special regulations for various planning areas.

Staff Presentation: Mr. Caughey presented staff report. He explained the
proposed uses of the Manual and that it is a companion piece to the
General Plan revision. In response to Com. Mackenzie's question, he stated
recommendations for changes can be made.
Com. Mackenzie stated that he would like to see more clarity on the tips
and a set trip generation number should be applied evenly unless there are
extraordinary circumstances.
Com. Adams noted the detailed explanations should be written in the
appendix. Chr. Claudy expressed concerns regarding the use changes and
the assignment of trips.
Mr. Caughey pointed out the Manual did stipulate that if the trip rate for a
particular use changed, the use permit can be modified for similar uses.
In response to Com. Fazekas's question, he stated a study would be done to
determine an extraordinary use.
Com. Mackenzie questioned the basic 16 trips per acre, stating this was
originally based on the traffic capacity, but by changing trip rates
development is no longer based on traffic. He also expressed concerns
about the policy regarding the extraordinary amenity space and volume. He
noted another condition should be added concerning amenity space.
Mr. Caughey noted that amenities are a judgment based on review of the
Planning Commission and conformance to the General Plan objectives. He
noted that development should be based on gross building area and not
leasable building area.
Com. Mann expressed concern regarding amenity space and the possibility
of using it as leasable area. Com. Mackenzie suggested public
accessibility should be weighed when reviewing public amenities. He
stated that expanded trip generation rates should require Commission or
Council approval rather that staff approval.
Mr. Caughey stated that standard trip generation rates should be a policy
decision of the Council.
Chr. Claudy opened the meeting for public input.

Mr. Herman Hijmans, Top Furniture, asked if trip generation rates would
come up in the General Plan review.
Mr. Caughey explained that if a major change occurs in the review of the
trip generation rates, then it would be an issue in stage 3 of the General
Plan review. He stated the Manual would be revised and brought back for
Planning Commission review and asked the Commission if they would
clarify the Trip Allocation Policy for a change in use for a furniture store.
Mr. Robert Bernstein, Architect, questioned whether he could put a more
intensive use on the site without requiring a use permit.
Com. Mackenzie suggested looking into the non-conforming use ordinance
and if not applicable a use permit would be required.
Mr. Caughey stated this item would be continued to February 26, 1990.
ITEM 3:
Report of the Community Development Director on the status of
regulations for outdoor display of merchandise.
Staff Presentation: Ms. Ciddy Wordell presented the staff report. She
explained the regulations between long term and short term outdoor
display.
Chr. Claudy expressed concerns about year round outdoor display of
merchandise. He stated three issues: merchants are exceeding there
allotted square footage; more subjective issue of attractiveness; issue of
safety regarding the fire lane.
Com. Mann stated her concerns of merchants using the sidewalks for
displays. Com. Mackenzies noted this was a use permit issue.
Mr. Caughey gave direction to relieve this problem.
Com. Mann expressed concern about outside storage of shopping carts.

REPORT OF THE PLANNING COMMISSION:
Com. Mackenzie asked staff to research the use permit for the Arco
service station on South Saratoga-Sunnyvale road for location of the cash
register.
Com. Adams asked staff to look into the service station at McClellan and
DeAnza for illegal storage of cars. He discussed the Mayor's Luncheon.
Com. Adams asked staff to look into a possible water leak on Twilight
Court.
The Commissioners discussed who would be representing the different
committees.
Chr. Claudy discussed the possibility of reusing garden clippings as mulch
and suggested the Energy Commission look into this matter.
