1 . Application B-TM-SS of CHARLES T. MASTERS: TENTATIVE
SUBDIVISION MAP to subdivide approximately 1.5 acres into six
single family residential lots. The subject property is located
on Jollyman Lane approximately 350 ft. east ❑f Stelling Road.
First Hearing continued. Tentative City Council hearing date
August 5, 1905.
Dir. of Planning 'and Development Cowan stated the new map
provides flexibility relative to potential subdivision designs
for property to the east and south, thus, staff recommends
approval of the new map.
Mary Kirkeby, civil engineer (Saratoga) , stated he had nothing to
add and he had no recommendations.
Charles T. Masters-, applicant, discussed the revised application
with the surrounding property owners concerning the dedication of
property. Mr. May, property owner to the west, asked that a
fence be placed on the northern boundary of his property in which
Mr. Masters agreed. to.
Ed Jauch, Cupertino, stated, in: summary, he wants to maintain the
present access of Jollyman Lane.

Irene Jauch, Cupertino, felt that the bulb of the cul-de-sac
should be reduced 11 ft. off their property.
Mary Kirkeby stated that the applicant is not proposing to
improve anything on the Jauch property at this time and that the
completion of the cul-de-sac would be done at the time of future,
development of the church. It was stated that the only
improvement to the Jauch property, atHi. this time, would be a
temporary curb.
Randall Smith, Redeemer Church, Cupertino, stated the road
planned to be constructed south of the church property would
eliminate approximately 19 large trees and asked that the
Commission consider not to construct la- road to the south of the
church. Mr. Smith. presented future plans for the sale of the
church property to the east and 'state,d the church disagreed with
the southerly shift of the cul-de-sac,
Irene Jauch disagreed with constructing the bulb of the
cul,-de-sac on their property and feltl'i would be an invasion of
their privacy. I'
Chairman Claudy stated the bulb was notlgoing to be constructed
at this time.

The Commission expressed they preferred the modification as

application 8-TM-85 as outlined in staff report subject to the
standard conditions, 17, 18 and the modification of condition 16
to show exhibit A 1st revision.

2. Application 21-U-85 of DAVE HOBSONV (RAYMOND ROOKER) : USE
PERMIT to convert a 1 ,000 sq. ft. single-story residence into a
2,030 sq. ft. two-story office building and ENVIRONMENTAL REVIEW:
The Environmental Review Committe recommends the granting of a
Negative Declaration. The subject property is located on the
south side of Granada Avenue approximately 100 ft. west. of
Imperial Avenue. Tentative. City Council hearing date - August 5,
1985.
Planning Director Cowan felt the facility is inconsistent with
the design objective for landscaping and the applicants second
• option held more merit.

Chairman Claudy expressed the concern about a note from the City
Clerk pertaining to there being an excess of office space in the
" City at the present time.
Director Cowan stated to the Commission there was a potpourri of
issues discussed at the City Council meeting and there was no
4111 indication for staff to consider any type of a moratorium.
Com. Sorensen stated she was at the City Council meeting when
this issue was brought to the attention of the Council. She said
that Councilmember Gatto brought up the point that if a
moratorium were to be made it would be done by the banks lending
the money for such office buildings.
RayRooker, architect, Cupertino, expressed theyare not doinga

minor conversion but are going to do a major renovation and major
remodel to the existing house. After describing the landscaping
for Scheme A and Scheme B, Mr. Rooker stated they preferred
Scheme A. In response to a question by the Commission, Mr.
Rooker said there was ample area for a turn around for parked
cars.
Dave Hobson, applicant, briefly discussed the type of business
that would occupy the office.
Ray Rooker stated the office space would be reduced by removing
approximately 1 ft. off the front and west side of the proposed
building.
Director Cowan said that the joint interfacing of landscaping
between the two projects relieves staff concerns.

Commissioners Sorensen, Mackenzie and Chairman Claudy stated they
preferred Scheme A while Com. Adams favored Scheme B.
Commissioner Szabo felt the residence should be left as is and it
should not be allowed to convert into an office.
Director. Cowan suggested making a condition to require or
obligate the applicant to work with the owner to the west in
terms of joint sharing.
MOTION: Com. Mackenzie, to recommend the granting of a negative
declaration

MOTION: Com. Mackenzie, moved to approve application 21-U-85
subject to the findings in the staff report with Standard
Conditions 1-15; Condition 16 modified to specify Alternative l
(1)"j; Condition 17, 18; modify Condition 19 to indicate the
applicant reduce a proposed office building to approximately 1750
sq.'' ft. and delete the remainder of Condition 19; Condition 20,
21 and 22 from staff report. Add condition 23 requiring the
applicant to develop a better landscaping plan to the south of
the'' property. Modify condition 12 to indicate that a fence will
be built .between the applicants property and the residential
property to the east that conforms wilth the Monta Vista
guidelines.

3. Application 24-U-85 of BRUCE TERRY AND STEVE. BUXA (DOMINOS
PIZZA) : USE PERMIT to operate a takeHout and delivery pizza
business and ENVIRONMENTAL REVIEW. T,le project is categorically
exempt, hence to action is necessary.H The subject site is
located in the Portal Plaza Center onj 'the north side of Stevens
Creek Boulevard approximately 400 ft.', :east of Portal Avenue.
First Hearing. Tentative City Council hearing date August 5,
1985.
Steve Buxa, applicant, stated due toti a and cost of trying to
find a location and limited budget they would not be able to
replace major landscaping but they would offer to place a few
plants where needed. Mr. Buxa said that the owner would not put
any money or effort into a major landscaping project. •
In response to questions by the Commission, Mr. Buxa stated there
was not a back door and 'there was a chain across the rear access •
bloacking entry to back o the building.

Director of Planning and Development Cowan stated that staff will
pursue the matter of improving the landscaping at Portal Plaza
along Stevens Creek Boulevard.

•Commission discussed the changing of conditions so the applicant
isn 't responsible for the improvements of landscaping within
Portal Plaza. - -
MOTION: Vice Chairman Szabo, moved to ecommend approval of •
24-U-85 with conditions 16, - 17, 19, 20, and all other conditions
deleted. One of the conditions to stat that this application
doesn 't provide leverage on the owner ',and it is a business that
is Useful and will contribute to revenue for the City.

4. Consider a comprehensive amendment to the Trailer Ordinance.
110 Andrew Ziegler, 825 Kim Street, Cupertino, presented to
Commission pictures of campers, trucks, cars, etc. which were
parked on Kim Street. Mr. Ziegler stated this made it hazardous
for him to get in and out of his driveway.
Ann Anger, Cupertino, suggested to the Commission the parking of
cars, trucks, etc. be restricted from the street.
Commission stated there would be another public hearing on the
topic ❑f Trailer ❑rdinances from other cities when a report is
presented by the staff. ,
Director of Planning and Development Cowan stated there was going
to be another code enforcement officer added to the staff.
MOTION: Com. Mackenzie, to continue public hearing on August 26,
1985.

5. Methodology for computing floor area for buildings. .
111 Commission requested that the staff report be reworded by
deletingthe word exterior fromparagraph two.

REPORT OF THE PLANNING COMMISSION:
Director of Planning and Development Cowan, in response to a
question by ,the Commission, stated that there is now motor cycle
officers in the City of Cupertino.
REPORT OF THE PLANNING DIRECTOR:
Director of Planning and Development Cowan informed the
Commission that -a memo was given to them from the Mayor
concerning the deadline for reservations and to please contact
Laura. Mr. Cowan stated that there was to be a meeting next
Monday on Civic Center Action.
