Reso 2750 RESOLUTION NO. 2750 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING CHANGES TO THE GENERAL COMMERCIAL ZONING 110 ORDINANCE TO REQUIRE USE PERMIT REVIEW FOR CERTAIN USES LISTED BELOW. • APPLICANT: City of Cupertino ADDRESS: 10300 Torre Avenue, Cupertino, California 95014 SUBMITTED: November 20, 1985 LOCATION: Citywide FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and the subconclusions as set forth in the minutes of the Planning Commission meeting of December 11, 1985 and the following: 1. Restaurants typically generate traffic levels which may impact surrounding streets and may be a disturbance to neighboring property owners, residents, or business patrons. 2. New restaurant operations may impact available parking facilities and require measures to mitigate on-site and off-site impacts. 3. The number of service stations which offer minor maintenance services is declining due to land values and • shifting market trends. 4. Minor maintenance of motor vehicles may be allowed as a primary use on some commercial sites if off-site impacts and aesthetic concerns are mitigated. 5. Specialty food stores, laundry establishments, and retail dry cleaning establishments may create off-site impacts due to noise, traffic, parking, litter, loittering or unrestricted hours. Changes to Ordinance No. 1295 are recommended as follows: 1. Delete Section 5e and re-letter remaining sections. 2. Amend Section 6g to add the words "or without" in the first line after the word "with". 3. Delete the words "as a subsidiary activity" from the end of Section 6o. 4. Include the following under uses which require Use Permit review: a. Specialty food stores such as bakeries, donut shops, ice cream stores, produce markets and meat markets, or similar establishments where food is prepared and/or sold primarily for consumption off the premises. Retail dry cleaning establishments, provided that the solvents used in the cleaning process shall be non-flammable and non-explosive and are in fluid-tight cleaning units approved by the State Fire Marshall. No dry cleaning is permitted of clothes other than those delivered to the establishments by retail customers.
