MINUTES OF THE REGULAR ADJOURNED MEETING OF THE PLANNING
COMMISSION. HELD ON JULY 10, 1985 IN THE COUNCIL CHAMBERS,
CITY HALL, CUPERTINO, CALIFORNIA
The meeting was called to .order by Chairperson Claudy at 7:33 p.m.

5. Application 21-U-85 of DAVE HOBSON (RAYMOND ROOKER): USE PERMIT to ,
convert a 1,000 sq. ft. single-story residence into . a 2,030 sq. ft.
two-story office building and ENVIRONMENTAL REVIEW: The, Environmental
Review Committee recommends the granting of a Negative Declaration.
The subject property is located on the south side of Granada Avenue
approximately 100 ft. west of Imperial Avenue in, a P (Planned
Development with 4-12 dwelling units per gross acre intent)- zoning
district. First Hearing. Tentative City Council hearing date -
15, 1985.
It was moved by Coma Sorensen, seconded by Com. Mackenzie and passed
unanimously to continue consideration of this application to the regular
meeting of July 22, 1985.
6. Application 22-U-85 of BEIM AND JAMES PROPERTIES III: USE PERMIT to
construct a three story, 38,700 sq. ft. office building and remove an
existing restaurant on the site. ENVIRONMENTAL REVIEW: The
Environmental Review Committee recommends the granting of a Negative
Declaration. 'The subject property is located on the west side of
North De Anza Boulevard approximately 130 ft. north of Valley Green
Drive in a P (Planned Development with General Commercial, Light
Industrial and Residential 4-10 dwelling units per gross acre intent)
zoning district. First Hearing. Tentative City Council hearing date
July 8, 1985..
Dir. of Planning and Development Cowan said the only question staff had
regarding this ' application was the methodology for counting the space in
the office buildings.
Bob Beim, applicant, Menlo Park, said that the development will proceed at
a reasonably slow rate and hopes . to pre-lease space during the building
process. In response to a Commission question he said that it could be
4111 possible to lease to a restaurant owner..

Bill Bocook, Palo Alto, addressed the Commission's concerns regarding the
concept of a green building next to Anthony's Restaurant which has a blue
roof. He stated he did not believe it would be too- much contrast and. that
there would be a strong grove of trees; between the two buildings. He said
that the Sobrato building across De ;Anna Blvd. would also be a granite
building.

Mr. Beim said that he felt the colors of the blue roof and the - green
building would blend nicely. '
Mr. Bocook reviewed the design with the Commissioners. He said that
access would be completely at the back of the building with the parking in
the back. There would be generous landscaping on all sides. The building
is divided- into two cubes which are angled so there is no long wall.
There would be some deciduous trees . that would be planted for fall
colors. The equipment on the roof will be screened. .

It was moved by Com. Mackenzie, seconded by Com. Sorensen and passed
unanimously to close the public hearing'.
The Commission expressed a liking for - the design but was concerned
.regarding possible vacancy rate. They felt that a restaurant or office
would bean appropriate choice on thisqsite.
It was moved. by Com. Sorensen, seconded by Com. Mackenzie and passed
unanimously to recommend the grantingof a Negative Declaration.

It was moved by Com. Sorensen, seconded by Com. Mackenzie and passed with .
a 'unanimous vote to recommend approval of Application 22-U-85 subject to
the standard conditions approve the exhibit, conditions 17, 18, 19 through
25 as per staff recommendation and repoirt. -
7. Application ' 24-U-85 of BRUCE TERRY D STEVE BUXA (DOMINO'S PIZZA): -
USE PERMIT to operate a take-out, nd delivery Pizza • business and
ENVIRONMENTAL REVIEW: The project is categorically exempt, hence, no
action is necessary. The subject site is located in the Portal Plaza
Center on the north side of Stevens Creek Boulevard approximately 400
ft.. east of Portal Avenue in a P- (P1 nned Development with Commercial,
office and Residential intent) zoning district. First Hearing.
Tentative City Council hearing date - July 15, 1985.
It was noted that the applicants were not present. '
Commission did express some concern regardding the location of the proposed
pizza parlor and requested that the item be continued to give the owner
and applicant a chance to respond to those questions.
It was moved by Com. Mackenzie, sec nded by Com. Adams and passed
unanimously to continue consideration �of Application 24 -U-85 to the
meeting of July 22, 1985 and that staff notify the applicant and property
owner.

UNFINISHED BUSINESS:
1110-4 8. Discussion of Schedule for Semi-Annual General Plan Amendment.
The Commission discussed the possibility of rezoning the present
commercial/office use to residential; where there is mixed use in Monta
Vista, should be rezoned to residential; should the Commission look for
conversion of vacant office to residential.
Director of Planning and Development Cowan said that he could give the
Commission a map showing current vacancies and areas zoned for
commercial/office. -
It was suggested that a separate hearing regarding this matter be held in
the fall of this year.
Mr. Cowan stated that the Housing Element of the General Plan does need to
be done and perhaps the Commission could look at this particular item in
conjunction with the Housing Element.
It was moved by Com. Mackenzie, seconded by Com. Sorensen and passed
unanimously to approve a minute order requesting the City Council initiate
hearings as per staff report.
NEW BUSINESS:
None
REPORT OF THE PLANNING COMMISSION:
Upon being asked by a commissioner Mr. Cowan stated that there is an
expansion and an addition of a kiosk to the Shell gas station located on
the corner of North Stelling and Stevens Creek Blvd.
REPORT OF-THE PLANNING DIRECTOR:
Mr. Cowan informed the Commission that the staff will send a memo to the
City Council regarding the Amelia Court decision should a Councilmember
wish to appeal.
