined by the Applicant. - Mr. Bateh stated that a house at that location would have to sell for $75,000-100,000 for the lot alone to be financially profitable. Chr. Adams moved to close the public hearing. SECOND: Cam. Sorensen VOTE: Passed 5-0 Can. Claudy stated that what is proposed is a vast improvement and will be a benefit to this corner in the long run. The proposed project is attractive and is designed to shield the houses on Camino Vista. The Commissioner, while recognizing that the need for housing exists in the city , stated that the loss of this particular lot will not be significant. The Circulation plan is reasonable and the mixed use for this site is acceptable. The plan is acceptable with the understanding on the part of the Applicants that the back area cannot be used for storage and sorting; the location of the trash should be left to the Planning Staff or ASAC approval. Cam. Claudy supports this project. Cam. Adams concurred that this project is a vast improvement, with the Planning Staff's suggestions an the site plan and parking. Cam. Sorensen is not concerned with the loss of this residential site due to the fact that other residents on Stevens Creek are erecting 8 foot masonry wall to keep the noise out. With regard to the concern that young people congregate in the parking area, this may diminish with the proposed placement of the parking in the £Lui,L. She agrees with the Staff suggestion on parking requirements. Cam. Mackenzie concurs that this project is an improvement. He states that no truck parking and rigid enforcement of this must be done at this site, given the proposed design. In general, parking standards for restaurants aid delis are lax; thus, patrons use adjoining parking areas. He agreed with the suggestion for relocation of trash enclosures and an further Condition stating no on-sale beer and wine. Chr. Szabo stated that despite the upgrading of this business, he will not vote favorably because of the loss of housing and the significant increase of traffic. MVI'Ia : Con. Calls. Ttustree Location: McClellan Square, Northwest corner of DeAnza Boulevard and McClellan Road Parcel Area(Ac) N/A USE FAT To construct and operate a 1500 square foot bakery and cafe. FIRST HEARING ENVIRONMENTAL DETERMINATION: Categorically E empt TENTATIVE CITY COUNCIL HEARING DATE: March 17, 1986 Staff Presentation: Mr. Tsuda stated that this is a Use Permit to construct a bakery and a deli with approximately 25 seats. Under the OG Ordinance speciality food stores, bakeries, donut shops and delis require • a Use Permit. PLANNING COMMISSION MINUTES Regular Meeting of March 10, 1986 PAGE 8 PC-489 110, ITEM 4 (Cont'd) The Planning Staff addressed two main issues: 1) Streetsca,e requirements Der the South DeAnza Conceptual Zoning Plan: A change of use on the site requires the Applicant to make improvements such as street,' curb, street trees and utility lines. However, in past cases, the' Commission has elected to waive these requirements; it was their finding that these requirements are an unreasonable economic burden an the Applicant of a small shop. A Minute Order of a similar finding of unreasonable economic burden is included in the packet. 2) Parking: Two variances have been granted for this Center: in 1972, a reduction from 29 spaces was granted fran the required amount and in 1973, a variance granted a reduction from 21 spaces. Approval of this Use Permit results in a technical deficiency of 34 spaces. The Planning Staff'is not aware of any parking problems at the Center, and a use of this type requires only 1 more space than ordinary CG Use. A Condition has been included providing that should parking cause a problem, the Caamission has the authority to review the Use Permit at that time. Mr. Tusda stated that currently the shop is vacant. The Applicant 110 ' operates bakeries in Sunnyvale and Fremont. The Applicant's Presentation: Mr. Ganjoo stated that this is a French bakery and the main product is croissants and the sandwiches made from them. Also, pastries and cakes are made. Can. Adams asked if, since the Camaission considered waiving the requirements for street improvements, will there be a problem in the future with parking? Mr. Cowan stated that the site will have to stand on its own merits with regard to parking or perhaps as a joint use concept. The Planning Staff has no record of complaints regarding parking adequacy at this Center. Mr. Ron Cali, representing the property owner, stated that a mixed use concept is being considered. In his eleven years of management of this property, he has not encountered parking problems. MVTION: Cam. Claudy moved to close 'the public hearing. SECOND: Can. Adams VOTE: Passed 5-0 Cam. Mackenzie stated that at sane sites a bakery can cause problems and thus the Ordinance was modified so that the Commission can review it; this does not seem to be the case here. Can. Smith, President of the Church Council, stated that they were basically happy with the 6 its listed on page .3, of the Staff Report. He requested that same of them be reviewed and not required of the Church: 5) The turnout for pick-up and drop-off is fine. 2) The elimination of one parking space is also fine. 1) "Squaring off" the outer edges; The reason this was put in was primarily to enable the center area to be slightly larger to accommodate summer activities and secondly to provide an aesthetic change from a plain linear . layout. Mr. Richard H. Carlsen, 7583 Normandy Way, Cupertino, emphasized that the maintenance of landscaped areas of Churches are done by volunteers. Thus the goal was to group landscaped areas for easier maintenance. Secondly, cars parking next to the walkways often extend over the walks and interfere with pedestrians. The area is to be an outdoor site for Church members. Mr. Ray Craver stated that the children use the parking lot as a play ground. He stated that Jollyman Park has insufficient parking and assumes that on occasion the Church may be ,a source of additional parking for Park activities. M71'ICV: Clam. While concerned about visibility of cars backing out of parking spaces, the Commissioner suggested further review of options.
