RESOLUTION No. 3025
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A VARIANCE FROM
CONDITIONS 19B AND 19C OF THE
SOUTH SARATOGA-SUN YVALE CONCEPTUAL ZONING PLAN
SECTION 1: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino has received an
application for a Variance, as described on Page 2 of this Resolution; and
WHEREAS, the necessary notices have been given in accordance with the
Procedural Ordinance of the City of Cupertino, and one or more Public
Hearings have been held by the Planning Commission; and
WHEREAS, the Planning Commission finds that the application satisfies the
following criteria:
1) That there are special conditions or exceptional characteristics in
the nature of the property to be affected, or that its location or
its surroundings are such as will permit the Commission to make a
determination that a literal enforcement of the Ordinance would
111 result in practical difficulties or unnecessary hardships.
2) That the granting of the variance action is necessary for the
preservation and enjoyment of substantial property rights.
3) That the Hearing record demonstrates that the granting of the
variance will not have a material, adverse impact upon the health or
safety of persons residing or working in the neighborhood of the
property. Further, the manner in which the property will be used
subsequent to implementation of the variance action will not be
materially detrimental to the public welfare or injurious to the
value of property or improvements located in the the vicinity of the
property affected by said variance.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence submitted in this matter, the application for variance is
hereby recommended for approval, subject to the conditions which are
enumerated in this Resolution beginning on Page 2 thereof; and

BE IT FURTHER RESOLVED:
That the subconclusions upon which the findings and conditions specified
in this Resolution are based are contained in the Public Hearing record
concerning Application 1-V-87 as set forth in the Minutes of the Planning
Cammission meeting of April 27, 1986 and are incorporated by reference as
though fully set forth herein.

SECTION III: CONDITIONS A NI IISTERED BY THE PLANNING DEPARTMENT
1. APPROVED EXHIBITS
The recommendation of approval is based on Exhibits A 1st Rev., C-1,
and staff exhibit of Application 3 ZJ-87, except as may be amended by
the Conditions contained in this Resolution.
111 2. LANDSCAPING AND DRIVEWAY MODIFICATIONS
The landscape areas and northern driveway shall be modified to
reflect the arrangement shown on the staff exhibit.
3. APPROVED VARIANCE
This approval waives Condition 19b of the South Saratoga-Sunnyvale
Conceptual Zoning Plan and allows an average landscape depth along
the Saratoga-Sunnyvale Road frontage of approximately 30 feet as
shown on the staff exhibit of Application 1-U-87.
This approval also waives Condition 19c of the South
Saratoga-Sunnyvale Conceptual Plan and authorizes landscaping along
the Highway 85 frontage road as depicted on the staff exhibit of
Application 1 U-87
