In the event a conflict does exist, the special conditions as enumerated herein shall . . apply. 17. Exhibits That the recommendation of approval is based on Exhibit A of Application 28-Z-85 except as may be amended by special conditions enumerated herein. 18. Permitted Uses The existing uses specified below are hereby included in this approval. A use permit shall be required for any activity occupying the vacant 6000 sq. ft., with the exception of school activities sponsored by the school district. Existing Uses Sq. Footage Hours K-6 elementary school 32,000 7AM-l0PM Special education (handicap) 3,200 7AM-10PM classes Extended day care program 1,800 6AM- 6PM Family counseling program (maximum 30 families) Administration: 1,000 8AM- 5PM Counseling: N/A 5PM-l0PM - 2 - CITY OF CUPERTINO 411 City Hall, 10300 Torre Avenue Cupertino, California 95014 Telephone: (408) 252-4505 RESOLUTION OF THE PLANNING COMMISSION OF, THE CITY OF CUPERTINO RECOMMENDING THE GRANTING OF A ZONE CHANGE WHEREAS the attached application has been submitted to the City of Cupertino requesting a change of zone in the zoning regulations of the City, as stated on Page 2; and WHEREAS the Planning Commission has held at least one public hearing in regard to the application on the date as noted on said application; and WHEREAS the Planning Commission has duly considered and heard all evidence submitted in regard to said application; and WHEREAS the necessary public notices have given as required by the Zoning Ordinance of the City of Cupertino: 9 NOW, THEREFORE, BE IT RESOLVED: That the Planning Commission finds that the proposed zone change: • a. Encourages the most appropriate use of land. b. Conserves and stabilizes the value of property. c. Provides for adequate open spaces for light and air. d. Permits adequate control of fires. e. Promotes the health, safety and public welfare. f. Provides for the orderly development of the City. g. Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located. That said Planning Commission, therefore, reports favorably to the City Council in the matter of granting said zone change. • " d RESOLUTION 2742 12-09-85 Page - 3 The extended day care program shall be for children attending Older Elementary School only. The family counseling program shall be for the families of children attending Cupertino Union School District only. 19. PARING If parking problems develop in the future, the Planning Commission reserves the right to assess the impact on parking of the family counseling program. If the Commission finds the family counseling program is contributing to the parking problems, the Commission may require measures to mitigate the problem, including possibly restricting the program.
