OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A REQUEST FOR INTERPRETATION OF
OF A NIINOR AMENDMENT TO UTILIZE 1000 SQUARE t" 1' OF A SECOND STORY
MEZZANINE FOR OFFICE USES AND TO ALIAW A REDEVEIAPNENT FLOOR AREA
BONUS FOR AN EXISTING OrrmCE BUILDING
FINDINGS:
The Planning Commission finds as follows with respect to the this
application:
1. The redevelopment bonus floor area is warranted as the applicant's
project removed two blighted structures.
2. The amendment is minor in scope and generally consistent with the
original use permit for the project.
CONDITIONS ADMINISTERED BY THE PLANNING DEPARTMENT:
1. APPROVED EXHIBITS:
The approval is based upon Exhibits A-2, A-3, A-4, A-5, A-6 and B-2
of Application 13-U-84 except as may be amended by conditions
contained within this resolution.
2. ACQUISITION OF PROPERTY:
The applicant shall acquire the rights to the property shown on the
Staff Exhibit prior to issuance of tenant improvements permits
and/or occupancy for the second floor mezzanine.
3. REDEVELOPMENT BONUS:
A floor area bonus of 350 square feet is granted for redevelopment
as authorized by General Plan Policy 6.a.7 of 1-GPA-80.
4. OrriCE SPACE AREA:
Approval is granted for to utilize 1000 square feet of the second
floor mezzanine for office uses.

5. PARING SPACES:
The applicant shall restripe the parking lot to create a min;mim, of
29 parking stalls. A striping plan shall be submitted to and
approved by staff prior to striping. The lot shall be restriped
prior to occupancy of the second floor mezzanine.
The applicant shall cooperate with staff to solve future parking
problems should they arise.
6. MODIFICATION OF APPROVED DEVELOPMENT PLAN
In the event that the applicant or subsequent property owner shall
desire to make any minor changes, alterations or amendment of the
approved development plan, a written request or revised development
plan shall be submitted to the Director of Planning and
Development. If the Director makes a finding that the changes are
minor and do not result in a material affect upon the appearance or
function of the project, said changes may be certified on the
revised plan. If approval of said changes is withheld, the
applicant may appeal to the Planning Commission.
If the Director finds that the requested changes are material, such
changes shall be referred to the Planning Commission for approval.
• If the changes are denied by the Planning Commission, the applicant
may appeal to the City Council as provided in City Ordinance No.
652.
If said changes are approved by the Planning Commission, an appeal
may be made to the City Council by any interested party. Further,
anyMember of the CityCouncil. mayrequest a hearingbefore the City
Council regarding said approved changes. Said request shall be made
within ten (10) days from the date of approval of said changes by
the Planning Commission.
7. PHOTOGRAPH STUDIO/1=RIM USE
Approval is granted per the current property configuration (not
including use of parking on the adjacent corner triangle) for a
photography studio to accommodate a maximum of two persons.
Approval is granted for a period of 3 years (expiration on June 8,
1990) .
If the property owner acquires permanent rights to the parking on
the corner triangle parcel (per Condition #2) and complies with the
other conditions contained herein, the owner/applicant may use the
1,000 sq. ft. of mezzanine space for general office with no
restriction on the number of persons or limited time period.
